JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

(JOFOC)

For (FY21-05/ SOFIA Cologne Deployment Support Services/ 80AFRC21 0007)

1. Federal Acquisition Regulation (FAR) 6.303-2(b)(1) – Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for other than full and open competition.”

This document is a justification for other than full and open competition prepared by National Aeronautics and Space Administration (NASA): Code 210-Procurement

The procuring agency is the National Aeronautics and Space Administration (NASA) and the contracting activity is Armstrong Flight Research Center (AFRC).

2. FAR 6.303-2(b)(2) – The nature and/or description of the action being approved:

This justification provides the rationale for contracting by other than full and open competition to award a sole-source contract (80AFRC21 0007) with Lufthansa Technik AG for support for the SOFIA aircraft while operating at the Cologne Germany airport from February to of 2021.

3. FAR 6.303-2(b)(3) – A description of the supplies or services required, to meet the Agency’s needs (including the estimated value):

Lufthansa Technik AG will provide the required aircraft supplies, support and maintenance to the SOFIA deployment operation in Cologne Germany. This will include providing supplies required to keep the aircraft flying. Supplies include, engine oil, breathing oxygen, nitrogen for servicing of struts and tires. Equipment will include access stands, jack stands, special tools to resolve aircraft issues, technical support to resolve aircraft issues and repair of aircraft structure or control surfaces if necessary, to maintain SOFIA in an airworthy condition. This deployment will occur from February 2021 through March 2021 with costs not to exceed $7 0K.

4. FAR 6.303-2(b)(4) – An identification of the statutory authority permitting other than full and open competition:

The statutory authority permitting other than full and open competition for acquisitions using the procedures using the format at FAR 6.303- modified to reflect that the procedures in FAR subpart 13.5 were used in accordance with 41 U.S.C.1901. Only one responsible source and no other supplies or services will satisfy agency requirements.

5. FAR 6.303-2(b)(5) – A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

The rationale supporting the use of 10 U.S.C. 2304(c) (1) as described below.

Lufthansa Technik AG is the only Line Maintenance facility located at the Cologne Bonn airport with maintenance facilities and access to supplies and shops required to maintain the SOFIA aircraft while it operates in Germany. SOFIA has just completed its 4 month maintenance check at the Lufthansa Technik AG facility in Hamburg Germany. On-going support from Lufthansa Technik while in Germany will ensure that the SOFIA mission in Germany will be successful. As the only heavy maintenance provider for the SOFIA aircraft, Lufthansa Technik has exclusive knowledge and expertise in maintaining SOFIA while in Germany. This contract will only be in use while the SOFIA aircraft is operating at the Cologne Bonn airport.

6. FAR 6.303-2(b)(6) – A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:

A notice to the Government Point of Entry (GPE) website (beta.sam.gov) was published on February 6, 2021 in accordance with FAR Subpart 5.2. This posting informed potential sources of NASA’s intent to award this sole-source contract to Lufthansa Technik AG. The results of this synopsis are summarized in Section 10 below.

7. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:

The Contracting Officer’s signature on this document indicates that the Contracting Officer has determined that the anticipated cost to the government will be fair and reasonable. The Contractor shall be required to submit a proposal to be evaluated and negotiated by the Government. Prior to execution of the contractual instrument, a proposal analysis will be performed. The proposal analysis will ensure that the final agreed-to price for the contract action is fair and reasonable.

8. FAR 6.303-2(b)(8) – Description of the market research conducted, and the results, or a statement of the reasons a market research was not conducted:

A site survey was conducted to the Cologne Bonn Airport in October of 2020 to determine the airport within Germany that would provide the best science for the astronomical community. A thorough review of all the support infrastructure at the airport was conducted during this site survey and identified Lufthansa Technik AG as the only operator at the airport capable of performing line maintenance and providing access to the Lufthansa Technik AG support and services throughout Germany. This includes access to the Maintenance Repair and Overhaul (MRO) facility in Hamburg Germany and the supply base in Frankfurt Germany. Between these three locations, the SOFIA aircraft will have the best access to what is required to maintain SOFIA in a flight worthy condition while outside of its home base in Palmdale California.

9. FAR 6.303-2(b)(9) – Any other facts supporting the use of other than full and open competition:

None.

10. FAR 6.303-2(b)(10) – A listing of the sources, if any, that expressed an interest in writing in the acquisition:

No sources sought was posted. The requirement for SOFIA is to have a maintenance organization at the Cologne Bonn Airport. Lufthansa Technik AG is the only maintenance organization at the airport.

A notice of NASA’s intent to award this sole-source action was synopsized on the GPE website (beta.sam.gov) per FAR Subpart 5.2 (See Section 6 above)

The Agency will continue to examine the market in the future for alternative solutions or new sources before executing any subsequent acquisitions for the same requirements.
