DEPARTMENT OF THE NAVY
NAVAL AIR WARFARE CENTER AIRCRAFT DIVISION
21983 BUNDY ROAD, 441 BUILDING
PATUXENT RIVER, MARYLAND 20670
BRAND NAME JUSTIFICATION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Patuxent River, MD
2. Description of Action Being Approved.
This Brand Name Justification and Approval authorizes and approves the issuance of a firm fixed price (FFP) contract action on a brand name basis to any company that is an authorized government reseller of the (14) Imperx Bobcat SDI Cameras and (14) Imperx Power Supply for SDI Cameras.
3. Description of Supplies/Services.
This procurement is for the issuance of a Firm-Fixed Price (FFP) contract with an authorized government reseller of Imperx equipment in support of the MQ-25A Flight Test Project.
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1) as cited in FAR 6.302-1. The acquisition is considered a brand name description per FAR 6.302-1(c) and is justified here in accordance with FAR 6.303 and 6.304.
5. Rationale Justifying Use of Cited Statutory Authority.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1) --the property or services needed by the executive agency are available from only one responsible source and no other type of property or services will satisfy the needs of the executive agency.
The MQ-25 is a system of systems that integrates the first operational carrier-based, catapult-launched Unmanned Air System (UAS) with existing aircraft carrier (CVN) systems and command, control, communications, computers, and intelligence (C4I) systems. It will provide a long-endurance Intelligence, Surveillance, and Reconnaissance (ISR) and robust organic refueling capability, coupled with incremental precision strike, for the Carrier Air Wing (CVW). MQ-25 will significantly extend the effective mission ranges of CVW assets, alleviate the current Carrier Strike Group organic ISR shortfall, and preserve F/A-18E/F service life. This suite of Imperx Camera equipment has been successfully operating under current Navy security regulation and control relating to Information Technology (IT) protection and data safeguards. It is an integral part of the Real Time Telemetry Processing System (RTPS) and MQ-25A. For the purposes of capturing user interaction with the MQ-25 CCS, an unobtrusive, high-resolution camera is required. The Imperx camera selected is small and easily mounted in a location out of the way of system operators. The camera requires power and a single coaxial cable for operation. The SDI interface allows for integration into existing video distribution systems for real-time monitoring of CCS operations. Changing to another brand of camera would also result in changing RTPS accreditations package which would change our Information Assurance (IA) status with competency 7.2.6; causing rework of the package from both ATR and 7.2.6. Continuity of hardware insures flexibility for easy exchange/replacement of various components, and reduces the configurations to be managed, spare parts, and additional personnel required to maintain the equipment and training required to do so. The vendor awarded the contract must be an Authorized Government Federal Reseller of Imperx equipment and must ship either FedEx or UPS.
6. Description of Efforts Made to Solicit Offers from as Many Offers’ as Practicable.
A combined synopsis/solicitation was posted to beta.SAM.gov on November 9, 2020 ending on November 16, 2020 with one quote having been received from Imperx, Inc.
7. Determination of Fair and Reasonable Cost.
Based upon the published Commercial Price List from Imperx, Inc., the Contracting Officer has adequate information and background to determine a fair and reasonable cost.
8. Actions to Remove Barriers to Future Competition.
ATR will continue to monitor the market for vendors that can provide the expertise and capability to provide a complete system needed to satisfy and support requirements. If another potential source emerges, ATR will assess whether competition for future requirements is feasible. The contracting officer will also ensure that price analysis is performed and utilize necessary resources to help determine a fair and reasonable price.
Per NAVAIR Instruction 4200.31F dated 22 July 2014, Contracts awarded under FAR Part 13, simplified acquisition procedures, do not require a J&A thus do not need concurrence from our legal counsel.
