H.8. Background Information on BUREAU 47

SECTION A: FUNDING OPPORTUNITY DESCRIPTION

A.1. Background

The Department of State’s Bureau of International Security and Nonproliferation, Office of Cooperative Threat Reduction (ISN/CTR) is pleased to announce an open competition for assistance awards through this Notice of Funding Opportunity

(NOFO). ISN/CTR sponsors foreign assistance activities funded by the

Nonproliferation, Antiterrorism, Demining and Related Programs (NADR) and other accounts and focuses on mitigating weapons of mass destruction (WMD) and WMD-related delivery systems proliferation and security threats from non-state actors and proliferator states. An underlying aim of all ISN/CTR’s efforts is long-term sustainability to maximize programmatic impact while minimizing the need for foreign partners to rely on outside financial or technical assistance.

A.2. Problem Statement

Russia’s unprovoked war in Ukraine has resulted in unprecedented international sanctions regimes targeting the perpetrators and enablers of Russia’s defense industrial base. These sanctions are a critical tool to help raise the cost on the

Russian military, and its enablers, to access the resources, finances, and materials that advance its wartime objectives.

To help partners identify these increasingly complex sanctions evasion typologies and take action to stop them, ISN/CTR conducts foreign capacity-building engagements and provides expert resources to support public and private sector compliance, investigatory, and enforcement bodies. These technical engagements assist partners to identify and avoid transactions with designated Russian and

Belarussian entities, and their associated networks, in the following areas:

• Financial Sector

• Maritime Sector

• Aviation Sector

• Machine Tools/Microelectronics/Other Emerging Sectors

ISN/CTR is specifically interested in highly technical capacity building engagements and providing commercially available information and tools that permit partners to identify and take action against specific sanctions evasion entities and networks.

A.3. Project Goal

Engage foreign audiences on identifying and taking action against complex sanctions evasion entities and networks. Projects should be sustainable and build relationships between partners.

A.4. Objectives

1. Targeted Financial Sector Sanctions Engagements: The Russian Federation’s sanctions evasion tactics rely upon continued access to the global financial market. These programs will engage financial private sector entities to provide technical training and tools in order to improving compliance with international sanctions against Russia and Belarus:

Objective: Plan and organize technical trainings and follow-on private consultations on sanctions regimes that will bring together 20-50 stakeholders per event. The events should aim to reach small and medium sized firms, with weaker compliance systems, and should focus on improving due diligence, conducting investigations, demonstrating regulator data-sharing, highlighting risks, etc.

Objective: Bring timely, relevant, and applicable case studies, using open-source information to the private sector that show active exposure to the jurisdiction.

Organizers should analyze audiences prior to engagements in order to tailored materials and case-studies to reach action-oriented results. Organizers can provide tools following the engagement.

Objective: Use commercially available and open-source data to develop and disseminate reports that help partners identify beneficial ownership structures, subsidiaries, lenders, financiers, and other links to sanctioned or prohibited entities.

Objective: Deliver trainings that build on, and expand beyond, what ISN/CTR has offered to-date by tailoring to new regulatory developments, compliance guidance, countries of emerging risk, and links to sanctioned or prohibited

Objective: Plan and organize trainings for smaller groups that focus on improving private sector coordination with the public sector, including the relevant authorities and regulators.

Countries: Albania, Armenia, Azerbaijan, Bahamas, Belize, Bosnia and

Herzegovina, Bulgaria, Cayman Islands, Croatia, Cyprus, Czechia, Estonia, Finland, France, Georgia, Germany, Greece, India, Indonesia, Ireland, Japan, Kazakhstan, Kyrgyzstan, Latvia, Lithuania, Luxembourg, Malaysia, Maldives, Malta, Moldova, Montenegro, Netherlands, North Macedonia, Panama Philippines, Poland, Republic of Korea, Romania, Singapore, Slovakia, Slovenia, Spain, Switzerland, Taiwan, Thailand, Tunisia, Türkiye, UAE, Ukraine, United Kingdom, Vietnam

2. Russia Sanctions Evasion in the Advanced Technology and Manufacturing

Sectors (Machine Tooling, Microelectronic, etc. Sectors): The Russian

Federation’s sanctions evasion schemes work to exploit advanced technology and manufacturing sectors to support their own military capabilities and advance their weapons programs. ISN/CTR’s capacity-building work looks to engage key private sector stakeholders within this high-tech community (and sometimes regulators) within the machine tools, microelectronic, and advanced technology/manufacturing sectors to counter this activity.

