OPOAM 3008.405-6(a)(2) Limited-Sources Justification (LSJ)

For orders or BPAs exceeding the Simplified Acquisition Threshold

This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.

1. Agency and Contracting Activity.

The Department of Homeland Security (DHS), Cybersecurity and Infrastructure Security Agency (CISA) Chief of the Contracting Office (COCO) proposes to award a task order pursuant to FAR 8.405-6(a), Limiting Sources.

2. Nature and/or description of the action being approved.

DHS/CISA COCO intends to limit the number of sources solicited pursuant to FAR 8.405- 6(a) for a six (6) month bridge task order, with one three (3) month option period, to continue Administration and Program Management Support Services while a competitive effort is underway to the following vendor:

RCM Solutions, 4801 Tesla Drive, Suite C, Bowie, MD 20715.

3. Description of Supplies/Services.

In support of its mission, DHS CISA Infrastructure Security Division (ISD) Office of Bombing Prevention (OBP) requires contractor support to continue Administration and Program Management Support in order to effectively coordinate, synchronize, integrate and operate. These integral roles include integration support functions, written instruction, divisional policy development, annual operating procedures, data calls, divisional correspondence, metrics requests and adhoc executive requests, correspondence tracking reporting, to effectively support SOW Section 2.1 tasks. Current support ended on May 11, 2024.

The total estimated value of the firm-fixed-price task order is for a period of performance of nine (9) months, inclusive of a base period of six (6) months, and an option period of three (3) months. The proposed period of performance including the option period is as follows:.

Base period: May 20, 2024 November 11, 2024 (to be funded with fiscal year 2024 funds) Option 1: November 12, 2024 February 12, 2025 (to be funded with fiscal year 2025 funds)

4. Authority and supporting rationale.

8.405-6(a)(1)(i)(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

An award will be made to RCM Solutions, under GSA MAS contract number GS-35F- 593GA, as the only source capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized, pursuant to FAR 8.405-6(a)(1)(i)(B).

Market research determined only one (1) source, RCM Solutions Inc. is capable of providing the services required. Previous procurement history for these services and the resulting BPA awards were reviewed, concluding that a transition in period would be required for this unique and specialized services resulting in a significant impact to to DHS ISD program.

RCM Solutions Inc. is the only source currently that can provide this level of specialized experience, and immediate uninterrupted service requirement. Furthermore, market research was conducted in accordance with HSAM 3017.7102; mandatory strategic sourcing vehicle ordering guides, and capabilities were reviewed concluding that these services could either not be provided immediately or would require ramp up time, or a cold start. Either scenario would significantly impact service and operational requirements needed during the nine-month period of performance (six (6)-month base period with potential three (3)-month option period if needed for transition services).

RCM solutions Inc. has the technical competencies, strategic alignment, workflow, and current labor required to execute office of bombing preventions unique, highly specialized deliverables at the level of quality required and without a break in service. An example of these highly specialized deliverables includes strategic integration, communication, and execution of intergovernmental counterterrorism bombing prevention portfolios through ISD Executive Secretary (ExecSec) tasks and Requests for Information (RFIs), maintenance of OBP knowledge management tools and repositories, programmatic materials, correspondences, training, and accountability, such as the CISA.gov site, OBP SharePoint site, and OBP activities database in coordination with CISA Office of the Chief Information Officer (OCIO). RCM Solutions Inc. has an established GSA MAS contract GS-35F-593GA that is active, DHS cleared personnel, and a period of performance that would satisfy OBP requirement duration while additional procurement solutions are being pursed without risk to ISD or a break in service resulting in impacts to the OBP mission. RCM Solutions Inc. is a small business, commercial, has no current debarments or derogatory performance history, and supports NAICS 541611 as listed in SAM.gov entity reports.

OBP Administration and Program Management Support is currently provided via MAS contract number GS-35F-593GA, order # 70RCSJ23FR0000038 which was awarded to RCM Solutions, a Small Business concern as a logical follow on. The current order was awarded as a nine (9) month bridge to continue administration and program management support

3- 3 -services while CISA COCO and ISD/OBP defined, solicited, negotiated, and awarded a competitive task order. This limited source justification will replace the current order with an additional temporary short term bridge, to allow additional procurement acquisition lead time (PALT) for a recompete replacement contract.

5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).

The contracting officer has determined that issuing the proposed Task Order to RCM Solutions for a short-term bridge of administration and program management support services represents the best value and will result in the lowest overall cost, considering price

This order will be placed in negotiated fair and reasonable pricing rates. Discounts to these GSA schedule rates will be requested. Additionally, prior to issuance of the task order, the ordering activity will consider the level of effort and the mix of labor proposed to perform the specific task being ordered in effort will also be compared to the Independent Government Cost Estimate (IGCE).

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

Market research was conducted in accordance with HSAM 3017.7102 to determine if a DHS strategic sourcing vehicle (SSV) was available to support this short-term bridge. The available SSVs are not immedatley capable of supporting the unique, specialized

-term need without transition integration actions, undue risk or potential for break in services. ISD in coordination with OBP determined through program subject matter experts, previous procurement history and program requirement deliverables with the previous incumbent, that these services could not be performed immediately without a 30 day or more transition in period. During this period contractors would be obtaining DHS security clearances, adjudications, interagtion activities and request of government provided equipment. Furthermore the previous procurement required partnering via subcontracting to obtain the specialized services required under this requirements statement of work.

Additional market research conducted supported the above determination that no available schedules, vendor capabilities, and specialized experience offered in the commercial market place through available GSA/FSS schedules and intra-interagency contract vehicles would meet the requirements with out risk or impact to OBP mission. The current incumbent RCM Solutions is the only source capable of supporting this bridge order which will provide highly specialized deliverables; including strategic integration, communication, and execution of intergovernmental counterterrorism bombing prevention portfolios through ISD Executive Secretary (ExecSec) tasks, requests for Information (RFIs), maintenance of OBP knowledge management tools, repositories, programmatic materials, correspondences, training, and

3- 4 -accountability, such as the CISA.gov site, OBP SharePoint site, and OBP activities database in coordination with OCIO. RCM Solutions has staff currently performing support services, with full access and adjudication to perform on day one of the period of performance at pre-established, and acceptable schedule rates.

7. Any other facts supporting the limited-sources justification.

None noted.

8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited-sources) before any subsequent acquisition for the supplies or services is made.

The government intends to procure administration and program management support services competitively in FY24/FY25, thus eliminating the barriers to competition. The strategy for increasing competition while soliciting the recompte for this bridge action, will be to use the OASIS Small Business Pool 1 vendors. The combination of Market research conducted and s the determination that their are capable vendors and a small business set aside would provide adequate competition among the active schedule holders.

9. DHS intends to post this requirement on System for Award Management (SAM.gov) pursuant to FAR 8.405-6(a)(1)(i)(B).

10. Technical/Requirements Personnel Certification.

Pursuant to FAR 8.405-6(c)(2)(x), I certify that this requirement meets the minimum need and that the supporting data, which form a basis for the Limited-Sources Justification, are accurate and complete.
