JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Identification of Agency and Contracting Activity.
The requiring activity is Naval Criminal Investigative Service (NCIS); the contracting activity is Naval Supply Systems Command (NAVSUP) Fleet Logistics Center (FLC) Norfolk Contracting Department, Philadelphia Office.
2. Description of the Action Being Approved.
The use of other than full and open competition to award a cost-plus fixed-fee (CPFF) contract to Mantech Advanced Systems International, Inc. (CAGE: 5N741) for services (as outlined in Section 3) in support of NCIS.
3. Description of Supplies/Services.
Due to recent cyber-attacks against the United States, emanating from non-ally countries the NEPTUNE SILO (NS) Task Force was created at NCIS to work in collaboration with the Office of the Secretary of Defense (OSD) Cross Functional Team (CFT) and the Deputy Undersecretary for the Navy for Policy (DUSN(P)) Senior Director for Intelligence to address the ongoing exfiltration and compromise of DoN critical information and threats to identified DoN technologies, affiliated companies, laboratories, and applied research centers. The NS Task Force was created to develop business practices and processes to specifically enhance lethality and sharpen competitive advantage as outlined in the 2018 National Defense Strategy and has Deputy Secretary of Defense oversight.
Consequently, the proposed acquisition is to procure Technical and Operational Support Services for the NCIS Cyber Directorate. These services will support the NCIS Cyber Directorate’s ability to use digital information to identify and counter new and persistent threats to Department of Navy (DoN) critical assets, personnel, operations, computer networks, and information. The contractor will be required to operate, maintain, and develop new capabilities for NCIS Cyber Directorate’s custom classified data aggregation and analysis system. This system serves as the backbone for NCIS Cyber Directorate’s data centralization projects and enables NCIS and community analysts and agents to leverage NCIS Cyber Directorate’s digital information to enhance their investigative and operational capabilities. In addition to providing for continued operation and maintenance of the system, the contractor will be required to improve the system by incorporating additional data types to integrate with existing data collection feeds; user interfaces shall be redesigned to automatically correlate data from various sources; and high priority information shall be identified and highlighted to users.
As the only system of its kind in the Navy, the custom classified data aggregation and analysis system, developed by Mantech Advanced Systems International, Inc., is uniquely positioned to aid the NS Ttask Force by compiling and integrating source data for intelligence or vulnerability value with respect to targets and to be continually developed to provide solutions for detecting, responding to, and exploiting cyber threats. The data aggregation and analysis system is a system developed exclusively for NCIS as noted in Section 5 of this document. As a result of the success of the NS Task Force in countering cyber-attacks against the United States emanating from non-ally countries, NCIS has been directed to stand up a permanent NS capability. The services outlined in the proposed acquisition addresses this directive and includes contractor support to accommodate the recent addition of additional DoN technology programs being supported by NS and the custom classified data aggregation and analysis system.

8. Actions to Remove Barriers to Future Competition.
Any future action will be synopsized and solicited in accordance with the procedures of the Federal Acquisition Regulations (FAR). A Source Sought Notice/Request for Information will be released for all future requirements to determine if any source is capable of performing the tasks of the requirement and also have experience with NCIS Cyber Directorate’s Data Aggregation and Analysis System.
