About this file

This is a Justification and Approval for Other Than Full and Open Competition (J&A) document issued by the Department of Homeland Security, Office of Procurement Operations. DHS seeks to procure round-trip transportation services on a sole-source basis from Chart Up, LLC, located at 6595 Roswell Road, Suite G291, Atlanta, GA 30328. The contract is structured as a firm-fixed-price arrangement with an estimated total value of $32,808.39 for a three-day period from October 27, 2026 to October 29, 2026. The transportation services will move DHS personnel from various locations within the Washington, D.C. metropolitan area to DHS's St. Elizabeth Campus to support a mandatory three-day event hosted by DHS's Office of Intelligence and Analysis. Funding is categorized as Transportation under Fiscal Year 2027.

The justification for sole-source procurement authority is based on 41 U.S.C. 3304(a)(1), implemented through FAR Class Deviation 25-11, citing the "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements" exception. DHS states that Chart Up, LLC is the only identified source capable of providing transportation services from the various required locations at the specified times for the number of travelers. The requirement arose due to unforeseen circumstances requiring the event to relocate to the St. Elizabeth Campus, which lacks adequate parking and viable public transportation. Market research involved engagement with a few local transportation providers, with Chart Up being the sole provider able to commit to the requirements. The contracting officer determined the anticipated price to be fair and reasonable based on price analysis and historical data of similar services. For future transportation events, DHS commits to conducting broader market solicitations to overcome barriers to competition.

(h) Background information about the requirement: DHS’s Office of Intelligence and Analysis (I&A) is hosting a mandatory three-day event at DHS’s St. Elizabeth Campus that will be attended by DHS personnel within and outside the Washington, D.C. metropolitan area. Due to parking shortages and other transportation issues, personnel need to be transported from various locations to attend and depart the event.

3. Description of Supplies/Services.
