About this file

This document is a Second Amendment to Contract No. 20422, executed between the State of Washington's Department of Enterprise Services and GA Creative, Inc., a Washington profit corporation. The amendment modifies a previously existing contract for Communications and Marketing Services, with the first amendment dated August 1, 2024, which added a pass-through costs provision.

The key modifications in this second amendment include extending the contract term by thirty-six (36) months, with the new end date set as February 28, 2029. Additionally, the amendment introduces a new pay equality provision mandated by the Washington State Legislature, requiring GA Creative to ensure that similarly employed individuals are compensated equitably. The provision allows for compensation differentials based on factors such as seniority, merit, production quantity/quality, job-related factors, or regional compensation differences, provided these are not derived from gender-based differentials. The amendment maintains that Enterprise Services may suspend or terminate the contract if the contractor fails to provide satisfactory evidence of compliance within thirty days.
