About this file
This is a Department of the Air Force Justification for Other Than Full and Open Competition (J&A) document for a sole-source acquisition valued under $10 million. The contracting activity is United States Air Forces in Europe (USAFE), 39 Communications Squadron at Incirlik Air Base in Turkey.
The acquisition covers ongoing maintenance and repair services for the Federal Signal-brand Giant Voice system at Incirlik AB. Required services include quarterly maintenance to comply with manufacturer specifications, emergency repair services, boom lift rental, and replacement parts. The contract structure consists of a one-year base period plus four one-year option periods. Delta Teknik Co. Ltd. is designated as the sole-source contractor based on statutory authority under 10 U.S.C. 3204(a)(1), as it is the only responsible source capable of performing the necessary work. The justification cites that Delta Teknik possesses exclusive access to Federal Signal-approved original equipment manufacturer (OEM) parts and holds the requisite certifications to perform maintenance without voiding the manufacturer warranty. Additional rationale includes the expired warranty on the system, the high personnel turnover at Incirlik due to annual assignment cycles, and the need to protect the critical Nuclear Command, Control, and Communications (NC3) mission by freeing technicians from equipment maintenance duties. Federal Signal confirmed Delta Teknik as the only certified vendor in Turkey authorized to perform such work. To overcome future competition barriers, the Government commits to engaging Federal Signal regarding expansion of authorized service providers in the European/Anatolian region and will publish a Sources Sought Notice prior to subsequent procurements to identify any additional qualified regional contractors.

I. Agency and Contracting Activity (RFO 6.104-1(a)(1)):
Agency: USAFE
39 CONS/PKC
II. Nature and/or description of the action being approved (RFO 6.104-1(a)(2)):
This document approves the award of a sole-source buy to Delta Teknik for the Giant Voice system at Incirlik AB. The intention is to award the service contract as a base +4 OY. This justification is made on an individual basis.
III. Description of supplies/services required to meet agency needs (RFO 6.104-1(a)(3)):
The Federal Signal-brand Giant Voice System at Incirlik AB, Türkiye requires ongoing quarterly maintenance to comply with the manufacturer's system manual. The 39th Communications Squadron also requires as-needed emergency repair services, boom lift rental, and replacement parts for the system. Contractor support is required to maintain the Giant Voice System as 39 CS Nuclear Command, Control, and Communications (NC3) technicians are untrained in servicing the system. As this is an ongoing requirement, a contract with a 1-year base period and four 1-year option periods is in the best interest of the Government. A single-source acquisition is being pursued to procure the required services and parts from Delta Teknik Co. Ltd.
IV. Statutory Authority Permitting Other Than Full and Open Competition (RFO 6.104-1(a)(4)):
10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
V. Rationale for Use of Authority (RFO 6.104-1(a)(5)):
10 U.S.C. 3204(a)(1) states the services are only from one responsible source. Delta Teknik is the sole vendor capable of performing the necessary structural repairs and component replacements on the Giant Voice system. Te Giant Voice system's warranty has expired. Without a maintenance contract, any repairs or issues arising after the warranty period will be the responsibility of the base and could incur significant costs. Incirlik's 1-year assignment cycle means a constant turnover of personnel. The specialized knowledge required to maintain the Giant Voice system may not be consistently available among the rotating technicians. This creates a risk of improper maintenance, system downtime, or reliance on potentially less-qualified personnel. Without contractor support, the responsibility for maintaining the Giant Voice system falls on NC3 technicians. This diverts their time and attention from their primary mission, which is the NC3 (Nuclear Command, Control, and Communications) mission. The NC3 mission is of paramount importance, and any distraction from it is undesirable.
VI. Integrated Market Analysis and Efforts to Solicit Competition (RFO 6.104-1(a)(6), (8), and (10)):
Market research determines that Delta Teknik is the only vendor possessing the requisite technical knowledge and access to the the Federal Signal approved OEM parts necessary to restore the range to occupational safety. There are currently no other vendors in Turkiye who are allowed to manufacture the current parts, perform maintenance or take any actions upon the equipment that would result in voiding the warranty. Federal Signal was contacted to ensure Delta Teknik was the only company in the area with the appropriate certifications to perform work on the systems and provided a MFR.

VII. Determination of Fair and Reasonable Cost (RFO 6.104-1(a)(7)):
The Contracting Officer is responsible for evaluating, determining, and documenting the anticipated contract cost/price is fair and reasonable in accordance with RFO Subpart 15.4, Contract Pricing.
VIII. Any Other Facts Supporting the Justification (RFO 6.104-1(a)(9)):
N/A
IX. Actions to Overcome Barriers to Competition (RFO 6.104-1(a)(11):
To overcome the barriers to competition for future maintenance and repair of the Giant Voice system at Incirlik AB, the Government will take the following actions:
OEM Engagement for Expanded Regional Certification: The primary barrier to competition is the Original Equipment Manufacturer's (Federal Signal) business model, which currently designates Delta Teknik as the sole authorized service provider and OEM parts distributor in Turkiye. Prior to the expiration of this proposed contract action, the Contracting Squadron and Program Office will formally engage with Federal Signal to inquire about expanding their authorized service network. The Government will request that Federal Signal evaluate certifying additional vendors in the European/Anatolian theater to perform maintenance and source parts, thereby creating a competitive pool for future option years or follow-on contracts.
Continuous OCONUS Market Research: The Government will continuously monitor the local and regional market. Prior to any subsequent procurement for Giant Voice maintenance, the Government will publish a Sources Sought Notice to identify if any other regional defense contractors have independently acquired the requisite Federal Signal certifications, technical data, and supply chain access to perform the repairs without voiding the manufacturer guarantees on newly installed OEM components.
