This acquisition is conducted under the authority of GSAs MAS Program (41 U.S.C. 152(3)), as implemented by FAR 8.405-6, and for brand-name items as authorized by FAR 8.405-6(b).

5. Rationale Justifying Use of Cited Statutory Authority

The Contractor shall provide commercial, annual subscriptions that provide access to existing repositories containing the following: Global IT research and analyst discussions, industry research on IT spending and staffing levels and/or cost and performance metrics, downloadable tools and templates that provide actionable guidance, the ability to customize reports/deliverables, facilitated peer networking and access to member-driven research on issues critical to specific Agency roles and responsibilities, executive level content and research; assistance in crafting answers to questions where standard industry practices have not yet been documented, and synthesized research. The overall subscription level requirements are defined above but are not limited to the outlined requirements.

If these items are not procured, the cost to the government to develop and produce similar software with matching form/fit/function could exceed . It would cost over to hire contractors with the capability to produce this software and would require a significant expenditure for expert training due to the complexity of the software. This would also result in additional costs for operator training and an unacceptable delay to scheduling. This duplication of costs could not be recovered through full and open competition. In addition, the Department of Defense (DoD) Enterprise Software Initiative (ESI) has awarded Blanket Purchase Agreements (BPAs) for Information Technology Research software products which includes: software licenses, subscriptions, maintenance, support, and services to support Information Technology (IT) operations across the DoD enterprise. DOD ESI has a ten-year agreement with a period of performance from 25 March 2019 to 24 March 2029.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Market research shows there is a Blanket Purchase Agreement (BPA Contract#: N66001-19-A-0049) awarded through the DOD ESI with Gartner, Inc. for Information Technology Research software products which includes: software licenses, subscriptions, maintenance, support, and services to support Information Technology (IT) operations across the DoD enterprise. This BPA has a ten-year agreement with a period of performance from 25 March 2019 to 24 March 2029. The Department of Navy (DoN) mandates all DoN Organizations and programs to procure software licenses and maintenance through these ESI BPAs when available.

The agreement supports the U.S. Navy Information Technology efficiency efforts by consolidating procurement of all Gartner, Inc.s products across the DoN. Gartner, Inc. is the sole provider under the mandated ESI vehicle.

The proposed contract will be synopsized on GSAs MAS website for brand name items manufactured by Gartner, Inc.

7. Determination of Fair and Reasonable Costs

GSA has already determined the prices of supplies under schedule contracts to be fair and reasonable. The contracting officer will determine that the proposed order represents the best value consistent with FAR 8.404(d).

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, the NSWCDD Contracts Department has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, the NSWCDD Contracts Department will assess whether competition for future requirements is feasible.
