SUPPLIES OR SERVICES AND PRICES

1. Description of Services

The contractor shall provide all management, supervision, labor, materials, supplies, and equipment; and shall plan, schedule, coordinate and ensure effective supply and delivery of propane and/or fuel oil in accordance with requirements described herein.

See Exhibit 1.

The contractor shall automatically (i.e., without a separate request or order from the

Government) deliver the appropriate fuel to each location in order to maintain a minimum of 35% of the tank(s) capacity at all times at each location. The sole exception is the Cargo Building propane tank at Highgate Springs, Vermont, which shall be maintained at a minimum level of 45%. In addition, prior to anticipated severe weather and ice storms, at the Government’s request, the contractor shall fill the tank to 100% capacity levels.

Most locations operate 24 hours per day, 365 days per year, including all holidays.

However, regardless of the building hours, the contractor shall deliver to all locations at all hours, including weekends and holidays, necessary to maintain the minimum required levels in each tank.

The Contractor shall provide a metered delivery ticket to the Contracting Officer’s

Representative (COR) immediately upon delivery or by the next business day if the delivery takes place after hours, or on the weekend or holiday. The delivery ticket shall include the following information at a minimum:

Date of delivery;

Total gallons delivered;

Price per gallon. The ticket shall clearly indicate each of the following prices

(See Section 2, Price, for definitions):

o Index Rate o Contractor Margin o Total Unit Price

Government Surveillance. The COR shall verify that the correct pricing is indicated on each delivery ticket in accordance with Section 2, Price. The COR shall also verify that each delivery occurred. All deliveries shall be tracked, including gallons and price, to ensure that the Contractor does not proceed beyond the ceiling price for each location.

2. Price

The contract unit price per gallon of oil and propane will consist of two components – the current index rate and a margin inclusive of all contractor markup. The unit price is expressed as follows: Price per Gallon = Current Index Rate + Contractor Margin.

Index Rate. Contractor shall propose the current index rate(s) to be used for this contract and provide supporting documentation and website to verify the current index rate. This index rate shall be based on the current rate 1 day prior to the proposal due date. This rate will be used for purposes of calculating the total evaluated price.

The total unit price per gallon of fuel will depend upon the individual delivery date, as the index rate fluctuates. The applicable index rate will be the rate in effect on the delivery date.

The contractor shall provide to the Government a receipt for all fuel deliveries. The receipt shall clearly indicate the unit price for the fuel delivered – broken down to show the current index rate and the contractor margin.

Contractor Margin. The Contractor Margin is fixed and includes all markup above the index rate. This includes, but is not limited to: delivery charge (including labor and transportation), overhead, profit, applicable taxes and duties, etc. The margin is fixed and will not fluctuate with changes to the index rate.

Ceiling Price. In accordance with the Description of Services above, the Contractor shall make continuous deliveries on an as-needed basis, but shall not exceed the stated contract ceiling amount per location. The Ceiling Price for each location and fuel type will be the total lump sum price for each contract line item.

The Contractor must refer to the FAR clause 52.228-5 "Insurance - Work on Government Installation" incorporated by reference herein. The coverages specified below, pursuant to Subpart 28.307 of the Federal

Acquisition Regulation (FAR), are the minimum insurance required.

(a) Workers' Compensation and Employer's Liability. Contractors are required to comply with applicable

Federal and State Workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least

$100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.

(b) General Liability. The contractor shall provide bodily injury liability insurance coverage written on the comprehensive form of policy of at least $500,000 per occurrence.

(c) Automobile Liability. The contractor shall provide automobile liability insurance written on the comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage. The amount of liability coverage on other policies shall be commensurate with any legal requirements of the locality and sufficient to meet normal and customary claims.

INSTRUCTIONS TO OFFERORS

52.212-1 - Instructions To Offerors—Commercial Items (Apr 2014)

SUBMISSION REQUIREMENTS

The offeror, at its discretion, can submit pricing for any combination of buildings. For example, it may submit pricing for all Buildings, or any of the buildings independently. For each building an offer is submitted, offerors shall price all line items under that building.

Each building will be evaluated separately, allowing for the possibility of a multiple award.

