About this file

This is an Amendment No. 1 to a Special Procurement request issued by the State of Oregon's Department of Consumer and Business Services, Division of Financial Regulation. The amendment seeks approval to extend the term of Special Procurement S-44000-00001298 for Google Advertisements to enable continued statewide outreach advertising with Google Inc. The original Special Procurement was issued on November 18, 2021, with an initial term running from November 29, 2021, through November 30, 2025. The amendment requests an extension from December 28, 2026, through December 31, 2031, a five-year extension period. The services involve ongoing agency outreach through Google Advertisements, including targeted advertising campaigns that can be adjusted based on current events, consumer risks, and unforeseen emergencies such as natural disasters or emerging consumer scams. The procurement is classified as a Contract-specific Special Procurement under Oregon Administrative Rule OAR 125-247-0288(5), which permits the purchase of media advertising without competitive bidding.

The original Special Procurement was established with an estimated cost of $145,000.00, with a corresponding internal Purchase Order (13-1044) created on December 28, 2021, for tracking purposes. As of August 11, 2026, approximately $38,000.00 had been expended, with advertising services paid through the Agency SPOTS card. The amendment requests a total estimated cost of $0.00 for the extension period, indicating that no additional funding allocation is being requested at this time. The Special Procurement was justified based on Google's dominance as an online search engine platform and its capability to reach a large statewide audience across multiple languages and geographic areas of Oregon. The agency determined that competitive procurement would not yield different results given limited advertising options with comparable reach and effectiveness. Google Analytics capabilities enable the agency to optimize advertising expenditures by measuring engagement and effectiveness. The amendment is subject to a seven-day public notice period on OregonBuys, with provisions for interested parties to file protests, and requires Enterprise Information Services review and potential Department of Justice legal sufficiency review prior to execution.

8. Total Estimated Cost for Amendment Time Period: $0.00

9. Title: Supplies and/or Services to be acquired:

Ongoing Agency outreach through Google Advertisements.

10. Amendment Request, Background, Current Need, and Proposed Contracting Procedure:

a. Amendment Request:

Agency requests approval to amend the SP to extend the term to allow Agency to continue statewide extended outreach advertising with Google Inc.

Advertising is a type of SP established in rule, OAR 125-247-0288(5), and allows Agency to purchase media advertising, regardless of dollar value, without competitive bidding.

b. Background:

Special Procurement S-44000-00001298 was issued on November 18, 2021, for $145,000.00.

The Special Procurement term was November 29, 2021, through November 30, 2025. Agency posted the SP notice on OregonBuys for the required seven (7) days; no protests were received.

As a result, Purchase Order numbered 13-1044 was created on December 28, 2021, for $145,000.00 with an expiration date of December 27, 2026. Purchase Order 13-1044 is an internal Purchase Order for payment tracking purposes. Advertising Services under this Special Procurement are paid for on Agency SPOTS card but tracked internally through Purchase Order 13-1044. As of August 11, 2026, the spend to date is approximately $38,000.00.

The purpose of outreach through advertising is to further Agency’s mission of protecting Oregonians’ access to fair insurance and financial products and services through education, regulation, and consumer assistance. Agency’s regulatory authority includes insurance, banks v.3 Google Ads S-44000-00001298 Amendment No. 1.docx and trust companies, credit unions, mortgage lending, non-depository programs, securities, and the drug price transparency program. Ongoing outreach provides increased awareness of Agency services and programs.

c. Current Need:

Extending Agency’s current Purchase Order for Google advertisement Services will allow Agency to timely respond to ongoing outreach needs and reach a large state-wide audience.

Services can vary depending on Agency needs, and may increasing in the case of an emergency (for example the 2021 Oregon wildfire), Agency keeps a bucket of funds available.

Agency must be able to quickly respond to outreach needs, some of which are driven by unforeseen events. For example: natural disaster response, storms, and new consumer scams.

When these unforeseen events happen, such as wildfires, the response to Oregonians can change in an instant and the more quickly Agency can disseminate crucial information to affected areas, the more effective the outreach will be to provide consumer and businesses support needed to recover from substantial losses.

Ongoing outreach is conducted on a variety of Agency programs. Outreach efforts are targeted based on current events. Scams are continually evolving and scammers come up with new tactics to deceive and take advantage of vulnerable populations. Targeted outreach to address consumer risk must be timely to be the most effective.

d. Proposed Contracting Procedure:

Agency will issue a public notice (Notice) on OregonBuys, as required by OAR 125-247-0287, regarding approval of this Special Procurement request for a period of seven (7) calendar days.

The Notice will include provisions that any Affected Person(s) may protest the approval of the Special Procurement.

At the completion of the seven (7) day notice period, if no protests are received and sustained, Agency will proceed with amending Purchase Order 13-1044 and extending the term for five (5) years.

Agency will obtain Enterprise Information Services review prior to executing the Purchase Order amendment, as required. DOJ legal sufficiency will be obtained if requested or required.

11. Justification for use of Special Procurement: Describe the circumstances that justify the use of a Special Procurement. Attach relevant documentation.

Advertising is a type of SP by OAR 125-247-0288(5), and allows Agency to purchase media advertising, regardless of dollar value, without competitive bidding.

The Contractor selected has the majority of online search engine presence and Agency has determined that it is the best platform to reach Agency consumers.

v.3 Google Ads S-44000-00001298 Amendment No. 1.docx

12. Findings to Satisfy the Required Standards: This proposed Special Procurement:

___X___ (a) will be unlikely to encourage favoritism in the awarding of public contracts or to substantially diminish competition for public contracts because:

Approval of this SP Amendment would not encourage favoritism because past notice #S-44000- 00001298 was posted and no protests were received.

Using a competitive procurement process would not change the result for this request because there are limited advertising options that reach such a large audience across all geographic areas of Oregon and provide the ability to advertise in multiple languages.

and

______ (b)(i) will result in substantial cost savings to the contracting agency or to the public because:

or

___X___ (b)(ii) will otherwise substantially promote the public interest in a manner that could not practicably be realized by complying with the requirements of ORS 279B.055, 279B.060, 279B.065, or 279B.070, or any rules adopted thereunder because:

Using a competitive procurement process would not change the result request because there are limited advertising options to reach such a target large audience across the entire state of Oregon.

When consumers search the internet with insurance and financial services questions, they predominantly use Google. Placing Agency advertisements on Google is the best online platform for linking consumer questions and search efforts to Agency. Google analytics enables staff to determine which advertisements are the most effective in engaging consumers, thus optimizing the ad expenditures.
