About this file

This document is a Limited Source Justification (LSJ) for a federal contract opportunity to acquire new and updated fingerprint scanners and accompanying maintenance/technical support packages.

The contract will be awarded under GSA Schedule GS-35F-0199R to HID Global, the sole manufacturer and provider of the required Guardian 200 fingerprint scanners and proprietary MCIO-DFME LSMS software. HID Global is the only company authorized to perform support, provide maintenance, and supply parts for its hardware and software. The total potential period of performance is from July 2024 through June 2029, with an initial 12-month warranty period. The contract will be funded with FY24 Operation and Maintenance, Navy (O&MN) funds. The Independent Government Estimate for the entire contract is redacted. The LSJ justifies the sole source award to HID Global based on the unique and specialized nature of the required products and services.

NOTE: The aforementioned Guardian 200 Scanners (hardware/software) are manufactured by and proprietary to HID Global. The accompanying maintenance and support packages are only available through HID Global as they are the only company authorized to perform support and provide maintenance of its software as well as provide parts to repair its hardware.

Period of Performance: Total possible coverage from 01 July 2024 through 30 June 2029 Independent Government Estimate (IGE): (inclusive of all options) Funding: Proposed acquisition will be funded with FY24 Operation and Maintenance, Navy

(O&MN) funds.

Coverage Period: Initial 12 months of purchase of updated or new Guardian scanners comes with a standard 12-month warranty

NOTE: Vendor typically requires 30 days ARO, so anticipated dates and option periods dates may differ.

In conclusion, the requires supplies and support services represent the minimum requirements of the government.

4. Identification of the Justification Rationale and/or Demonstration of Contractor’s Unique Qualifications to provide the required supply or service. The statutory authority which permits restricting consideration of schedule contractors to fewer than that required in FAR 8.405-1 (Ordering procedures for supplies and services not requiring a statement of work) or 8.405-2 (Ordering procedures for services requiring a statement of work) is 41 U.S.C. 251 et seq., as implemented by FAR 8.405-6.

The proposed requirement is to acquire purchase new and updated fingerprint scanners and maintenance packages in support of CNIC.

The justification for limiting sources is FAR 8.405-6(a)(1)(i)(B) – Only one source is capable of responding due to the unique or specialized nature of the work.

HID Global is the only manufacturer and provider of the items identified in paragraph 3 that are required for use with HID Global produced Live Scan devices currently in NCIS Inventory. The Guardian 200 scanner only operates with the MCIO-DFME LSMS software that is proprietary to HID Global and only supports HID biometric scanners.

The software utilized by the Navy Security Force was developed by HID Global in conjunction with various Government agencies (Army, Navy, Marines, Air Force, and Coast Guard) to meet each command’s unique needs. This software is proprietary to HID Global; therefore, they are the only ones able to provide the required maintenance support. The maintenance support packages being procure through this requirement are also essential to keep this software certified and available on the NCIS network.

HID Global Guardian 200 fingerprint scanners are proprietary to the HID Global software used throughout the enterprise. NCIS is the Navy’s Criminal Justice Information Services Systems Office to the FBI for E-fingerprint submission. CNIC uses the NCIS servers and network to submit electronic fingerprints to the FBI, thus requirements are locked into using this software. NCIS tried a Cogent USB scanner in 2013, with the software and it did not function. While the hardware would recognize input of the scanners, the HID Global software would not recognize or function with the Cogent scanner. Through testing by the requiring activity, as well as conversations with the manufacturer, it revealed that only HID Global Biometric scanners would be compatible with the software. CNIC is required to stay with the HID Global software since NCIS has been working on an authority to operate (ATO) for the past year to certify the software and servers that run the Live Scan system.

While HID Global does authorize certain resellers to sublicense HID Software without modification, to resell hardware, and to resell its software and hardware maintenance. However, HID Global is the sole party capable and authorize to perform support and provide maintenance of its software (through changes, modifications, and/or updates). In addition, they are the only company authorized to provide parts and repair its hardware. Warranties will be voided if anyone unauthorized performs the changes, modifications, and/or updates.

Furthermore, HID Global is the sole company authorized to provide the required items on GSA through GSA Schedule GS-35F-0199R and offer special trade-up discounts to update older scanners.

5. Determination of the Best Value. GSA has determined the prices of supplies of the schedule contracts to be fair and reasonable for the purpose of establishing the schedule contract. Per FAR 8.404(d) DEVIATION, GSA’s determination does not relieve the ordering activity contracting officer from the responsibility of making a determination of fair and reasonable pricing for individual orders. Therefore, ordering activities are responsible to make a separate determination of fair and reasonable pricing for individual orders, BPAs, and orders under BPAs. The Contracting Officer will determine, using the procedures in FAR 15.404-1, that the prices are fair and reasonable and will document such determination with a level of detail commensurate with the complexity and circumstances of each order. By placing an order against a schedule contract, the ordering activity contracting officer concludes that the order represents the best value to the Government.

6. Description of market research among schedule holders and the results or a statement of the reason market research was not conducted. The requiring activity and contracting activity have conducted market research among schedule holders. Pursuant to FAR 10.001, market research was conducted to ascertain if: (1) sources exist to satisfy this requirement and (2) commercial items are available to meet the agency’s need. Market research was performed through a review of previous acquisitions for the same or similar requirements, discussions with the requiring activity, cold calls to potential vendors, catalog reviews, and internet searches.

Research has shown that the supplies to be procured are of a type customarily used by the general public or by non-governmental entities for purposes other than governmental and have been sold to the general public.

Due to the nature of the requirement and the current infrastructure in place, the Guardian 200 live scanners and accompanying maintenance/support packages are the only items identified to meet the minimum requirements of this request. Materials are the same as what is incorporated in current systems and the request is needed due to increased requirements pursuant to complete the fielding of electronic biometrics collection systems. CNIC utilizes NCIS servers to submit electronic fingerprints to the FBI.

NCIS limits the software to be used to MCIO-DFME LSMS software which is a proprietary software developed, manufactured by, and proprietary to HID Global. Through testing done by the requiring activity and conversations with the manufacturer, only HID biometric scanners are compatible with the required software. As such, only HID Global products would satisfy the minimum requirements.

HID Global is the sole publisher of the software and sole manufacturer of its hardware. Research indicated that there are no authorized resellers capable of providing the required Guardian 200 live scanners nor is any other company able to perform support and provide maintenance of its software. HID Global is also the only company able to provide parts or repair its hardware.

Further research has shown that the same or similar items have historically been acquired through the GSA IT Schedule 70 number GS-35F-0199R. HID Global is the only company authorized to sell its products on GSA.

7. Any other facts supporting the justification. This procurement uses a GSA Schedule and will be solicited and awarded in accordance with FAR Subpart 8.4.

8. Actions the Agency may take to remove or overcome barriers to competition.

All future requirements will be handled on a case-by-case basis. For the reasons set forth in Paragraph 4, the required supply and support services only has one source capable of responding to the specific requirements are the only company authorized to sell on GSA. If the limitations on the existing network should change and other potential sources emerge, the Government will assess whether competition for future requirements is feasible. All future requirements will be researched on a case-by-case basis.

9. Contracting Point of contact. The point of contact at NAVSUP Fleet Logistics Center Norfolk Regional Directorate is Jason Zajac, Code 280.1, can be reached by e-mail at jason.m.zajac2.civ@us.navy.mil.
