LSJ No.: FY15-0385, ID: 1627

An essential responsibility of OCHCO is to provide employees with a wide array of accurate retirement information such as; web calculators, early and disability benefits, part-time and intermittent service, deposits and re-deposits, Social Security/FERS supplemental benefits, Thrift Savings Plan benefits, survivor benefits, and severance pay. In addition, OCHCO must provide tools to its HR specialists in allowing them to on-board new employees to include; establishing their eOPF records, import employee information from the National Finance Center (NFC), and provide reports and case tracking tools.

4. Authority and supporting rationale.
This acquisition is conducted under the authority of Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures and 40 U.S.C. 501, Services for Executive Agencies in accordance with FAR 8.405-6, Limiting Sources. In accordance with FAR 8.405- 6(a)(1)(i)(B), the circumstances restricting competition for this acquisition is “Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.”
In August 2010, DHS competitively awarded GS-02F-0092T/HSHQDC-10-F-00123 to Economic Systems Inc. using the ordering procedures at FAR 8.405. DHS Components have since implemented FHR Navigator across DHS to integrate employee records and manage a wide array of HR services. It is necessary to limit competition for new work to only one source because Economic Systems Inc. is the only vendor that has access to FHR Navigator as they developed, maintain, and own the proprietary software codes. The vendor’s proprietary software allows for an automated tool that can quickly process, manage, and document all steps associated with DHS’ hiring actions. Also, FHR Navigator is the only known online HR processing tool currently available in a FedRAMP approved data center.
FHR Navigator is the only online processing tool which integrates with multiple HR functions and processes within a single processing tool, such as; USAJOBS to post job announcements, import applicant data, and export status from/to the Office of Personnel Management site. Additionally this tool provides simultaneous access to agency managers, employees, and HR staff for actions that include recruitment requests, position management, retirement calculation and processing, benefits and personnel action processing, and the review and staging of documents for filing in the eOPF. It also has the unique capability of using information provided in any of these HR functions as input to the other areas. Data entered in one area is used in all other areas, cutting down on data entry, increasing data consistency, and saving time and resources. In addition, there are productivity tools and data connectivity services which allow connection to NFC for personnel/payroll actions. DHS would require at least five separate processing tools to provide the same functionality available from FHR Navigator. To establish alternative procurements with multiple vendors could create an administrative burden across the Department which effectively negates the services afforded therein.

5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).
The contracting officer has determined that issuing the proposed Task Order to Economic Systems, Inc. for the HR online processing tool, FHR Navigator represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government’s needs. This order will be placed in accordance with FAR 8.404, “Use of Federal Supply Schedules.” The General Services Administration (GSA) has already negotiated fair and reasonable pricing rates. Discounts to these GSA schedule rates will be requested.
6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.
Market research was conducted and has confirmed Economic Systems Inc. is the only vendor that has access to FHR Navigator. FHR Navigator is developed and maintained by Economic Systems Inc. and this vendor owns the proprietary software code. DHS would have to procure new software, software licenses, and maintenance at a cost exceeding that which currently exists from Economic Systems Inc.
7. Any other facts supporting the limited-sources justification.
None.
8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited-sources) before any subsequent acquisition for the supplies or services is made.
The government intends to competitively solicit a new HR online processing tool with available software code from multiple distributors in fiscal year 2020. This will allow the Government to seek competition in subsequent acquisitions for the same type of support, thus eliminating the barriers to competition.
On an annual basis, DHS will conduct an analysis to determine if the Government’s requirement has changed or if Econmic Systems Inc.’s proprietary software code is available from other vendors at a competitively fair and reasonable price.
