FEDERAL BUREAU OF INVESTIGATION
FINANCE DIVISION | PROCUREMENT SECTION
Justification
Justification for Other than Full and Open Competition In Accordance WITH 41 USC 253(c)(1) Requisition Number: DJF-22-2200-PR-0002685 Date: April 1, 2022 Estimated Contract Dollar Value:
1. Identification of the agency and contracting activity.
(U) The U.S. Department of Justice, Federal Bureau of Investigation (FBI), Critical Incident Response Group (CIRG), Counter-IED Section (CIEDS) has prepared this justification for other than full and open competition for the purchase of Percussion Actuated Non-Electric Disruptors (PAN) disruptors manufactured by Ideal Products, Inc. in support of the Render Safe Programs Unit in the Critical Incident Response Group (CIRG), Counter Improvised Explosive Device Section (CIEDS).
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
(U) The CIRG / RSPU seeks to establish a sole source contract for this purchase from Ideal Products, Inc. The FBI Render Safe Programs Unit, Research & Development Program (hereinafter RSPU) bases is sole source request on research indicating that only one responsible source can readily provide all of the items requested under Section 3. Furthermore, where Ideal Products, Inc. not the sole responsible source for these products they would likely be the lowest cost option for the government based on the fact that they are the sole manufacturer of the items in question. Lastly, Ideal Products, Inc. is also a small, female-owned business under the Federal Acquisition Regulations.
3. A description of the supplies or services required to meet the agency’s needs.
(U) The FBI has counter improvised explosive devices (CIED) mission sets which require the development, fielding and training of new defeat and disrupt technologies. As a part of its Research, Development, Testing& Evaluation mission, CIRG / RSPU utilizes Percussion Actuated Non-Electric Disruptors (PAN) disruptors’ manufactured by Ideal Products, Inc. The specific products sought under this contract are as follows: 1. Eight (8) Ideal Products, Part #: 1107 – 24” 12 Gauge Wildcat Barrel (Acme Barrel Threads), 2. Eight (8) Part #: K1090DS-ACME – Electric Breech Acme Drop Safe, and four (4) Part #: K4340 – Breech Cap & Plug (Assembled with Hex and Ferrule Nut).
4. The statutory authority permitting other than full and open competition.
(U) The statutory authority for conducting this acquisition is 41 U.S.C. 253 (c)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
(U) The PAN Disrupter is a proprietary product manufactured by Ideal Products. The barrels and other parts sought under Section 3 are used with the PAN Disrupter and are designed specifically for use in the PAN, which is manufactured exclusively by Ideal Products, Inc. Ideal Products, Inc. manufacturers the vast majority of disruptors in use by federal, state, and local bomb technicians across the United States. Due to its widespread use, strength, and reliability, the RDT&E program utilizes the Ideal PAN disruptor to extensively test technologies developed by the program. In addition, the RDT&E program uses these disruptors extensively in its Advanced Disablement & Engineering Technology program. The RDT&E program frequently pushes the PAN disruptor to its engineering limits in testing and the programs use is well beyond that of most bomb squads in the United States. As a result of this intensive use and the resultant wear and tear on the equipment, the RDT&E program must replace eight (8) of the PAN disruptors for safety, reliability, and to insure the integrity of testing and evaluation. The requested products are as follows: 1. Eight (8) Ideal Products, Part #: 1107 – 24” 12 Gauge Wildcat Barrel (Acme Barrel Threads), 2. Eight (8) Part #: K1090DS-ACME – Electric Breech Acme Drop Safe, and four (4) Part #: K4340 – Breech Cap & Plug (Assembled with Hex and Ferrule Nut). These parts are backward compatible with existing RDT&E equipment and the continued use of matching equipment will help ensure the integrity of test data gathered in ongoing research. Additionally, RDT&E personnel are familiar with the use and maintenance of this equipment and its capabilities.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart5.2 and, if not, which exception under 5.202 applies.
(U) RSPU personnel conducted market research via internet searches and phone calls, while agent and operational support personnel have attended industry trade shows in the past. Research located another vendor capable of providing one of the requested parts, Ideal Blasting. However, the one part Ideal Blasting could supply was significantly cheaper from Ideal Products, Inc. The other two items requested in this contract are not readily available from Ideal Blasting or any other identified vendor.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
(U) The value of this contract will be approximately $xxxxx. The contracting officer will determine if the price negotiated for this acquisition is fair and reasonable. The determination of the fairness and reasonableness of the price will be based on an analysis of the contractor’s proposal.
8. A description of the market research conducted and the results.
(U) Internet research and consultation within the EOD & public safety bomb technicians community as well and the Naval Surface Warfare Center and the Department of Homeland Security did not result in the identification of any other entity capable of fulfilling all of the requirements listed herein.
9. Any other facts supporting the use of other than full and open competition.
(U) None
10. A listing of any sources that expressed a written interest in the acquisition.
(U) None
11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
(U) The FBI will continue to engage with the NBSCAB, the NAVEODTECHIH, DHS and other operational communities to identify industry capabilities and potential service providers who can provide the services identified as critical to RSPU’s requirements.
