About this file
This justification and approval document describes a proposed sole source award for one Versa-Lift 40/60E battery powered forklift. The forklift is needed to safely lift and move MK57 missile launchers and directors at the Navy Munitions Command facility in Yorktown, Virginia. Market research found no other equipment can provide the required variable lifting weight capabilities and crane boom and standard forklift functions. The anticipated cost to the government is $278,950. While no other sources were identified, the contracting activity will continue market research to encourage future competition if alternative suppliers emerge.
The related solicitation seeks one Versa-Lift 40/60E forklift and shipping costs to be delivered to the Navy Munitions Command facility. Quotes are due by September 11, 2020. Evaluation will be based on lowest price among technically acceptable offers. The soliciting agency is the Naval Sea Systems Command on behalf of the Department of the Navy.

4. Statutory Authority Permitting Other Than Full and Open
Competition
10 U.S.C. 2304(c)(1) as implemented by the Federal
Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular features, do not meet, or cannot be modified to meet, the agency’s needs.
5. Rationale Justifying Use of Cited Statutory Authority
The Versa-Lift brand forklift is a unique hybrid forklift designed to combine both overhead Boom Crane Lift and standard forklifting capabilities. With an extendable counterweight, the Versa-Lift can achieve greater lifting capacities by increasing its lifting capacity from 40,000 to 60,000 pounds remotely. The Versa-Lift is equipped with a removable hydraulic boom, adding crane-lifting capabilities in conjunction with its standard forklift rail lifting. The Versa Lift’s compact design, extendable counterweight, and boom lifting capabilities is only available on the Versa Lift 40/60E, manufactured by Custom Mobile Equipment.
The Versa-Lift’s unique Boom Crane Lift capability is essential to safely lifting and moving the MK57 Launchers and Directors that have a small base and disproportionally large and heavy top. This capability is necessary to safely handle and load MK57 Launchers and Directors to tractor-trailers for shipment from the Yorktown Munitions Facility.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
Code S32 and the MK 57 NSSMS Depot, NMCLANT Yorktown technician’s market research revealed no other company can provide any equipment lift with variable lifting weight capabilities, and required crane boom and standard forklift lifting capabilities. These specifications are unique to the material handling equipment industry.
Research revealed the two leading Material Handling Equipment manufacturers in the United States, Crown Equipment Inc, and Hyster-Yale Inc., do not offer a similar Forklift and Crane Boom combination. Both manufacturers indicated that the Versa-Lift brand forklift is a unique device designed for a specialized segment of the market.
Toyota Industries Corporation, (the top Industrial Lift Truck supplier in the United States) and their distributor Toyota Lift Inc. in Southern California confirmed, Toyota does not manufacture a Forklift and Crane Boom combination.
Clark Material Handling International Inc. and Hyundai Heavy Industries indicated they do not manufacture a like item, citing a specialized item.
Defense Logistics Agency Troop Support, Heavy Equipment Procurement Program’s list of manufacturers does not list any that manufacture a Forklift and Crane Boom combination.
The Materials Handling Equipment Project Manager at NAVSUP confirmed that NAVSUP is not able to procure this asset and does not have this type of equipment available.
After exhausting all resources, quotes were obtained from the Versa-Lift manufacturer and their distributor National Lift Truck.
7. Determination of Fair and Reasonable Costs
The Contracting Officer shall determine that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
NSWC PHD will continue to conduct market research as warranted to provide a broader vendor base as applicable for the types of supplies/services covered by this document. If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
