Brand Name/Sole Source Justification under $250K

PMD Number: FY21-22423 (Maintenance Plan), FY21-22645 (Spare Parts Kit)

Department: Air Dominance Department, Naval Surface Warfare Center, Port Hueneme Division

Company Name/Brand: Thermo Eberline LLC doing business as Thermo Fisher Scientific

Description of Product, Supplies or Services required to meet the agency’s needs:

Since the Fukushima Daiichi nuclear disaster in March 2011, the United States Navy (USN) has required the Japanese Maritime Self-Defense Force (JMSDF) to certify that all parts are screened for radiation contamination prior to shipment to Naval Supply Systems Command (NAVSUP) Weapon System Support (WSS) for repairs. In support of this requirement, the JMSDF procured a LAM-12 Large Article Monitor from Thermo Fisher Scientific in 2014. The LAM-12 provides complete coverage for large article monitoring of all repair parts being returned to NAVSUP WSS from Japan Kongo, Atago, and Maya Class ships. Continuous operation of LAM-12 requires manufacturer’s maintenance services and periodic calibration to ensure all returned parts are certified to be free of radiation contamination. JMSDF has requested assistance from NSWC PHD to contract for maintenance plan support for their LAM-12. The required LAM-12 maintenance plan includes annual calibration maintenance and operational validation testing to ensure proper operation. JMSDF also requested that PHD procure a LAM-12 spare parts kit that provides ready replacement parts for maintenance when required, reducing system downtime.

Identification of Justification Rational:

☑The Material or service must be compatible will aspects (Form, Fit, and Function) with existing systems presently installed.

□ A patent, copyright, proprietary data, or licensing agreement limits competition.

□ These are “direct replacement(s)” parts/components for existing equipment.

□ Urgency.

Identification of the Justification Rationale Explained: **If using form, fit, and function, describe the current equipment and how the new item/service must coordinate or interface.

**If using patent, copyright, proprietary data, describe the proprietary data. **If using direct replacement, describe this below.

The Thermo-Fisher Scientific LAM-12 is currently employed at Repair and Supply Facility Yokosuka (Y-RSF), Yokosuka, Japan for conducting Radiological Control (RADCON) screening and certification on all repair parts being returned to NAVSUP WSS from Japan Kongo, Atago, and Maya Class ships. In order to certify the unit’s operation and ensure the repair parts being returned are properly screened for radiation contamination, annual calibration maintenance and validation testing is required. Thermo-Fisher Scientific’s maintenance plan fulfills this requirement. Further, having spare parts on hand provides ready replacement parts for maintenance when required, reducing system downtime, and enabling parts to be certified and returned to NAVSUP WSS for repair quicker. The Enhanced Spare Part Kit SAM12, only available from Thermo-Fisher Scientific, fulfills this requirement.

Specific Characteristics of the Item or Service required that Limit the Availability to a Sole Source or Brand Name: **This is the most important section. Explain in detail why this company or brand are the only ones that can meet the requirement.

Thermo-Fisher Scientific is the original and only manufacturer for the Thermo Scientific LAM-

12. Since it is Thermo-Fisher Scientific’s system, Thermo-Fisher Scientific is the only source that provides the LAM-12 annual maintenance plan and Enhanced Spare Part Kit SAM12 required to meet mission requirements. There are no authorized vendors other than Thermo- Fisher Scientific that provide a maintenance plan or a SAM-12 enhanced spare part kit.

Since Thermo-Fisher Scientific is the only company that can provide an annual maintenance plan and a spare parts kit for the LAM-12, identifying another vendor would additionally require the procurement of new radiation detection hardware resulting in a substantial duplication of cost estimated at over $100,000 that is not expected to be recovered through competition. This estimate is based upon the government’s previous efforts in procuring the LAM-12 equipment and maintenance plan. Pursuing another vendor would also result in an unreasonable delay of 6- 12 months with no guarantee of success. This estimate is based off of the timeframe associated with the initial LAM-12 procurement and would place the continued operation of the LAM-12 at risk. If the LAM-12 fails without a maintenance plan in place, Japan will not be able to send parts in need of repair back to the USN supply system. This will lead to downtime for fielded JMSDF shipboard systems and negatively impact JMSDF ships’ ability to meet mission requirements.

Market Research Conducted:

For the SAM-12 Spare parts kit PHD reached out to Thermo Fisher Scientific (the manufacturer), CE Elantech, Federal Resources Supply Company and Parttarget.com.

Thermo Fisher referred us to Thermo Eberline Thermo Eberline provided the quote CE Elantech said that they don’t have it Federal Resources Supply Company didn’t respond to our request Parttarget said that they don’t have it

For the LAM-12 maintenance

Thermo Eberline LLC/Thermo Fisher Scientific is the Original Equipment Manufacturer (OEM) of LAM-12 and is the only company that provides continuous maintenance support services and extended warranties for the LAM-12. Thermo Eberline provided the quote.

There is previous contract history o Current Maintenance Plan Contract N63394-16-P-0118, POP (Base plus 4 Option

Years): 6/27/16 - 6/26/21) o Original Purchase Contract N63394-14-P-0075

These findings align to Market Research conducted in 2014 for the Original Purchase Contract

Statement of Actions, if any to Remove Barriers to Competition in the Future:

NSWC PHD Contracts Office will continue to conduct market research as warranted to provide a broader vendor base as applicable for the types of supplies/services covered by this document. If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
