JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity
Naval Air Systems Command (NAVAIR), Commander, Fleet Readiness Center (COMFRC), Patuxent
River, MD
2. Nature and/or Description of Action being Approved
This Justification and Approval (J&A) authorizes and approves a contract award on a Brand Name basis for the Tier 1 Additive Manufacturing (AM) Ultimaker S5 systems and the initial support and sustainment of those systems.
3. Description of the Supplies/Services
The proposed contract will procure Commercial off the Shelf (COTS) non-modified Additive
Manufacturing (AM) Ultimaker S5 systems as well as provide post-procurement support of the systmes to include technical support and its installation at predetermined sites, support equipment and ancillary equipment problem resolution, technical publication logistic support, OEM reach-back capability for software and hardware components, engineering investigations and corrective actions for system anomalies, and development of initial training for the supplied systems.
The AM process will continue on-going efforts to reduce supply support shortfalls by providing improved readiness at the point of need for execution of operational requirements, and emerging need requirements of the combatant commander across the Navy. This procurement is required to meet Chief of Naval
Operations Design for Maintaining Maritime Superiority Ver 2.0 and Marine Corps Order 4700.4 initiatives to increase warfighting readiness.
The anticipated period of performance for this effort is 1 August 2021 through 31 July 2022 with four one-year options through 31 July 2026. The total estimated contract value is $1,833.7(K) as shown below:

4. Statutory Authority Permitting Other Than Full and Open Competition
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(5), the agency’s need is for a brand-name commercial product for authorized resale.
5. Rationale Justifying Use of Cited Statutory Authority
Ultimaker, the manufacturer of the Ultimaker S5, is the only 3D printer in the desktop printer category to offer the unique capabilities needed to support NAVAIR's current requirements. This COTS item provides the ability to communicate securely over Ethernet, Wi-Fi, or through removable memory which is lacking from the competition at this price point. This printer is also uniquely able to be configured with safety features such as an air filtration system and material management system not found in the competition. Out of the box these units provide an additional level of safety by enclosing all moving apparatuses, as well as all heating elements.
Ultimaker also produces printing filament for use in the Ultimaker S5 and other Ultimaker printers.
Ultimaker has extensively tested their printing filament using the Ultimaker S5 and provides all data required to produce polymer parts with high accuracy and repeatability. This is in contrast to other printers within the Desktop printer category (with few exceptions), where little to no testing is completed with materials on the printer to provide the optimal print settings. Also, the material produced by
Ultimaker is uniquely equipped with NFC chips, which provide the user with characteristics of the material, including the date of manufacture, remaining material, and optimal print settings. The NFC communicates to the Ultimaker S5 to provide these characteristics for user viewing and print setup. The
Ultimaker S5, paired with Ultimaker material, will ensure that the optimal print is produced each time;
this will reduce lost time, waste material, and machine consumable wear.
These printers also uniquely provide additional cyber security not provided by other manufactures through the use of Cura Essentials. Essentials updates are tested by an independent company for security.
The firmware is secured via firewall, allowing only controlled traffic. The software assigns different levels of internal security by segmenting user rolls and allowing admin only features. The software is backed by 24-hour support as opposed to other free software options common in all other competitors.
Awarding a contract for any other than the Ultimaker S5 would require modification of the COTS product to meet existing digital architecture integration supporting a cyber-safe environment and would incur additional cost for the modifications. Likewise, the unique inclusion of NFC chips make this equipment superior to other devices that do not include this technology.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Sources Sought Notices were posted to GSA’s eBuy and to beta.sam to identify potential Small Business sources that could provide the Ultimaker S5 and the needed requirements, and to notify Industry of the
Government’s requirement. Four (4) Small Business vendors submitted capability statements and two (2) were determined capable from their responses. No other brands or solutions were proposed by interested vendors. The Solicitation will be posted via beta.sam as a Small Business set-aside.
7. Determination of Fair and Reasonable Cost
In accordance with FAR 13.106, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. The Contractor will submit a price proposal with sufficient information to support the accuracy and reliability of the price. The proposal will be reviewed by experienced technical analysts and contract specialists with the aid of field pricing support, if applicable. The Contracting Officer will utilize cost and pricing analysis and historical data as the basis for negotiating a fair and reasonable price for the supplies/support covered by this J&A.
8. Actions to Remove Barriers to Future Competition
The Government has analyzed whether alternate brand/sources could be used; however, the analysis established that no other products could meet the agency’s needs. Future requirements will be evaluated to determine whether an alternate brand/source can be used to increase competition and not limit procurement sources. As technology continues to evolve, other brands may become available for future acquisitions.