PRICE AND BUSINESS PROPOSAL

Each offeror shall submit a proposal containing the following:

1. PRICE PROPOSAL

The offeror shall complete and return an original, signed Standard Form (SF) 1449

(Solicitation/Contract/Order for Commercial Items) with its offer. Offerors shall price all contract line items. In addition, offerors shall complete the pricing calculation spreadsheet that breaks out the Margin

Rate and Index rate. The Index Rate(s) will be verified along with the website and supporting documentation provided.

2. TECHNICAL

Past Performance and Experience

The offeror shall provide a minimum of three (3) references for projects that are similar in magnitude, scope and complexity to that identified in this solicitation, preferably from three (3) separate contracts.

For Experience, the contractor shall provide a list of similar projects comparable in magnitude, scope, complexity and duration to the requirements as defined by this Request for Proposal, including Scope of

Work. The list shall include fuel type, delivery locations, and the estimated annual delivery quantities per year.

Spill Response Plan

Provide a draft Spill Prevention & Response Plan. The supplier must prove that they can effectively prevent and contain any fuel spills and prevent contamination to the surrounding ground, storm drains or downhill contamination to local waterways. The contractor must certify that their drivers have been trained on spill prevention. They must also prove that they have an effective means of communication during a spill containing 10 or more gallons. This plan shall include emergency contact numbers for:

their own company, remediation companies and State & Federal authorities in the event of a major fuel spill containing 10 or more gallons.

3. CURRENT CERTIFIED FINANCIAL STATEMENT(S)

Offerors shall submit a copy of the last certified financial statement prepared for the offerors firm along with a copy of any interim reports since the closing date of that statement. These statements will be used in determining the offeror’s financial capacity to perform the work required by this contract. Offerors may use GSA Form 527 to disclose financial information in lieu of submitting a certified financial statement.

4. REPRESENTATIONS AND CERTIFICATIONS OF OFFERORS

See FAR Clause 52.212-3 (Offeror Representations and Certifications – Commercial Items) for submission requirements.

Submission of Proposals

A. Offerors are requested to submit an electronic proposal to Contract Specialist, Sotheavy Khon via email at sotheavy.khon@gsa.gov. Electronic proposals must be submitted in PDF format and shall not exceed 25MB per email submission. Offerors are cautioned to allow sufficient time for firewall security screening.

Proposals shall be received no later than 2:00 p.m. local time on September 12, 2014.

Offerors are cautioned to make their initial offer their best offer. In accordance with FAR 52.212-1(g) the

Government intends to award on the basis of initial offers, but reserves the right to conduct discussions if determined by the Contracting Officer to be necessary.

EVALUATION OF OFFERORS

FAR 52.212-2 Evaluation – Commercial Items (JAN 1999)

(a) Award(s) of this contract will be made on a competitive best value basis using the “Lowest Price, Technically Acceptable” approach. Evaluation will be made to identify all Offerors whose proposals are technically acceptable in accordance with the Statement of Work (SOW) and the evaluation criteria set forth below. Award(s) will be made, by building, to the Offeror(s) from the pool of technically acceptable proposals, whose Total Evaluated Price is lowest. Technical acceptability will be determined by evaluating the following non-cost/price factors: Experience and Past Performance and Spill Response

Plan.

An evaluation for technical acceptability will be made to ensure satisfactory responsiveness to the requirements as set forth in this solicitation. Each non-price factor will be rated “Acceptable” or

“Unacceptable” using the following criteria:

Acceptable: A proposal is acceptable if it demonstrates to the government evaluators that the Offeror can provide:

(a) Experience and Past Performance indicates that the Offeror will be able to comply with all contract requirements and has the ability to provide an overall satisfactory quality of performance.

(b) Spill Response Plan adequately addresses how the offeror will be able to promptly and properly respond to spills.

Unacceptable: A proposal will be deemed unacceptable if the Offeror fails to demonstrate the ability to comply with all contract requirements, provide a satisfactory level of performance or submits an offer that does not adequately respond to the solicitation requirements or introduces too much risk.

mailto:sotheavy.khon@gsa.gov

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the

Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

PRICE EVALUATION

The price will be calculated per the calculation spreadsheet (attached) for each contract line item on the

SF 1449. The Total Evaluated Price will be calculated based on the contract line items bid for the base year plus Option Year 1 and Option Year 2.
