Order against: |X| FSS Contract Number: GS-07F-217CA

Name of Proposed Contractor:
SIEMENS INDUSTRY INC
Street Address:
1000 DEERFIELD PKWY
City, State, Zip:
BUFFALO GROVE, IL 60089

3. Description of Supplies or Services:

The estimated value of the proposed action is $

a. Siemens is the manufacturer of the fire alarm system equipment installed across the Jesse Brown VAMC campus.

b. They are the only provider of the proprietary software used to service the installed system.

c. Siemens is the only service provider who can program the panels for the system.

d. Siemens employees are certified on the Siemens equipment.

e. Siemens offers high security service and technical support due to the sensitivity of the operations they are servicing.

f. Siemens is the only vendor that will be able to provide marketing updates, firmware or software releases, TechALERT notices and product application notices.

4. Authority:

Order Against FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception:

|X| An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A);

a. |X| Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; Siemens is the only provider of the proprietary software used to service the installed system.

(FAR 8.405-6(a)(1)(i)(B));

|_| In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405-6(a)(1)(i)(C)); or

|_| Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)).

5. Rationale/explanation to support cited authority Siemens Industry Inc. is the original manufacturer of the equipment, and the only company with the knowledge, parts, and software codes required to maintain the MXL Fire Life Safety System. The facility has expended an estimated to acquire the aforementioned proprietary fire alarm system, precluding the use of other vendors’ items and services for this requirement. If another vendor’s items were used, a new fire alarm system would need to be procured at an additional and excessive cost to the Government. Similar systems currently cost approximately $165,000.00 -180,000.00 per year for this service based on other awards for the same service.Price reasonableness was determined at the time of award of the GSA contract (GS-07F-217CA) for all the services and parts that will be covered under this task order. Due to the emergency need for this procurement a notice to proceed was issued so the inspection of the system be conducted immediately.

6. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
