About this file
This document is a Justification for Exception to Fair Opportunity for a Multiple Award Contract (MAC) Order above the Simplified Acquisition Threshold (SAT), awarded to T-Mobile for wireless mobile services at Joint Task Force Guantanamo Bay (JTF-GTMO). The procurement requires T-Mobile to provide comprehensive wireless services, including three unlimited data SIMs, three new hotspot devices, wireless data services for ten existing hotspot devices, voice and data services for 79 smartphones, and international calling limited to $3,500 annually. Critical performance requirements include 99.9% network uptime throughout the Guantanamo Bay area, minimum data speeds of 10 Mbps download and 5 Mbps upload, device encryption meeting Department of Defense security standards, and 24/7 technical support.
The justification highlights that T-Mobile is the sole commercial wireless provider in the Guantanamo Bay area, utilizing the Navy's Spiral 4 contract as the mandated contract vehicle for DoD wireless services. The total contract value is $340,409.55, covering the base year and four additional 12-month option periods. Previous contracts with T-Mobile include three sole-source awards: W91WRZ-24-F-0009 for $49,657.04, W91WRZ-24-F-0001 for $26,578.50, and W91RUS-11-A-0008 for $52,721.10. The procurement was conducted under 10 U.S.C. 2304a-2304d, with the contracting activity being 410th CSB RCO-GTMO and the requiring activity JTF GTMO-J6.

JUSTIFICATION FOR EXCEPTION TO FAIR OPPORUNITY
FOR A MULTIPLE AWARD CONTRACT ORDER (MAC)
Above the Simplified Acquisition Threshold (SAT)
1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY: This is a Limited Source Justification. The requiring activity is the JTF GTMO-J6; the contracting activity is 410th CSB RCO-GTMO.
2. NATURE/DESCRIPTION OF CONTRACT ACTION: This acquisition is conducted under the authority of 10 U.S.C. 2304a through 2304d. This is a limited source action to be awarded as a new task order and/or modification of an existing order to T-Mobile as identified in paragraph 3 below. The placement of a firm, fixed price order is anticipated.
3. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES: The proposed acquisition is for wireless mobile services at JTF-GTMO. The requester has advised, and there is a history, of a recurring need for these services beyond the base year. In light of this projected need, the customer has requested that four additional options, (each covering 12 months), be included in the contract, at a cost of $340,409.55 from T-Mobile.
Requirements for this contract include providing wireless mobile services as follows:
1. Three new unlimited data SIMs,
2. Three new hotspot devices to be used in conjunction with the three SIMs referenced in point (1) above,
3. Wireless data services for ten hotspot devices currently in use,
4. Wireless voice and data for 79 smartphones that are currently in use, and
5. International calling limited to $3,500 per year.
The wireless mobile services contract requires the contractor to provide cellular voice, data, and text messaging services that meet the following critical performance requirements:
a) Network Coverage: The contractor must provide coverage throughout the Guantanamo Bay area, with a minimum of 99.9% network uptime.
b) Data Speeds: The contractor must provide data speeds of at least 10 Mbps for downloads and 5 Mbps for uploads.
c) Security: The contractor must ensure that all mobile devices provided are encrypted and meet the security requirements of the Department of Defense (DoD) for Defense Enterprise Emails (DEE).
d) Technical Support: The contractor must provide 24/7 technical support to resolve any issues with the services or devices.
4. IDENTIFICATION OF THE JUSTIFICATION RATIONALE AND/OR
DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS: The statutory authority which permits not providing each awardee a fair opportunity to be considered for each order exceeding $10,000 issued under a multiple award contract is 10 U.S.C.
2304c, as implemented by FAR 16.505(b)(2) and, for orders exceeding $250,000, DFARS 216.505-70(b)(2).
Naval Station Guantanamo Bay is the forward, ready, and irreplaceable U.S. Sea power platform in the Caribbean. JTF- GTMO is located there. The market for wireless mobile services in the Guantanamo Bay area is limited, with only one commercial provider, T- Mobile, available to provide services. The Navy's Spiral 4 contract is the mandated contract vehicle for all DoD agencies in CONUS and some OCONUS areas, providing a standardized pricing structure and terms and conditions for the procurement of wireless mobile services. T-Mobile is also an authorized service provider under the Navy's Spiral 4 contract, which has pre-negotiated contract prices and discounts for equipment purchases. As the only available provider, T-Mobile has a 100% market share on Naval Station Guantanamo Bay.
5. DETERMINATION OF THE BEST VALUE: The U.S. Navy's Spiral 4 contracts are mandatory for cellular phone, wireless devices, and wireless service purchases. The IDIQ was awarded to seven companies including T-Mobile after competitive solicitation.
The prices for services therein have already been determined as providing best value to the United States Government.
6. DESCRIPTION OF MARKET RESEARCH: The market for Wireless Mobile Services in the Guantanamo Bay area is limited, with only one commercial provider, T-Mobile, available to provide services. T-Mobile is also an authorized service provider under the Navy's Spiral 4 contract, which has pre-negotiated contract prices and discounts for equipment purchases. The FCC regulates wireless mobile services in Guantanamo Bay, ensuring compliance with industry standards. The standard delivery time for Wireless Mobile Services is expedited, with delivery possible as soon as a purchase order is in place. There are no environmental or safety regulations that affect the required service, and no customization, modification, or tailoring of services is allowed.
As the only available provider, T-Mobile has a 100% market share in the Guantanamo Bay area, and the government's leverage in the marketplace is limited to the terms and conditions of the Spiral 4 contract. The demand for wireless mobile services is expected to remain steady, with the Navy's Spiral 4 contract providing a stable and predictable pricing structure for government agencies.
7. ANY OTHER SUPPORTING FACTS: This procurement uses a MAC and will be solicited and awarded in accordance with FAR Subpart 16.5.