Objective: Support targeted, private consultations with advanced technology and manufacturing firms to help de-risk supply chains away from sanctioned or prohibited networks.

Objective: Plan and organize capacity building and technical events that will bring together 20-50 stakeholders per event. The events should engage industry partners (suppliers, shippers, intermediaries, other supply-chain stakeholders) to demonstrate areas of exposure to prohibited Russian entities and the reputational and sanctions risks associated with transacting in these assets/sectors.

Objective: Plan and organize small, targeted capacity building events that engage regulatory bodies, trade associations, etc. on the need for strong compliance and control tools to ensure maximum transparency when addressing Russian sanctions evasions tactics in the sector.

disseminate reports that help partners to identify illicit activities.

Countries: Cyprus, Czechia, Estonia, Finland, France, Georgia, Germany, India, Italy, Latvia, Lithuania, Luxembourg, Maldives, Malta, Netherlands, Poland, Slovakia, Slovenia, Switzerland, Türkiye, Ukraine, United Kingdom, Indonesia, Japan, Malaysia, Philippines, Republic of Korea, Singapore, Taiwan, Thailand, Vietnam, UAE

3. Targeted Public Sector Sanctions Outreach: The Russian Federation’s sanctions evasion schemes seek to heavily infiltrate a number of sectors (financial, industry, maritime, aviation, etc.) that various public sector authorities and regulators are responsible for monitoring and overseeing. These programs will engage public sector entities through the following objectives:

Objective: Plan and organize technical consultations and private meetings for private sector policy and enforcement entities. These engagements will be more targeted than a large workshop. These public sector engagements should be implemented as technical engagements/exchanges where organizers engage organizations or agencies individually, instead of as part of a larger training.

These technical consults should aim to reach investigatory bodies (to include financial intelligence units, law enforcement, and regulators) to train them to identify sanctions evasion networks linked to the Russian-linked entities.

Objective: Bring cutting-edge case studies, using open-source information to these public sector authorities that show active jurisdiction-specific exposure with the goal of taking concrete action.

disseminate reports that help public sector partners identify beneficial ownership structures, subsidiaries, lenders, financiers, and links to sanctioned or prohibited

Objective: Provide public sector enforcement entities with commercially available tools related to risks and links to sanctioned or prohibited entities.

Countries: Armenia, Azerbaijan, Bahamas, Belize, Bosnia and Herzegovina, Bulgaria, Cayman Islands, Cyprus, Czechia, Estonia, Finland, Georgia, Ireland, Latvia, Lithuania, Luxembourg, Maldives, Malta, Moldova, Montenegro, Netherlands, North Macedonia, Poland, Romania, Spain, Switzerland, Taiwan, Thailand, Tunisia, Türkiye, Ukraine, Japan, Malaysia, Panama, Philippines, Republic of Korea, Singapore, UAE

4. Russia Sanctions Evasion in the Maritime Sector: The Russian Federation continues to leverage vessels to transport technology and goods that help them circumvent sanctions and advance the war. While many jurisdictions have de-risked, Russia continues to seek new registries, new routes, and new methods for obfuscation. ISN/CTR’s capacity-building work looks to engage key public and private sector stakeholders to counter this illicit maritime activity.

Objective: Plan and organize capacity building and technical events that will bring together 20-50 stakeholders per event. The events should provide both public and private maritime partners with timely and in-depth investigative support to counter Russian and Belarussian sanctions evasion activity at sea and with lists of designated vessels and illicit entities associated with the maritime sector.

