JUSTIFICATION for an EXCEPTION to FAIR OPPORTUNITY for the placement of an order >SAT under a Multiple Award Contract (MAC)
Upon the basis of the followingjustification, I, Sharon M. Pritchard, as Competition Advocate of Naval Information Warfare Center (NIWC), Pacific, hereby approve the Justification for an Exception to Fair Opportunity Pursuant to FAR 16.505(b )(2).
JUSTIFICATION
I. Agency and Contracting Activity. Department of the Navy, NIWC, Pacific.
2. Natnre/Description of Action. This a fair opportunity exception to place a task order with SAIC under multiple award contract numher N66001-I8-D-0293. This task/delivery order numher is TBD.
3. Description of Supplies/Services. This task order provides engineering and technical support to the Electronic Harhor Security System under the Navy's Anti-Terrorism Force Protection Ashore and Nuclear Weapons Security Programs.
The estimated value of the one-year effo11 with one option is

BASE OPTION TOTAL
OPN $839,143
4. Identification of the Exception to Fair Oppo11unity. (FAR 16.505 (h)(2))
Identification/Justification for Exception:
The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays ·
D a. The agency need for services is of such urgency that providing fair opportunity would result in unacceptable delays.
~ b. Only one such awardee is capable of providing such services required at the level of quality required because the services ordered are unique or highly specialized.
Science Applications International Corporation (SAIC) is currently the only contractor that possesses the required Subject Matter Expe11s (SMEs) and skillsets required to meet this task order's schedule and timelines without significant delays or significant cost impact to the project.
The Electronic Harhor Security System (EHSS) is a government designed, deployed, and sustained system for which there is no commercial equivalent. SAIC has provided continuous support for the EHSS project under contract N66001-10-D-0049 through more than ten competed task orders. SAIC possesses extensive knowledge and unique experience with the EHSS project. SAIC retains thorough knowledge and understanding of the government's EHSS plans, procedures, processes, and experience with unique acoustic sensors and with systems

(b)(4) designs in a marine environment.
The current completion type EHSS effort has a one-year base period with a one-year option period and will provide engineering services for the installation of the EHSS technology at and other U.S. Navy sites. SAIC has the ability to begin working immediately upon award. If the task order is awarded to a new contractor unfamiliar with the project, the government estimates substantial delays in the project. The government estimates that it would take approximately 4 - 6 months of work for a new contractor to become familiar with nearly 10,000 unique EHSS drawings plus an additional 6 - 8 work months solely dedicated to training and oversight in order to obtain the knowledge and skillsets required to develop new EHSS designs to meet mission standards. To successfully perform the tasks under this requirement, the contractor must have a detailed understanding of EHSS specific fiber-optic networks, sensor coverages and deployment methodologies which include the unique characteristics of acoustic sensors; radars; imagers; infrastructure (e.g. tower designs, sensor mounts, and foundations); and other government developed capabilities used solely by EHSS in a port environment. SAIC is currently the only source capable of an immediate start.
The government estimates the cost of a 6-month period of time to allow the new contractor to become familiar with the EHSS data to be a minimum of $407,000. All personnel including the Systems Engineer, Analyst and the Technical Writer, would need to become familiar with the system, its components, and its documentation. Following this period of familiarization, a 6 - 8 month training period would be required, either by overlapping the new contracting team with SAIC engineers - now effectively doubling the cost of the effott - or by government staff, who would be unproductive during this period of time. The entire first year would now be a training exercise for the new contractor, consuming the entire $839,000 budget with training, plus an additional $400,000 to overlap either SAIC personnel as trainers or lost productivity while government employees provide training. This approach adds $1,246,000 of cost to a task order that.can be accomplished for $1,680,692 by SAIC. The table below provides a cost/ benefit analysis of this discussion.
Method Sole Source to SAIC Award to New Contractor Familiarization with $0 $407,000 documents/methods, etc.
Payment to contractor while $0 $439,000 training in methodology Cost of trainer- either SAIC $0 $400,000 or Government employees First Year performance $839,143 $839,143
Second year performance $841,549 Total Cost $2,926,692
Another complication in acquiring a new contractor is the cost of the lagging schedule.
Installation of the EHSS system will be delayed by at least one year for all while the new contractor prepares to do the work that SAIC can begin from the contract award date.
These pmts will therefore be vulnerable to any and all security breaches the EHSS is designed to

(b)(3); (b)(7)(e) thwait. The potential cost of a preventable security breach or an attack is impossible to quantify.
D c. The order must be issued ou a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the MAC, provided that all the awardees were given fair opportunity to be considered for the original order.
D d. It is necessary to place au order to satisfy a minimum guarantee.
De. For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.
5. Determination of Fair and Reasonable Cost. Based on the historic cost information currently available, the contracting officer has adequate information to ensure that the cost to the government for this acquisition will be fair and reasonable.
6. Any Other Facts Supporting the Justification. None.
7. Actions Taken to Remove or Overcome Barriers that Led to the Exception to Fair Opportunity.
The technical code will continue to survey the industrial base for qualified personnel or opportunities to contract with other qualified entities for tasking that would result in the broadening of the institutional knowledge base.
