About this file

This document is a justification and approval for a sole source procurement and a related solicitation. The naval sea systems command seeks to procure solid state drives from Red Rock Technologies on a sole source basis. The drives are needed for compatibility with shipboard consoles and were developed specifically for this purpose over two years of testing. An earlier attempt to solicit other offers on beta.SAM received no responses. The solicitation seeks firm fixed price quotes by April 14, 2020 for drives and modules priced previously at fair and reasonable levels. The small business incumbent Red Rock Technologies is the original equipment manufacturer and sole approved source due to proprietary firmware requirements.

FY20

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1) as implemented by paragraph 6.302- 1(a)(2)(iii) of the Federal Acquisition Regulation (FAR);

Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

Due to an earlier ordnance alteration (ORDALT) for

, the ships had previously required replacement of SCSI Spinning Drives. Because much of the similar equipment required for compatibility with shipboard consoles was no longer manufactured, , Red Rock Technologies Inc. was identified as the only manufacturer able to provide required parts and developed proprietary data to support the

Red Rock Technologies, Inc. is the only manufacturer of the parts for this requirement.

, which is reflected in the drives firmware logic and form factor. The drives have been extensively matured and tested at PHD over a 2-year period and several specific modifications have been applied to ensure that the drives meet

. This includes the firmware logic as well as the drive form factor, which was specifically designed to fit in . The drives were taken to a ship for a fitment check to ensure they mount properly to the consoles and that the power and cabling are compatible so we can ensure these are drop in replacement devices. The drive Form, Fit and Function meet NSWC PHD requirements for . The Government is required to purchase direct from Red Rock Technologies, Inc. to ensure that it obtains the correct firmware version that was developed for PHD during the 2-year product development and test cycle with the at the NSWC PHD lab.

Even if another vendor were to procure the drives directly from Red Rock Technologies, Inc. for resale, the Government would not be able to ensure that the latest firmware logic modifications were applied prior to filling/shipping the order. Additionally, only Red Rock Technologies, Inc. can maintain and update the drives proprietary firmware. If the Government were to receive a stale or old version of firmware logic the drives would be unusable and would need to be sent back to Red Rock Technologies, Inc. for an update which will have a significant impact on cost and schedule.

An attempt to identify and qualify an alternate source that would be capable of meeting the specifications of this requirement would require the Government to incur costs associated with a duplicative feasibility study, which would likely exceed the of the cost of this procurement, and would not be recovered through competition.

Additionally, it would require the Government to incur an unreasonable delay in undertaking another two-year feasibility study to which may or may not result in identification of another suitable source.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

A Source Sought posted on Beta. SAM from 24 February 2020 through 09 March 2020, resulted in no interested vendors.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable based on historical information from Red Rock on previous procurements.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, NSWC PHD Contracting Office has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWC PHD Contracting Office will assess whether competition for future requirements is feasible.
