1. Contracting Activity: Department of Veterans Affairs, VISN 17, Network Contracting Office 17, Central Texas Environmental Management Office. 2237# 674-20-2-5122-0030
2. Description of Action: : CTVHCS requires professional on-site document collection, destruction and disposal services IAW National Association of Information Destruction (NAID) and all federal, state, and local laws, regulation and ordinances. The period of performance for the base period is April 1, 2020 through June 30, 2020 with a 3-month option period. This is a follow-on contract to GS-03F-

3. Description of Supplies or Services:
The estimated value of the proposed action is $92,976.00
CTVHCS requires professional on-site document collection, destruction and disposal services IAW National Association of Information Destruction (NAID) and all federal, state, and local laws, regulation and ordinances. The period of performance for the base period is April 1, 2020 through June 30, 2020 with a 3-month option period.
The incumbent task order (VA257-15-F-0062) expires on March 31, 2020 and all options have been exhausted. A long-term contract has been in development since August 2019. There is a lengthy OGC review process of each shredding requirement which has caused delays in awarding the new long-term contract. An emergency bridge contract must be awarded to cover services until the new long-term contract is awarded. Current milestones estimate the long-term contract to be awarded in July 2020.
The CS searched VIP using NAICS code 561990 and keyword “Document”, which revealed 106 found through the VIP search. The CS then emailed the owner of RW Lone Star Security and he confirmed they can meet the requirement.
4. Authority:
Order Against FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception:
An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A);
Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; (FAR 8.405- 6(a)(1)(i)(B));
In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405-6(a)(1)(i)(C)); or
Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)).
Rationale/explanation to support cited authority: The incumbent contract (VA257-15-F-0062) expires on March 31, 2020 and all options have been exhausted. A long-term contract has been in development since August 2019. There is a lengthy OGC review process of each shredding requirement which has caused delays in awarding the new long-term contract. An emergency bridge contract must be awarded to cover services until the new long-term contract is awarded. Therefore, a logical follow task order IAW FAR 8.405-6(a)(1)(i)(C) is the most efficient manner to meet this requirement as introducing a new contractor at this point would cause unnecessary administrative and logistical burdens to include a possible increase in cost. Current milestones estimate the long-term contract to be awarded in July 2020.
5. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
