Statement of Work Snagging and Clearing Black Rock Channel, Bird Island Pier, Buffalo River and Harbor

PART 1 DESCRIPTION OF WORK

1.1 Base Bid Item 1 – Snag and Clear of Black Rock Channel FY20

The work for this bid item includes removal of foreign debris and material (trees, branches, tires, etc.) from the locations noted during the pre-work site visit. This work must be done by water. At a minimum, removal locations must include:

• Culverts located under the Bird Island Pier

• Upstream of Unity Island

The Bird Island Pier is the 2 mile pier located to the south of Unity Island. The work must be performed between the mouth of the Black Rock Canal and the upstream side of the upstream gates of Black Rock Lock (See Attachment 3). Work must not be conducted inside the Black Rock Lock chamber. Other areas of the Black Rock Channel may require removal of debris and other material as directed. A location map and project map for the limits of clearing and snagging are illustrated in Attachment’s 1 and 2.

1.2 Base Bid Item 2 – Snag and Clear of Buffalo Harbor and River FY20

The work for this bid item includes removal of foreign debris and material (trees, branches, tires, etc.). At a minimum, removal locations must include:

• Buffalo River between the Michigan Ave. and the Conrail bridge remains

• Buffalo Harbor: Outer Harbor, Entrance Channels, and Ship Canal

Other areas of the Buffalo River & Harbor may require removal of debris and other material.

The work must be performed between the mouth of the Buffalo River and the Conrail bridge pier remains, and within the entire Buffalo Harbor. The Conrail bridge pier remains are located approximately 1/4 miles downstream of the Buffalo River-Cazenovia Creek confluence at 42°51’38.46”N x 78°49’58.10”W as illustrated in Attachment 3. There must be no clearing and snagging work performed outside of the protection of the Buffalo Harbor. A location map and project map for the limits of clearing and snagging are illustrated in Attachment’s 1 and 2.

1.3 Base Bid Item 3 – Brush Clearing of Bird Island Pier FY20

The work for this item includes removal of trees and shrubbery growing on the Bird Island Pier, which is the approximately 2 1/2 miles in length and is located off the south end of Unity Island.

The pier is accessible by the Ferry Street Bridge. This work includes both the River and Channel side of the Pier. The work on Niagara River side of the pier must be done by land, the Channel side of the pier may be done by water or land. As the culverts were cleared under Bid Item 1, this work should focus on brush and vegetation. All work must be done mechanically and no vegetation killing chemicals, as the work is next to a fresh water source. Cut all trees and bushes as close to the roots as possible and remove off site. This brush must be disposed of according to federal, state, and local laws and regulations. Debris must not be left on site or placed in the waterway as a form of disposal.

The contractor must have a work crew of three (3) laborers performing this work during the full 8 hour shift. One of the three laborers may be the Site Safety and Health Officer (SSHO).

As the workers will be adjacent to the swift moving Niagara River, all workers are required to wear a PFD at all times and must be tethered to a self-retracting lifeline anytime outside the guardrails.

Anytime a worker is outside of a guardrail, a second worker must be in the immediate work area in case of an emergency. The contractor is required to have a life ring on site in the vicinity of where workers will be.

A location map and project map for the Bird Island Pier are illustrated in Attachment’s 1 and 2.

1.4 Optional Bid Item 4 – Extension of Brush Clearing of Bird Island Pier FY20

This optional line item is for extending the number of days of the work in Base Item 4.

1.5 Optional Bid Item 5 – Install 2 Warning Signs FY20

This item is for installing 2 warning signs in the area of the Buffalo District Slip. There is an underwater line for waste from the Upper Operating house of the Black Rock Lock to the Buffalo District Reservation. The signs are to warn boaters not to anchor between the signs due to the underwater line. One sign will need to be attached to the sheet pile on the north east corner of the slip where the line comes up and the other sign will be mounted on the back side of the Black Rock Lock below the Upper East Operating building. Each sign is 81-1/4"x56" in size. The signs are provided with aluminum angle stock as a stiffener for the signs. Prior to mounting the signs a submittal of how and what will be used to anchor the signs in both locations for government approval is required prior to work starting.

1.6 Debris Removal and Disposal

The contractor must dispose of all organic and inorganic debris and materials in accordance with all federal, state, and local laws and regulations. Inorganic debris must be disposed of in a municipal landfill. Woody debris may be chipped up and disposed or recycled for other use.

