About this file

This document is a Justification for Other Than Full and Open Competition (sole source justification) submitted by the Federal Bureau of Prisons for FCI Pekin.

The Federal Bureau of Prisons seeks to award an operating lease for GE XRA X-ray equipment to GE Healthcare as the sole source provider. The equipment includes one XR Discovery XR650 2-D unit, one XR Discovery XR656 2-D unit, and two XR FlashPad units currently installed at the FCI Pekin Health Services Unit located at 2600 S. 2nd Street, Pekin, Illinois 61554. The quoted price for all line items is $27,300.00 for FY 2027. The justification cites 41 U.S.C. 3304(a)(1) and FAR Part 6.103-1(b) as statutory authority, asserting that only one responsible source exists and no other supplies or services will satisfy agency requirements. The rationale emphasizes that GE Healthcare is the sole manufacturer with proprietary control of the equipment and software; removing the equipment to procure from another vendor would require competitive processes including technical approvals at the Central Office level, which would inhibit the FCI Pekin Health Services Unit mission and create unrecoverable costs. Market research confirmed the equipment is a commercial item but concluded that due to proprietary constraints, the requirement cannot be met through FAR Part 8 processes. The Contracting Officer determined the price fair and reasonable based on historical pricing for the same equipment. No sources expressed written interest in the acquisition. The Contracting Officer certification is signed by Gary Kurtz, dated 09/18/2026.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

Pursuant to the Federal Acquisition Regulation (FAR) Deviation Subpart 6.103-1 , the Federal

Bureau of Prisons (BOP) has determined that the acquisition of the GE XRA Operating Lease from GE Healthcare. is the only vendor that can provide this requirement to FCI Pekin.

Agency:

Department of

Justice

Bureau of

Prisons

FCI Pekin 2600 S. 2nd

St.

Pekin, IL 61554

Nature and/or Description of Action Being Taken: FCI Pekin intends to make an award to a sole source provider, GE Healthcare, for the requirement of an operating lease for the GE XRA X-ray equipment installed at the FCI and FPC.

Description of supplies or services required to meet the agency's needs: The following line items:

(1) XR Discovery XR650 2-D), (1) XR Discovery XR656 2-D, and (2) XR FlashPad; are installed in the FCI Pekin HSU located at 2600 S. 2nd St. Pekin, IL 61554. The quoted price for all line items is $27,300.00 for FY 27.

Statutory Authority permitting other than full and open competition: This justification is being submitted for approval in accordance with 41 U.S.C. 3304(a)(1), and FAR Part 6.103-1(b)

(Only one responsible source and no other supplies or services will satisfy agency requirements).

Determination that the nature of the acquisition requires use of the authority cited:

GE XRA X-ray equipment is installed at the FCI and FPC. This equipment is used Bureau wide and has BARS approval. Removing this equipment and attempting to procure equipment from another vendor would result in a competitive process to include tech approvals at the Central Office level that would inhibit the mission of the FCI Pekin HSU and create additional costs that would not be recovered by competition.

Efforts made to solicit from as many potential sources as practicable, including whether a notice was or will be publicized:

GE Healthcare is the only vendor that can be used because they are the manufacturer of the GE XRA equipment, and have proprietary control of the equipment and software.

Contracting Officer Determination that the cost to the Government will be fair and reasonable:

The Contracting Officer determines the price for this equipment to be fair and reasonable based on prices paid in the past for the same equipment.

Description of the Market Description Market Research

Conducted Market Research was conducted in accordance with FAR Part 10 and to the extent commensurate with the urgency, established value and complexity of the requirement. Market

Research supported the determination concerning the most suitable approach for acquiring the subject supplies and services. It has been determined this requirement cannot be met in accordance with FAR Part 8. Market Research revealed the requirement is a commercial item customarily available through the commercial marketplace. However, due to the proprietary nature of the equipment and software.

Other facts supporting the use of other than full and open competition:

There are no other vendors that can provide this requirement.

List of sources expressing in writing interest in the acquisition:

None. This became a sole source acquisition because the equipment is manufactured by GE

Healthcare and they have proprietary control over the equipment and software being leased.

Action taken, if any, to remove or overcome any barriers to competition:

There is only one source currently available that can provide the requested materials. This requirement will be monitored to determine if other vendors are able to replace hardware, software and monitoring systems that would make for a competitive acquisition. A formal solicitation would be issued at that time.

Contracting Officer's Certification:

I hereby certify that this request for justification and Approval for Other than Full and Open

Competition is made in good faith, that the supporting data and information are accurate and complete to the best of my knowledge. I hereby certify that the supporting data provided by the technical and requirements personnel that form the basis for this justification are certified as complete and accurate.
