About this file

This is a Justification for Other Than Full and Open Competition document submitted by the Federal Bureau of Prisons (BOP) for the Federal Correctional Institution (FCI) Berlin located in Berlin, New Hampshire.

The BOP seeks to procure food-waste-collection services from a single source, Agri-Cycle, without conducting full and open competition. The contract period runs from March 18, 2026 through September 30, 2026, with a total estimated value of $5,180.00. The services are essential for sanitation, health, and operational continuity at the facility. Agri-Cycle is identified as the sole provider of food-waste-collection services within reasonable distance (approximately 100 miles) in the Coos County area of New Hampshire. The justification emphasizes that Agri-Cycle possesses unique qualifications, specifically the only de-parking equipment capable of separating food products from packaging materials, and provides renewable energy solutions that convert greenhouse gases into clean energy and fertilizer. The next closest competitor, Rowell's Services, lacks the necessary de-parking equipment to meet the institution's requirements.

The contracting officer, Jessalynn Laflamme, Property and Procurement Specialist, has certified that the estimated price of $5,180.00 is fair and reasonable, consistent with BOP's historical fiscal year pricing for this service. Market research was conducted in accordance with FAR Part 10, confirming Agri-Cycle as the only viable option. No public notice is required due to the contract value falling below the Government-wide point of entry threshold. No other sources sought interest in the acquisition due to proprietary concerns.