The contractor must conduct disposal operations in compliance with applicable ordinances and environmental laws. If sediment has been removed as a consequence of removing debris, and has accumulated on the barge deck, the contractor may not wash this material off the barge into adjacent waters. This material must be disposed of by legal means.

1.7 Safety

Refer to Attachment 4 for Government Safety Requirements.

PART 2 PROJECT REQUIREMENTS

2.1 Pre-Work Submittals

The contractor must submit as directed below. Submittals must be made to the Government within ten (10) business days of the Notice to Proceed (NTP).

Submittals must include the following:

1. AHA’s

2. Abbreviated APP

3. Abbreviated APP Checklist

4. Operations Plan

5. Work Schedule

6. Proposed Anchoring Method and Materials (Option 6 Award)

7. Other information required by the contract documents and the Government.

The Government Quality Assurance (QA) will be identified after the contract is awarded.

2.2 Work Hours

The contractor must work during daylight hours Monday through Friday. Weekend work will not be permitted. Payment to the contractor is measurable in whole or partial work days. One full work day is considered to be eight (8) hours of productive work. Partial work days will be paid in two

(2) hour increments with each increment equaling one-quarter of a work day. No payment will be made for incremental time worked less than two (2) hours. Work days and hours do not include mobilization, demobilization, and transportation of materials to the disposal facility, or returning to the work site from disposal areas or overnight mooring location.

2.3 Quality Assurance

At all times during the eight (8) productive snagging & clearing work hours, there will be a Government Quality Assurance (QA) Person on board the Contractor’s vessel to help direct the Contractor on what debris is to be cleared. This is to help minimize any confusion on work locations and types of debris that must be cleared.

The contractor, at no expense to the government, must protect all government and privately owned facilities, grounds, structures, equipment, sidewalk, pavement, and other property during completion of the work. Damages that were caused by the operations of the contractor and/or the contractor’s crew must be repaired at no expense to the government.

2.4 Equipment Requirements

The contractor is required to utilize equipment that satisfies minimum performance conditions. The collection barge must be able to temporarily store one full day’s worth of clearing and snagging debris. The collection barge is required to hold, at minimum, 150 CY.

The equipment to be used for clearing and snagging above the water level must be able to safely lift large debris at minimum 60 feet from the face of its marine vessel. The contractor is required to perform clearing & snagging of debris to the full depth of the Black Rock Channel, approximately 25 feet. The contractor must use a barge mounted crane or long-stick excavator with a grapple and ability to snag trees with a choker.

The contractor must demonstrate the ability to quickly and efficiently cut all debris into the maximum 10 foot sections. There must be a chain saw onboard used by an experienced operator.

The contractor must supply two (2) laborers for a work crew at all times, an additional laborer is required during the brush clearing in Section 1.4. The Site Safety and Health Officer (SSHO) may be one of the two workers. The crane and/or tug operator must not be counted as laborers. Laborers must be on the barge deck providing the labor for the clear & snag work during the complete eight

(8) hour productive work day.

All equipment to be utilized during this project must safely perform the tasks necessary to maintain efficient contractor performance.

All federal, state, and local laws and regulations must be followed.

2.5 Project Schedule

The contractor will have a 30-day performance period to complete work following issuance of the

NTP.

Bid Items 2-4 are all bid on a per-day unit. Depending on the level of debris and contractor performance, extra days may be added to these bid items. The contract will be modified so the contractor does not experience any delays. These optional work days must run continuously following the base bid work days. Optional days may be necessary if the two productive eight (8) hour work day(s) in the base work are not sufficient to cover the clearing and snagging amount of debris present. The government may choose to award any number of optional work days.

Liquidated damages of $150 per work day will be assessed on the 31st day following the issuance of the NTP if the work is not completed within the time period described above.

2.6 Completion and Acceptance

A USACE Quality Assurance (QA) inspector will be required to accompany the contractor during performance of the work to make certain that the contractor is removing the appropriate material.

The contractor must allow the QA person on the contractor’s barge at all times work is being performed.

PART 3 BIDDING INFORMATION

3.1 Point of Contact

3.2 Bid Proposal

The contractor must provide a proposal for the work as shown on the attached bid schedule. The costs proposed must include the costs of all labor, material, and equipment necessary to complete the work as provided for in this request for proposal and all related documents including, plans, figures, specifications and other contract documents previously provided.

As part of the proposal, the contractor must provide a schedule for completion of the base bid work and a submittal detailing the equipment the contractor will be using on this job (Refer to Section

2.4 of this SOW). Failure to include these items along with the proposal may disqualify the bid.

