About this file
This is a Justification and Approval (J&A) document for sole source procurement by the Naval Surface Warfare Center Indian Head Division. The J&A (Number: FY25-JAN28-74) authorizes a sole source contract award to Teledyne FLIR Defense Inc. (Stillwater, OK, CAGE Code: 4ZCA0) for maintenance and support services and spare parts for Griffin 460 Gas Chromatography-Mass Spectrometry (GC/MS) chemical sensor instruments. The contract structure includes one base year plus four option years. Required items include extended warranties (Part Number 400EXTWAR), Sorbent Tube Cartridges (201-014-0054, 4/unit), GC Maintenance Kits (241-005-0011, 2/unit), RI Calibrant Kits (241-005-0078, 2 units), and Ionization Filaments with 6-month warranty (460-001-0024, 2/unit).
The justification cites 10 U.S.C. 3204(a)(1) authority for "Only One Responsible Source" and emphasizes that the Griffin 460 instruments are critical life safety systems providing early chemical threat detection. The Navy conducted market research including a Sources Sought notice posted January 2, 2025, which received three responses, with only Teledyne FLIR determined technically capable. A pre-solicitation notice was published January 21, 2025, receiving zero responses. The document notes this is a follow-on to previous sole source contract N0017421P0186 and warns that using unauthorized service providers could void warranties and create vulnerabilities in the Chemical, Biological, and Radiological (CBR) sensor system. The J&A was approved by Deputy Chief of Contracting Office Rachel N. Luther on May 14, 2025.

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center Indian Head Division (NSWC IHD), Contracts Office Code 026.
2. Description of the Action Being Approved
Award of a sole source contract for maintenance and support services, and spare parts for the Griffin 460 chemical sensor operation to:
Teledyne FLIR Defense Inc.
1024 S Innovation Way Stillwater, OK 74074 Cage Code: 4ZCA0
3. Description of Supplies/Services
This requirement includes extended warranties, training, and spare parts to support seamless operation of Griffin 460 Gas Chromatography–Mass Spectrometry (GC/MS) instruments owned by the
The following is specifically required annually to ensure the systems are maintained adequately to remain fully operational:

Teledyne FLIR, Inc. will provide maintenance, repair, and service updates on Griffin 460 instruments through the extended warranties. It will also provide spare parts and advanced training.
The contract will be for one (1) base year, plus four (4) option years. The total is anticipated to be .
4. Statutory Authority Permitting Other Than Full and Open Competition.
This acquisition is being conducted under the authority of 10 U.S.C.
3204 (a) (1), Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
This is a follow-on acquisition from previously awarded sole source contract N0017421P0186. The Griffin 460 GC/MS instruments are part of a critical life safety system utilized to provide early detection of chemical threats to facilities and personnel. This procurement is required to satisfy Support Program-specific mission requirements related to National Security in direct support of currently fielded equipment. It is critical that Griffin 460 GC/MS instruments’ extended warranties and parts, and the training required for their operation are procured annually to ensure the operational capabilities of the systems. Inability to procure extended warranties, training, and parts could produce an unacceptable vulnerability in the Chemical, Biological, and Radiological (CBR) Sensor System, posing an untenable safety risk. Training is essential for R23 personnel to maintain excellent technical proficiency in operation of Griffin 460 GC/MS instrument. Loss of this equipment support would present tremendous risk to the Griffin 460 GC/MS instrument capabilities, with a likely potential to degrade operational availability for extended periods of time.
To ensure integrity of the systems, the parts required must be compatible (form, fit, and function) with the currently installed parts on the systems. The services must be provided by an authorized service provider to ensure the warranties remain valid. If one (1) of the Griffin 460 GC/MS instruments is degraded to the point of needing a complete replacement, it would cost the government approximately to replace just a single (1) unit, and an expected loss of detection capability for an estimated period of three (3) to six (6) months. In addition, the government’s investment of over in this equipment would be lost were the equipment to become inoperable.
In addition, obtaining the required support from any provider not offering fully-authorized manufacturer maintenance service and warranties is untenable. If equipment problems arose in the future and an unauthorized provider had been used to maintain these instruments, not only could the unauthorized service result in vulnerabilities in the detection system, but Teledyne FLIR Inc. could decline to honor warranties on parts and service, or refuse to service the equipment altogether.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Market research performed through internet searches and contact with the original equipment manufacturer (OEM) has shown the following: 1) Teledyne FLIR, Inc. is the OEM of the proprietary Griffin 460 GC/MS instruments, provider of extended warranties, distributor of genuine Griffin 460 parts, and provider of expert level training. Teledyne FLIR, Inc. possesses comprehensive knowledge of the technology used in the equipment; 2) While other vendors purport to offer extended warranties for the Griffin 460 GC/MS, none of the warranty offers are co-extensive with OEM warranties or sufficient for the equipment required to be serviced under this acquisition; 3) The query of government Subject Matter Experts (SMEs) knowledgeable in the maintenance requirements of the Griffin 460 GC/MS instruments and familiar with warranty requirements has shown that Teledyne FLIR, Inc.
has extensive knowledge of the specific Griffin 460 GC/MS instruments owned by the and is uniquely suited to provide the services/parts referenced.
A Sources Sought notice was posted on 02 January 2025 to the System for Award Management (SAM.gov) website to satisfy requirements for Defense Federal Acquisition Regulation Supplement 206.302-1(d). Three response(s) were received. Of the responses that were received, technical reviewers determined only one capability statement among the responses rendered the response technically capable of fulfilling the requirement’s needs, that being the sole source provider Teledyne FLIR, Inc.
As required by FAR 5.203, a pre-solicitation notice was publicized on SAM.gov on 21 January 2025. 0 responses were received.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government for the services covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in paragraph 5, NSWC IHD Contracts Department has no plans at this time to compete future contracts for the types of service covered by this document. If another potential source emerges for this comprehensive requirement, NSWC IHD Contracts
Department will assess whether competition for future requirements is feasible. As this is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(S-70)(i), the prior J&A was provided to the approval authority for review. Approval of this J&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(S-70)(ii).
