OPOAM 3016.505-90(a)(2)(ii) Justification for Exception to Fair Opportunity

Exceeding the SAT pursuant to FAR 16.505(b)(2)(ii)(B)

JEFO No.: FY20-00241 - 1 -

JEFO No.: FY20-00241

Date: July 23, 2020 PR Number: RSBR-20-00051

1. Agency and Contracting Activity.

The Department of Homeland Security (DHS), Office of Procurement Operations (OPO), Science and Technology Acquisition Division (STAD), on behalf of the Science and Technology Directorate (S&T) Office of Mission and Capability Support (MCS) prepared this justification for an exception to fair opportunity.

2. Nature and/or description of the action being approved.

DHS/OPO intends to procure additional work within scope and increase the ceiling of task order HSHQDC-17-F-00031 without considering other awardees pursuant to FAR 16.505(b)(2)(i)(B).

3. A description of the supplies or services required to meet the agency’s need (including the estimated value).

DHS S&T requires additional updates to the Tier I Mission Thread Architecture, the Tier II Mission Thread Architecture and additional Apex Border Situational Awareness (BSA) Future Capabilities Support. The Contractor will also provide additional technical assistance to support the Counter Unmanned Aerial Systems (C-UAS) program.. This additional work is necessary to meet the near-term demands for technical services by S&T Program Managers (PMs) and fully utilize the remaining performance period on the task order.

This additional work is estimated at a 14% increase to the task order ceiling.

4. Identify the exception to fair opportunity and supporting rationale, including a demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the exception cited.

FAR 16.505(b)(2)(i)(B), Only one awardee is capable of providing the services required at the level of quality required because the services ordered are unique or highly specialized.

Rationale:

The Joint Mission Threads task order was designed to to address capability gaps in information sharing, tactical response and strategic planning. This includes identifying joint gaps, overlaps, and shortfalls that result in deficiencies in joint border operational capabilities. Architectures and data standards are key enablers and criteria for assessment and integration. The task order provides technical services for assistance in identifying, developing, and facilitating the

JEFO No.: FY20-00241 - 2 -validation of joint mission thread architectures, operational requirements, and border operations business cases linked to the joint mission thread.

Task 1 focuses on Apex BSA program’s mission thread development and validation for Air and Land Security operations. Task 2 focuses on Port and Coastal Surveillance program’s mission thread development and validation for Maritime Security operations. In addition, both Tasks 1 and 2 have subtasks focused on Course of Action evaluation tools; CONOPS and TTPs development and validation; Transition and Sustainment assessment; Return on Investment assessment; Business Case Analysis development; and Operational Scenario analysis and assessments.

The scope of this task order requires specific and highly technical support with specialized training and experience (i.e. Joint Mission Threads). It also requires specific knowledge and experience with all DHS operational components and in some cases, embedding directly with the Components to conduct that coordination. The performer must also be able to identify gaps, overlaps and shortfalls and be able to use enterprise architectures and data standards as key enablers and criteria for assessment and integration.

Specific capabilities required by the contractor are as follows:

• Must have at least 5 years of recent and relevant experience in enterprise architecture development and documentation using Department of Defense Architecture Framework (DoDAF) or similar architecture framework by personnel holding an active Federal Enterprise Architect Certification (FEAC)

• Must have at least 5 years of recent and relevant experience with tools that will facilitate integration into a Defense Architecture Framework (DoDAF) Meta Model (DM2) compatible Mission Thread Repository hosted by DHS S&T Collaboration Site (STCS)

• Must be capable of developing and conducting business case and system of system engineering analysis of Fidelity Level I and II Homeland Security Operations (HSO) Joint Mission Threads

• Must have at least 5 years’ experience and at least 3 proven project examples of demonstrated experience developing and documenting HSO Joint Mission Threads

• Must have prior experience developing process models to conduct simulations and analysis in support of HSO Joint Mission Threads to execute simulations based on the mission-based activity models

• Prior experience participating in CBP’s Capability Gap Analysis Process (CGAP) to identify, document and analyze capability gaps and potential technology solutions that span the entire solution space and involve any combination of doctrine, organization, training, materiel, leadership and education, personnel and facilities (DOTMLPF) is desirable

• Key contract personnel (Program Manager II, Systems Engineer II and Senior Operations Analysts) must have active Top Secret (TS) clearances with either access to Special Compartmented Information (SCI) or the ability to obtain SCI access under a current TS clearance. These TS and/or TS/SCI positions require the ability of the contractor to generate and work with classified information at contractor’s facility. In

JEFO No.: FY20-00241 - 3 -addition, contract personnel must be able to meet DHS S&T Entry on Duty (EOD) requirements.

Only SAIC has personnel with the requisite experience to perform this work without disruption to the mission and Joint Mission Threads activities.

S&T is requesting additional work within scope for specific tasks/deliverables along with a proportional increase in the ceiling of the current task order’s period of performance, which ends in March 2022, in order to meet the additional, near-term demands for technical services by S&T PMs. The increased ceiling is being requested to provide additional updates to the Tier I Mission Thread Architecture, the Tier II Mission Thread Architecture and additional Apex BSA Future Capabilities Support. The Contractor will also provide additional technical assistance to support the C-UAS program..

This additional work will fulfill program office requirements without duplicating Government efforts to award a task order for the same work currently being performed by SAIC in HSQHDC- 17-F-00031. SAIC has the expertise necessary to complete this additional work and has personnel currently working on these efforts.

5. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer has determined that the anticipated cost will be fair and reasonable. As part of the evaluation of the contractor’s proposal for this additional work, the Contracting Officer and Contracting Officer’s Representative/Program Manager will consider the level of effort and the mix of labor proposed to perform the additional work within scope in order to determine that the total price is reasonable. The contractor’s labor mix and level of effort will be compared to the Independent Government Cost Estimate (IGCE) as well as the existing rates in the task order and the contractor’s OASIS contract to determine reasonableness. Certified Cost or Pricing Data is not required in accordance with the exception at FAR 15.403-1(b)(3), as the services are commercially available and Cost or Pricing Data is not required when acquiring a commercial item.

6. Any other facts supporting the justification.

None.

7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.

DHS Contracting is working to openly compete and award the follow-on under OASIS in

FY2021.

8. DHS intends to post this requirement on beta.SAM pursuant to FAR 16.505(b)(2)(ii)(D).