Objective: Plan and organize capacity building and technical events that target the following stakeholders: partner governments, chartering services/owners, flag registries, banks, insurance companies, port operators and other maritime stakeholders to shed light on findings/behaviors of suspicious vessels and associated maritime entities.

Objective: Events should focus on improving due diligence and supporting investigations that address challenges that include, but not limited to, ship-to-ship transfers, obfuscation of transshipment information, vessel location manipulation, forged bills of lading/cargo manifests, turning away, addressing, or seizing a designated vessel, etc.

disseminate reports that help partners to identify illicit shipping activities.

Countries: Bahamas, Belize, Cayman Islands, Comoros, Croatia, Cyprus, Democratic Republic of Congo, Eswatini, Fiji, Gabon, Greece, Guyana, India, Kiribati, Malta, Netherlands, Panama, Sao Tome, Spain, Tunisia, Türkiye, and the

United Kingdom.

5. Russia Sanctions Evasion in the Aviation Sector: The Russian Federation has continued to operate its aviation sector by breaking restrictions against access to critical spare parts and associated support needed to sustain their operations.

This is a source of revenue for partner nations that balances against the potential for secondary sanctions. ISN/CTR’s capacity-building work looks to engage key public and private sector stakeholders to counter this activity.

Objective: Plan and organize capacity building and technical events related to

Russia sanctions that will bring together 20-50 stakeholders per event. The events should provide public and private aviation partners with timely and in-depth investigative support to counter Russian and Belarussian sanctions evasion activity affecting the aviation sector.

Objective: Engagements should also shed light on safety risks posed by potentially unairworthy Russian and Belarussian carrier aircraft to both the private sector and civil aviation authorities and identify illicit supply chain networks for aviation spare parts in violation of sanctions and control regulations.

disseminate reports that help partners to identify illicit activities.

Countries: Armenia, Azerbaijan, Bahamas, Kazakhstan, Kyrgyzstan, India, Indonesia, Ireland, Malaysia, Maldives, Philippines, Thailand, Türkiye, UAE, A.5. Expected Outcomes

All projects should aim to have progress that that leads to improved compliance within the private sector, action-oriented decisions from the public sector

(investigations, private sector checks, etc.), and the development of new case studies allowing organizations to be ahead of Russian and Belarussian sanctions evasion.

A.6. Performance Indicators

All projects should have the following qualitative and quantitative indicators:

1. Number of private sector actions taken to include, but not limited to:

a. Shutting of bank accounts

b. Internal audits

c. Expansion of compliance through new resources or staff

d. Reports submitted to the public sector

e. Deregistration of illicit vessels or aircraft

2. Number of actions taken by the public sector (not limited to):

a. Opening of investigations

b. Deregistration activities

c. Compliance documents, circulars, guidance provided to the private sector

d. Development of a new sanctions task force or action plan for a new department/task force

3. Number of cutting-edge open-source documents produced and actions they led to, such as:

a. Investigations

b. Deregistration activities

c. Information sharing activities

A.7. Key Considerations

Favorable proposals may do the following:

1. Ensure sustainable engagement as new sanctions are released, new sanction linkages are discovered, new case studies are developed, etc.

2. Empower local centers of excellence to continue to train and engage on these key issues.

3. Leverage partnerships with local bankers’ associations, monetary authorities, financial intelligence units, and other relevant associations/regulators to improve engagement recruitment, participation, and ongoing efficacy of programming.

4. Leverage U.S. Government policy support (Departments of State, Treasury, Commerce) at in-person workshops and trainings.

5. Leverage policy support from key international sanctions partners such as the United Kingdom and European Union at in-person workshops and trainings.

A.8. Substantial Involvement

ISN/CTR will be involved in the project development and planning. ISN/CTR staff will work closely with the implementer to select participants, grant awards, and review event agendas to ensure that they align with the proficiency level, needs and interests of each ISN/CTR partner country audience. ISN/CTR will select foreign participant, advise on training logistical implementation and will consult on all aspects of event logistical planning and all participants including process and lead-time required for obtaining U.S. visas.