1 GENERAL REFERENCES AND INFORMATION

d. Unforeseen Hazardous Material: If suspected hazardous material is disturbed during the clearing and snagging operation, the contractor must stop that portion of work and notify the Government Quality Assurance Person immediately. Work on this portion of the project will not proceed until the Government determines if the material is hazardous. If material is not hazardous, the Government will direct the Contractor to proceed with the operation. If material is hazardous and handling of the material is necessary to accomplish the work, the Government will issue a modification pursuant to "FAR 52.243-4, Changes" and "FAR 52.236-2, Differing Site Conditions.”

2 SUBMITTALS

3 REGULATORY REQUIREMENTS

In addition to the detailed safety and health requirements of this attachment, the contractor must comply with all applicable Federal, DOD, State, County, and City ordinances, criteria, rules and regulations during the life cycle of the project. Submit matters of interpretation of standards to the Government Quality Assurance Person for resolution. When regulatory requirements conflict or vary, the most stringent requirements must apply.

4 SITE QUALIFICATIONS AND DUTIES FOR SAFETY AND HEALTH PERSONNEL

The contractor must have a competent person who will be responsible for the following health and safety related activities:

a. Conduct daily safety and health inspections per contractual requirements and schedules in accordance with EM385-1-1, Section 01.A.12. Safety inspection logs must be attached to the Contractors' daily production report and posted at the site.

b. Maintain a safety and health deficiency tracking system that monitors outstanding deficiencies until resolution. The contractor must maintain a written deficiency tracking log which includes area/operation inspected, date of inspection, identified hazards, recommended corrective actions, estimated and actual dates of corrections. The tracking log must be made available to government personnel upon demand.

c. Conduct mishap investigations and complete required reports. Maintain the OSHA Form 300 and Daily Production reports for prime and sub-contractors.

d. Maintain applicable safety reference material at the project site.

e. Implement and enforce job safety requirements.

f. Have available upon request, and maintain on-site, copies of the information required by EM 385- 1-1, section 01.A.06. The contractor must also have the following documents on site and available upon demand by government personnel:

(1) a listing of emergency telephone numbers and addresses of ambulance service, medical facilities, police, USCG and fire department facilities. The contractor must have maps showing the routes of travel to these agencies.

(2) copies of Activity Hazard Analyses

(3) Hazard Tracking Log

(4) Accident and incident reports

(5) copies of regulatory citations and\or violations that occur on the project site

5. ABBREVIATED ACCIDENT PREVENTION PLAN

The contractor must use a qualified person to prepare the written site-specific Abbreviated APP. Prepare the Abbreviated APP in accordance with the format and requirements of USACE EM 385-1-1 and as supplemented herein. Cover all paragraph and subparagraph elements in USACE EM 385-1-1, Appendix A, “Minimum Basic Outline for Accident Prevention Plan”.

a. Abbreviated Accident Prevention Plan (APP): The Abbreviated APP must be job-specific and must address any unusual or unique aspects of the project or activity for which it is written. Disregarding the provisions of this contract or the accepted Abbreviated APP will be cause for stopping of work, at the discretion of the Contracting Officer, until the matter has been rectified. Once work begins, changes to the accepted Abbreviated APP must be made with the knowledge and concurrence of the Contracting Officer, project superintendent, Contracting Safety Officer, District Safety Officer and government QA person.

b. The Abbreviated APP must be signed by the person and firm (senior person) preparing the Abbreviated APP, the Contractor, the on-site superintendent, the designated site safety and health officer and any designated CSP and/or CIH.

c. Submit the Abbreviated APP to the Contracting Officer 15 calendar days following the award of the contract. Work cannot proceed without an accepted APP. Once approved by the Buffalo District Safety Officer, the APP and attachments will be enforced as part of the contract.

d. Copies of the accepted plan will be maintained by the District Safety Officer and at the job site.

The Abbreviated APP must be continuously reviewed and amended, as necessary, throughout the life of the contract. Unusual or high-hazard activities not identified in the original Abbreviated APP must be incorporated in the plan as they are discovered.

6. MANDATORY SAFETY AND HEALTH MEETING TOPICS

Safety Meetings must be conducted and documented as required by EM 385-1-1. Minutes showing contract title, signatures of attendees and a list of topics discussed must be attached to the Contractors' daily production report.

