About this file

This document is a justification for using other than full and open competition to award a sole source contract. The Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 8 requires concrete and expansion joint repairs to the main parking garage at the James A. Haley VA Medical Center in Tampa, Florida. The repairs include fixing failed weld connections at eight expansion joints, replacing failed sealant, and conducting partial concrete repairs on two ramps. The contract will be awarded to AACON Construction, a service-disabled veteran-owned small business, with experience performing similar repairs on multi-level parking structures. The repairs are urgently needed and AACON can begin work immediately. The sole source justification cites authorization under the statutory exception for requirements authorized or required by statute. The agency twice solicited the requirement through full and open competition but received no offers despite market research identifying qualified contractors.

By utilizing the statutory authority found 41 USC §3304(a)(5) as implemented by FAR 6.302-5, which is wholly within the Contracting Officers discretion, urgently needed repairs to the expansion joints can be executed now instead of recompeting the requirement on an unrestricted basis.

This RFP was extended to 8 Nov 2022 but failed to produce proposal. A second solicitation was issued on or about 5 Dec 2022 with a proposal due date of 20 Dec 2023. This solicitation included small businesses. Due to schedule conflicts and requests from industry, an additional site visit was offered 20 Dec 2022 and the proposal due date was extended to 24 Jan 2023. The solicitation again failed to garner proposals and the solicitation was cancelled 26 Jan 2023. 8. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The contracting officer has determined that the price negotiated is considered fair and reasonable.
