JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Port Hueneme Division (NSWC PHD), Code 02.
2. Description of the Action Being Approved
NSWC PHD intends to award a contract on the basis of other than full and open competition in support of Product Support Office (PSP) for the purchase of a brand name product: LeadTools Software maintenance and renewal.
3. Description of Supplies/Services
The Advanced Technical Information System (ATIS v1.5.x) is the Naval Sea Systems Command (NAVSEA) and Navy Information Warfare Systems Command (NAVWAR) community's authoritative configuration management source for Navy technical publications. ATIS integrates with the Naval Systems Data Support Activity (NSDSA) Technical Data Manual Information System (TDMIS). It provides the fleet and shore communities with the most current and up to date technical publication configuration management information to support operations, maintenance, repair, and outfitting.
LEADTOOLS is a family of comprehensive toolkits designed to help programmers integrate documents, multimedia, and vector imaging into their desktop, server, tablet, and mobile applications. The LEADTOOLS SDK provides functionality for certain lower tier stand-alone Software Development Kits (SDKs) that are included with other more advanced stand-alone SDKs. The LEADTOOLS software is incorporated into ATIS v1.5.x. and is required to support, maintain, and keep operational the hundreds of existing engineering drawings supporting the fleet and shore communities.
The total estimated value of the requirement is on a Base-Plus 4-option year contract with the following funding source:
Estimated Dollar Value Fund Type Year Cost
4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304 (c) (1) as implemented by paragraph 6.302-1(a)(2) of the Federal Acquisition Regulation (FAR); When the supplies or services required by the agency are only available from one responsible source, or for DoD . . . from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.
5. Rationale Justifying Use of Cited Statutory Authority
The submarine community developed their engineering drawings in TG4 (Tile Group 4) and renamed them as C4 files, which are image file formats in order to be read by the ATIS application.
The LeadTools application is embedded in the ATIS software code and is currently being used in the fleet. As a result LeadTools software is the only known software application that can meet the requirement and is able to read engineering drawings associated with the Evolution of research, test and evaluation, and development to identify a new product would need to be performed, would take an estimated four to six months.
Full and open competition is not permitted for this
LEADTOOLS Maintenance and Server renewal.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Market research was conducted in Feb 2020 using current price documents and historical cost estimating relationships from previous LEADTOOLS Maintenance and Server Renewal procurements. Three vendors responded to market research and provided three price documents, which fulfilled the solicitation requirements.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the supply covered by this Justification & Approval (J&A) will be fair and reasonable based on cost/pricing information for past procurements.
8. Actions to Remove Barriers to Competition
NSWC PHD Contracts Office will continue to conduct market research as warranted to provide a broader vendor base as applicable for the types of supplies/services covered by this document. If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