The required mandatory topics will be discussed:

a. Review of the Accident Prevention Plan (or Abbreviated APP if applicable)

b. Methods of Emergency Communications while underway and while working at the project site

c. Accident Notification and Reporting requirements

d. Personal Protective Equipment requirements.

e. Equipment Safety

f. First Aid/CPR (First Aid Kits – where they are located and who is who is qualified to provide first aid)

g. Review of Preliminary Hazard Tracking List

h. Review of Activity Hazard Analysis

7. ACTIVITY HAZARD ANALYSIS (AHA)

a. The AHA will be developed by the contractor, supplier or subcontractor and provided to the prime contractor for submittal to the Contracting Officer. The Activity Hazard Analysis (AHA) format must be in accordance with the format provided in Enclosure 2 of this attachment. Submit AHA for review at least 15 calendar days prior to the start of construction.

b. The AHA should be referred to while conducting daily safety and health inspections to ensure the implementation and effectiveness of the activity's safety and health controls. The AHA list will be reviewed periodically (at least monthly) during the life of the contract at the Contractor supervisory safety meeting and updated as necessary when procedures, scheduling, or hazards change.

c. AHAS must address the hazards of the PHL as well as those hazards identified during the life cycle of the project.

8. EMERGENCY MEDICAL TREATMENT

Contractors will arrange for their own emergency medical treatment. The Government has no responsibility to provide emergency medical treatment. The contractor must have a person current in the requirements of the American Red Cross First Aid and CPR on site at all times during working hours. An approved First Aid Kit must be on site and readily available. The requirements for First Aid kits are found in EM-385-1-1, Section 03B.

9. ACCIDENT NOTIFICATION AND REPORTING

a. Accident Notification Notify the Government Quality Assurance Person as soon as practical, but not later than 4 hours after any accident meeting the definition of Recordable Injuries or Illnesses or High Visibility Accidents, property damage equal to or greater than $2,000, or any weight handling equipment accident.

Information must include contractor name; contract title; type of contract; name of activity, installation or location where accident occurred; date and time of accident; names of personnel injured; extent of property damage, if any; extent of injury, if known, and brief description of accident (to include type of construction equipment used, PPE used, etc.). Preserve the conditions and evidence on the accident site until the Government investigation team arrives on-site and Government investigation is conducted.

b. Record all accidents resulting in injury, illness and property damage on USACE Accident Report Form 3394 and provide the report to the Contracting Officer within five (5) calendar day(s) of the accident. The Contracting Officer will provide copies of any required or special forms.

c. For injuries and illnesses, and property damage accidents resulting in at least $2,000 in damages, the Prime Contractor must conduct an accident investigation to establish the root cause(s) of the accident, complete USACE Accident Report Form 3394 and provide the report to the Contracting Officer within Five (5) calendar day(s) of the accident. The Quality Assurance person will provide copies of any required or special forms.

d. For any weight handling equipment accident (including rigging gear accidents) the Prime Contractor must conduct an accident investigation to establish the root cause(s) of the accident, complete the 3394 form and provide the report to the Government Quality Assurance Person within 5 calendar days of the accident.

Crane operations must not proceed until cause is determined and corrective actions have been implemented to the satisfaction of the contracting officer. The Contracting Officer will provide a blank copy of the accident report form.

10. MONTHLY WORK HOUR REPORTS

Monthly exposure reporting to the Contracting Officer is required to be attached to the monthly billing request and submitted by the 5th of every month. This report is a compilation of employee-hours worked each month for all site workers, both prime and subcontractor. The Contracting Officer will provide copies of any special forms.

11. CRANE OPERATIONS

a. Crane operators must meet the requirements in USACE EM 385-1-1, Section 16 and Appendix G.

In addition, for mobile cranes with Original Equipment Manufacturer (OEM) rated capacitates of 50,000 pounds or greater, crane operators must be designated as qualified by a source that qualifies crane operators (i.e., union, a government agency, or an organization that tests and qualifies crane operators). Proof of current qualification must be provided.

b. Crane Reports Submit crane inspection reports required in accordance with USACE EM 385-1-1, Appendix H and as specified herein with Daily Reports of Inspections.

c. Crane Documentation: The contractor must have documentation of compliance for each crane entering an activity under this contract. Documentation must state that the crane and rigging gear meet applicable OSHA regulations. The contractor must have documentation that the crane operator(s) is qualified and trained in the operation of the crane to be used. The Contractor must also documentation for the crane operators working stating they have been trained in the proper use of all safety devices (e.g., anti-two block devices).

d. The use of hooks on equipment for lifting of material must be in accordance with manufacturer's printed instructions.

