FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Surface Warefare Center, Indian Head Explosive Ordnance Disposal Technology Division (NSWC IHEODTD) Contracts Office Code 02.

2. Description of the Action Being Approved

Award of a sole source contract to Chant Engineering Co.

Inc., for the purchase of one (1) Sling Manufacture and Weight Testing Facility.

3. Description of Supplies/Services

NSWC IHEODTD McAlester Detachment has a requirement for a turnkey solution to have a complete functioning rigging shop and test facility to support depot level manufacturing and refurbishment of NAVSEA Ordnance Handling Equipment (OHE) and other Navy rigging and handling equipment.

Funding total of $458,975.80 is planned for the acquisition of this effort.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open

Competition

10 U.S.C. 2304(c)(1). As implemented by Federal Acquisition

Regulation (FAR) 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

NSWC IHEODTD McAlester Detachment requires a turnkey solution to have a complete functioning rigging shop and test facility to support depot level manufacturing and refurbishment of NAVSEA OHE and other Navy rigging and handling equipment.

The NAVSEA technical manual (SG420-AP-MMA-010) identifies Crosby hardware as the only hardware that can be use for periodic testing arrangemenant for OHE. The OHE sling prints list Military Standards and specifications to which the slings must be manufactured. Chant’s equipment is compatible with the Crosby hardware, which is a requirement on the majority of the sling prints. Chant provides equipment and services to multiple Warfare Centers and DOD facilities, providing a consistent and standard weight test platform.

This ensures standards are maintained across the Warfare Centers and will elemated the need for retraining of Government personnel.

Ordering a turn-key solution from other than the specified vendor will obsolete the current Configuration Management for manufacture, test and certification of OHE now in use at other NSWC Installations. The Indianhead Picatinny detachment have already developed and documented

“SOURCE SELECTION INFORMATION – SEE FAR 2.101 and 3.104” standard Engineering designs procedures to accomplish this mission. These standards allow interoperability of methods, products, test criteria and knowledge among the different NSWC’s. If Chant equipment is not the selected vendor. this will cause an unacceptable delay due to, all new Engineering designs, documentation, procedures, standards and approvals for the use of this equipment will be required.

Chant is the only vendor capable of providing a complete turnkey solution to meet the requirements identified for swaging and weight test facility.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

A Sources Sought notice N00174-20-SN-0015 was posted on January 16, 2020 to the Federal Business Opportunities (FedBizOps) website to satisfy the requirement of Defense Federal Acquisition Regulation Supplement 206.302-1(d). No responses were received.

7. Determination of Fair and Reasonable Costs

The Contracting Officer will determine that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, NSWC IHEODTD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWC IHEODTD will assess whether competition for future requirements is feasible.
