PROGRAM BACKGROUND:
The GMD Program Element of the Ballistic Missile Defense System (BMDS) provides
Combatant Commanders the capability to engage and destroy intermediate and long-range ballistic missile threats in space to protect the U.S. homeland. The GMD Program Element integrates multiple sensors, communications systems, fire control capabilities, and Ground-
Based Interceptors (GBIs) to detect, track, and destroy intermediate and long-range ballistic missile threats during the midcourse phase of flight. The GMD Program Element is composed of two main components: GBIs and Ground Systems (GS), along with required communications, support equipment, training equipment, and facilities. The GMD Program
Element is a distributed capability with operational mission locations in Alaska, California, Colorado, and New York.
The GMD architecture provides for a defensive operations capability as well as the simultaneous conduct of operations, flight tests, ground tests, cybersecurity tests, and training.
MDA implements an evolutionary acquisition strategy to design, build, integrate, test, and field capabilities for missile defense in an incremental capability delivery approach.
Therefore, the GMD Program Element is involved simultaneously in multiple life cycle phases ranging from Product Development to Operations and Support.
As of April 2020, a single prime contractor manages the GMD Program Element under the
GMD Development and Sustainment Contract (DSC) HQ014712C0004/HQ014719C0004.
The DSC is a single contract that provides full end-to-end development and sustainment of the current GMD weapon system. The DSC’s period of performance is December 30, 2011 –
December 29, 2023.
GMD PROGRAM ELEMENT SCOPE:
GMD is currently exploring the work-scope construct of the activities defined in RFI #2 shown in figure 1 below:
Figure 1 - GMD Work Scope Construct
This GM construct uses five major thrust areas to encompass the full scope of the GMD mission system.

Underutilized Business Zone (HUBZone) SB, other, etc.).
PROGRAMMATIC: Responses should address the following questions listed below.
1) Types of Organizational Conflict of Interests (OCI):
a) Impaired Objectivity: This type of OCI arises where a firm’s ability to render impartial advice to the government would be undermined by the firm's competing interests. The primary concern with an impaired objectivity type OCI is that the contractor has a financial interest in the outcome of its performance and that the conflicting roles might influence the contractor’s judgement.
b) Biased Ground Rules: This type of OCI arises where a firm, as part of its performance of a government contract, has set the ground rules for the competition for another government contract. The primary concern with a biased ground rules type OCI is that by virtue of its current work a company has the opportunity and ability to skew a future competition in favor of itself, even unintentionally. There is typically no basis to distinguish between a firm and its affiliates, at least where concerns about potentially biased ground rules are at issue.
c) Unequal Access to Non-Public Information: This type of OCI arises when a firm has access to nonpublic information as part of its performance of a contract and where that information may provide a competitive advantage in a competition. The primary concern with an unequal access to information type OCI is that the contractor had inside information that provides it with an unfair competitive advantage.
2) OCI Business Decision Options A or B:
a) Option A: A provision which forces offerors to make a business decision as to which GMD opportunity (GMD WSI contract or GMD development/production contract) to pursue; this limits contractor/subcontractors from participating in both GMD development/production contracts and the GMD WSI contract.
b) Option B: No pre-determined prohibitions on contractor/subcontractors from participating in both GMD development/production contracts and the GMD WSI contract. The PCO will still perform the OCI analysis required under FAR subpart 9.5.
3) Programmatic OCI Questions:
a) Based on the WSI work scope outlined in figure 1 and defined in paragraph 5, what is your opinion of the possible OCI issues?
b) If MDA executes a provision which forces offerors to make a business decision as to which GMD opportunity to pursue, either the GMD WSI contract or the GMD Development/Production contract, which effort, if any, would your company bid on and why? (In this environment, the WSI contractor would be forbidden from competing for the development contracts (NGI, GS) but allowed to compete for the System Operations contract).
(1) Consider the potential risks and opportunities to the GMD Program, GMD WSI contract, and GMD Development/Production contract if MDA pursues Option A and how your company would mitigate the risks.
c) If MDA were to permit offerors to bid openly on both the GMD WSI requirements and the GMD Development/Production requirements, which effort, if any, would your company bid on and why? How would your company address the OCI concerns?
(1) Consider the potential risks and opportunities to the GMD Program, GMD WSI contract, and GMD Development/Production contract if MDA were to pursue OCI Business Decision Option B described above and how your company would mitigate the risk.
d) What potential WSI scope listed above would cause your company to recommend
OCI Business Decision Option A if it were included in a future solicitation? Is there scope not listed, that would logically fall under a WSI, which would lead to the same recommendation?
e) What are the potential risks and opportunities to the GMD Program if MDA were to combine WSI and System Operations into one contract? Are there any OCI implications between the two lines of effort? Would your company bid on a combined WSI and Systems Operation solicitation?