Attachment 6 - Abbreviated Accident Prevention Plan (APP) Checklist

11. ABBREVIATED APP for LIMITED-SCOPE SERVICE, SUPPLY AND R&D CONTRACTS. If service, supply and R&D contracts with limited scopes are awarded, the contractor may submit an abbreviated Accident Prevention Plan. This APP must address the following areas at a minimum. If other areas of the EM 385-1-1 are pertinent to the contract, the contractor must assure these areas are addressed as well.

a. Title, signature, and phone number of the plan preparer.

b. Background Information to include: Contractor; Contract number; Project name; Brief project description, description of work to be performed, and location (map); The project description must provide a means to evaluate the work being done (see AHA requirements in 01.A.13) and associated hazards involved. Contractor’s APP must address the identified hazards involved and the control measures to be taken.

c. Statement of Safety and Health Policy detailing their commitment to providing a safe and healthful workplace for all employees.

d. Responsibilities and Lines of Authorities – to include a statement of the employer’s ultimate responsibility for the implementation of his SOH program; Identification and accountability of personnel responsible for safety at all levels to include designated site safety and health officer (SSHO) and associated qualifications. The District SOHO will review the qualifications for acceptance.

e. Training - new hire SOH orientation training at the time of initial hire of each new employee and any periodic retraining/recertification requirements.

f. Procedures for job site inspections - assignment of responsibilities and frequency.

g. Procedures for reporting man-hours worked and reporting and investigating accidents. Report ALL accidents as soon as possible but not more than 4 hours afterwards to the Contracting Officer/Representative (CO/QA). An accident that results in a fatal injury, permanent partial or permanent total disability must be immediately reported to the Contracting Officer.

h. Emergency Planning. Employees working alone must be provided an effective means of emergency communication. This may be cellular phone, two-way radio or other acceptable means.

The selected means of communication must be readily available and must be in working condition.

i. Drinking Water provisions, toilet and washing facilities.

j. First Aid and CPR training (at least two employees on each shift must be qualified/certified to administer first aid and CPR) and provision of first aid kit (types/size).

k. Personal Protective Equipment.

(1) WORK CLOTHING - Minimum Requirements. Employees must wear clothing suitable for the weather however minimum requirements for work must be short-sleeve shirt, long pants (excessively long or baggy pants are prohibited) and leather work shoes. If analysis determines that safety-toed (or other protective) footwear is necessary (i.e., mowing, weedeating, chain saw use, etc.), they must be worn.

(2) Eye and Face Protection. Eye and face protection must be worn as determined by an analysis of the operations being performed HOWEVER, all involved in chain saw use, chipping, stump grinding, pruning operations, grass mowing, weedeating and blowing operations must be provided safety eyewear (Z87.1) as a minimum.

(3) Hearing Protection. Hearing protection must be worn by all those exposed to high noise activities (to include grass mowing and trimming, chainsaw operations, tree chipping, stump grinding and pruning).

(4) Head Protection. Hard hats must comply with ANSI Z89.1 and must be worn by all workers when a head hazard exists. At a minimum, hard hats must be worn when performing activities identified in

(2) above.

(5) High Visibility Apparel must comply with ANSI/ISEA 107, Class 2 requirements at a minimum and must be worn by all workers exposed to vehicular or equipment traffic.

(6) Protective Leg chaps must be worn by all chainsaw operators.

(7) Gloves of the proper type must be worn by persons involved in activities that expose the hands to cuts, abrasions, punctures, burns and chemical irritants.

(8) If work is being performed around water and drowning is a hazard, PFDs must be provided and worn as appropriate.

l. Machine Guards and safety devices. Lawn maintenance equipment must have appropriate guards and safety devices in place and operational.

m. Hazardous Substances. When any hazardous substances are procured, used, stored or disposed, a hazard communication program must be in effect and MSDSs must be available at the worksite. Employees must have received training in hazardous substances being used. When the eyes or body of any person may be exposed to corrosives, irritants or toxic chemicals, suitable facilities for quick drenching or flushing of the eyes and body must be provided within 10 seconds of the worksite.

n. Traffic control must be accomplished in accordance with DOT’s MUTCD.

o. Control of Hazardous Energy (Lockout/Tagout). Before an employee performs any servicing or maintenance on any equipment where the unexpected energizing or startup of the equipment could occur, procedures must be in place to ensure adequate control of this energy.

p. Driving, working on (i.e., working with equipment/mowers) while on slopes, working from/in boats/skiffs, etc. must also be considered and dealt with accordingly.
