JUSTIFICATION FOR

OTHER THAN FULL & OPEN COMPETITION

Project Name: Traffic Flow Simulation Software

The following Justification for Other than Full & Open Competition is prepared in accordance with FAR Subpart 6.303-2.

1. ORGANIZATION:

Federal Energy Regulatory Commission Office of the Executive Director Acquisition Services Division 999 North Capitol Street, NE Washington, DC 20426

2. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED:

FERC would like to procure licenses and support for a new product, Traffic Flow Simulation Software.

3. DESCRIPTION OF REQUIREMENT:

The Office of Energy Projects (OEP) Division of LNG Facility Review & Inspections (DLNG) requested to procure and deploy commercially-available-off-the-shelf (COTS) traffic simulation software. This will allow OEP-DLNG users to evaluate and verify calculations underlying plans for evacuation, shelter-in-place, re-entry, and other related emergency response plan information as part of its review of applications to build LNG facilities. This will also reduce application processing time.

4. STATUTORY AUTHORITY:

The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c)(3) in accordance with:

[ X] FAR 6.302-1, only one responsible source and no other supplies and services will satisfy Agency requirements

[ ] FAR 6.302-2, Unusual and compelling urgency;

[ ] Other, defined below:

FAR 6.302-3 Industrial mobilization; engineering development or research capability; or expert services.

5. DEMONSTRATE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS:

PTV Vissim, Vistro, and Viswalk are commercially available software applications designed specifically to simulate the effects that different parameters have on traffic volume and traffic flow under various evacuation scenarios. In addition, this software is the only one that provides the pedestrian analysis piece that is needed. These products would offer the most cost effective and expedient path to provide OEP- LNG staff the capabilities required to model and analyze evacuation scenarios efficiently and accurately. Moreover, these products are currently used by the Nuclear Regulatory Commission (NRC) and are often mandated for use by both the NRC and local emergency responders.

6. SOURCES SOUGHT EFFORTS:

PTV America Inc. is the sole creators of this software, and they also provide the support for it.

7. DETERMINATION OF FAIR & REASONABLE PRICING:

JUSTIFICATION FOR

OTHER THAN FULL & OPEN COMPETITION

This software is one of a kind, however, it is comparable to similar engineering products currently in the FERC environment.

8. DESCRIPTION OF MARKET RESEARCH CONDUCTED & RESULTS:

Market research on GSA Advantage, NASA SEWP, PTV website, and general internet search indicates that this is not available through any other means or resellers.

9. ANY OTHER FACTORS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

COMPETITION:

This is the only vendor who sells the software and provides maintenance and/or support for the software.
