Brand Name Justification (LSJ) For orders or BPAs exceeding the micro-purchase threshold but not exceeding the simplified acquisition threshold

This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.

1. Identify agency and contracting activity.

The Department of Homeland Security (DHS), Office of Procurement Operations (OPO), Cybersecurity and Infrastructure Security Agency Acquisition Division (CISAAD) proposes to award an order pursuant to FAR 8.405-6(a), Limiting Sources.

2. Nature and/or description of the action being approved.

DHS/OPO/CISAAD intends to limit the number of sources solicited pursuant to FAR Part 8.405-6(b)(1) for the procurement of Trueplanning® Cost Estimating Software. DHS intends to solicit the proprietary TruePlanning® Software from PRICE Systems LLC. A task order is anticipated to be awarded against the vendor’s Federal Supply Schedule (FSS) contract 47QTCA19D00C8, to ensure a fair and reasonable price.

3. Description of supplies/services, including the estimated total value (including options).

The commercial package of cost estimating tools will provide support for planning, analysis, and management of software, hardware, and IT development projects, along with initial tool training. The desired capability includes estimating the cost of software development, systems engineering, software, hardware and operating system maintenance, and life cycle costing of IT projects from concept through development and support. This tool will be used to generate parametric estimates of software size, development, and maintenance - based on the experiences contained in a robust, proprietary data base. The tool will further provide a means for cross-validating software cost estimation outputs developed through other methodologies such as the Constructive Cost Model (COCOMO II).

4. Authority and supporting rationale supporting brand name specification.

DHS/OPO intends to procure the Trueplanning® Cost Estimating Software through the Multiple Award Schedule Program under the authority of 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies. Only one source is capable http://uscode.house.gov/

LSJ Template < SAT of providing the TruePlanning® Software because TruePlanning® is a proprietary software that has been developed by PRICE Systems LLC that is highly unique and specialized.

Pursuant to FAR 8.405-6(b)(1), this brand name must be used because this is the only tool that is compatible with the program office’s existing supply of TruePlanning® licenses and fulfills the requirement of integrating with the cost and risk application, Automated Cost Estimating Integrated Tools (ACEIT). TruePlanning® is the only tool that will allow the ability to read, edit, copy, etc. existing documents developed using the TruePlanning® software. The use of other products could result in interoperability, compatibility, or interface issues that would prevent efficient and effective project/program management which will adversely affect the program office’s mission. Cybersecurity and Infrastructure Security Agency (CISA) conducted market research where multiple vendors responded to the Request for Information. The results of the market research indicates other companies’ similar products lacks the particular feature(s) required and do not meet the needs of CD.

Specifically none of the other tools were able to interconnect and function with CD’s current configuration. Migration to a product that is not compatible with an existing approved software/tool, would lead to additional effort, risks and switching costs and is not in the best interest of the government. The software has customarily been bought on a sole source basis where most recently, CISAAD procured the services with PRICE Systems LLC for the Office of Biometric Identity Management (OBIM) that resulted in an award of Task Order

70RNPP18FR0000039 (LSJ# FY18-0265).

5. DHS/OPO intends to post this requirement on e-Buy pursuant to FAR 8.405- 6(b)(3)(i)(A).
