About this file
This document is a Brand Name Justification (BNJ) for a federal contract opportunity to procure commercial brand-name Cisco network hardware and software for the U.S. Coast Guard. The Coast Guard requires Cisco routers, switches, and associated equipment to replace obsolete or end-of-life gear and increase the capacity of the Coast Guard One Network Enterprise (CGONE). The total estimated price for the Cisco tech refresh, including base and option year 1, is . The base requirement has a 180-day delivery period and a performance period of September 2024 to August 2025, funded with FY24 funds. The option period 1 is anticipated to have a 180-day delivery and a performance period of September 2024 to September 2025, funded with the applicable fiscal year funds. This requirement will be procured on a brand name basis from authorized Cisco resellers through the DHS First Source II contracting vehicle, as Cisco hardware is proprietary and necessary to ensure interoperability and security of the CGONE network.

FY24 Cisco Hardware Technical Refresh
JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY
BRAND NAME FAR 16.505(a)(4)(i)
1. Agency and Contracting Activity.
The Department of Homeland Security (DHS), the United States Coast Guard (USCG), Command, Control, Communications, Computer, Cyber and Intelligence Service Center
(C5ISC), Alexandria C5I Contract Operations Division (CG-9141) located at 7323 Telegraph
Road, Alexandria, VA 20598-7320, prepared this justification for an exception to fair opportunity.
2. Nature and/or Description of the Action being Approved.
The USCG intends to award a delivery order (DO) under the brand name exception to fair opportunity pursuant to FAR 16.505(a)(4)(i) for brand name Cisco hardware and equipment, restricting competition to items peculiar to one manufacturer. This brand-name requirement will result in a Firm-Fixed-Price (FFP) DO awarded to an authorized Cisco reseller via the
Department of Homeland Security (DHS) First Source II Multiple-Award Indefinite
Delivery/Indefinite Quantity (IDIQ) Contract.
3. Description of Supplies/Services.
The USCG requires Cisco Network Routers, Switches, and Associated Software and Hardware to satisfy the immediate need for lifecycle sustainment of
Enterprise Standard Network Equipment and Associated Hardware. This equipment will be used to replace obsolete or end-of-life equipment and/or to increase the capacity of the CGONE network to enable continued service as network demands increase. This equipment will be used on CG shore facilities service-wide.
The total estimated price for the Cisco Tech Refresh, including base + option year 1, is
The delivery date for the base requirement is 180 days from date of award, with an estimated award period of performance of 01 September 2024 – 31 August 2025. The base requirement will be funded using Fiscal Year (FY) 2024 funds. Option Period 1 is anticipated to have a period of performance of 15 September 2024 – 14 September 2025, but is dependent on the date that the award is exercised. If exercised, the optional requirement will have a delivery due date of 180 days from date of option exercise and will be funded using the funds from the applicable FY in which the option is exercised.

4. Identification of Statutory Authority Permitting Other Than Full and Open
Competition and Supporting Rationale.
The statutory authority permitting exception to fair opportunity is FAR 16.505(b)(2)(i)(B). “Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.” This requirement will be procuring items peculiar to one manufacturer on a brand name basis in accordance with FAR 16.505(a)(4)(i).
Cisco brand name hardware is proprietary to Cisco.

Software and Hardware. In addition, the

This allows the Coast Guard to meet DOD/DHS requirements for monitoring and managing network security for CGONE.
Cisco hardware is necessary for the USCG to support mission critical infrastructure, applications, and mitigate major security vulnerabilities. Currently, the Coast Guard has over
Cisco devices deployed throughout the Coast Guard network architecture, maintenance platforms, and configuration systems which require the use of these products to ensure interoperability with other USCG systems. Introducing a non-Cisco device that is not compatible with the Cisco based compliance review, and other Cisco equipment would result in an unacceptable degradation of CGONE security, increase the probability of successful cyber-attacks, and degrade overall Coast Guard mission readiness to an unacceptable level.
Due to the USCG’s need for proprietary Cisco hardware, the contracting strategy which will provide the Government best value is competing the brand-name Cisco hardware using the DHS
First Source II contracting vehicle.
5. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer determines the anticipated cost will be fair and reasonable based on adequate price competition between two or more responsible Offerors. Based on market research, it is anticipated that multiple offers will be received from multiple authorized Cisco resellers on the First Source II. The Contracting Officer will also perform a price analysis to determine that the price at the time of award represents the overall best value for the Government and is fair and reasonable.
6. A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any
Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services
Required.
Cisco hardware is proprietary and is currently in use on the USCG networks. There is availability of multiple vendors that can provide Cisco hardware on First Source II which will ensure competition. The USCG will continue to seek competitively available Cisco hardware or comparable products within the marketplace.
7. Contracting Officer’s Certification.
I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
8. Technical/Requirements Personnel Certification.
I certify that this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for the justification, is accurate and complete.
