The FWC seeks competitive pricing to conduct prescribed burns on approximately 11,825 acres of fire-maintained conservation lands, including mesic flatwoods, restoration sandhill, sandhill, scrubby flatwoods, and wet flatwoods. The work is intended to supplement FWC's in-house prescribed burning program and requires continual coordination with FWC's Project Manager and Contract Manager. A mandatory pre-bid conference and site visit will be held on September 22, 2026, at 10:00 AM ET at coordinates 29.9324, -83.6596. The deadline for written questions is September 28, 2026, at 5:00 PM ET. Sealed bids must be received by October 6, 2026, at 3:00 PM ET, with a public bid opening at the same date and time. The anticipated award date is October 12, 2026. The contract has an initial term of one year from the issuance of the Purchase Order, with FWC holding the option to renew on a yearly basis for up to three additional years under the same terms and conditions. No minimum amount of work is guaranteed under the contract.
Bidders must submit pricing on a per-acre basis for the initial contract term and each of the three potential renewal years. The award will be made to the responsive, responsible bidder submitting the lowest total price. Contractors must be Florida Certified Prescribed Burn Managers with at least five years of experience managing prescribed burns and a minimum of twenty prior burn authorizations from the Florida Forest Service during the past five years. All contractors must provide a Performance Bond equal to 100 percent of the total contract price before commencing work. Bidders are required to submit a minimum of three references for similar projects and must be registered in both MyFloridaMarketPlace and the SunBiz system prior to bid opening. The contractor is responsible for all permitting, equipment, personnel, and costs associated with prescribed burning operations, including fire suppression costs and any damages resulting from escaped fires. Subcontracting of Certified Prescribed Burn Manager responsibilities is not permitted. Liquidated damages of $100 per calendar day will be assessed for failure to complete work by the specified completion date, except in cases of unavoidable delay beyond the contractor's control.

If the tie has not been broken by application of the aforementioned statutes, the Commission will proceed with a random selection to decide the award.
SUPPORTING/SUPPLEMENTAL INFORMATION
The Commission requires that bidders submit all required technical, specification, and other supporting information with their bid, so that a detailed analysis and determination can be made, by the Contract Manager that the product/service offered meets this ITB’s specifications and that other requirements of this ITB have been met. However, provided a bid meets the requirements for a definite, firm, unqualified, and unconditional offer, the Commission reserves the right to request supplemental information from the bidder after the bids have been opened to ensure that the products/services offered completely meet this ITB’s requirements. The requirement for such supplemental information will be at the reasonable discretion of the Commission and may include the requirement that a bidder will provide a sample product(s) so that the Commission can make a first-hand examination and determination.
A bidder's failure to provide this supplemental information or the product sample(s), within the time set by the Commission, will cause the Commission to consider the Contractor non-responsive and reject the Contractor’s bid.

Should the Commission, in its sole discretion, determine that any project materials or equipment stored on its property must be moved in response to an emergency, the Contractor shall hold harmless, indemnify, defend, and may be responsible for costs of any reasonably necessary actions taken by the Commission.
PERFORMANCE BOND
A Performance Bond shall be required from the Contractor by the Commission for this project. Prior to commencing any work, and within ten (10) days after issuance of a Purchase Order, the Contractor shall furnish a Performance Bond in the amount of one hundred percent (100%) of the total contract price to ensure full and complete performance of the contract to the attention of the Contract Manager. The bond must state on its front page: the name, principal business address, and phone number of the Contractor, the Surety, the Commission’s full name, the Purchase Order assigned to the project by the Commission, and a description of the property being improved with a general description of the project. Please note: A Notice to Proceed will not be issued until after the required bond has been received.
The Bond shall be issued from a reliable Surety Company acceptable to the Commission, licensed to do business in the State of Florida and signed by a Florida Licensed Resident Agent. Such a bond shall be accompanied by a duly authenticated power of attorney evidencing that the person executing the bonds on behalf of the Surety had the authority to do so on the date of the bond. The cost of the Performance Bond shall be borne by the Contractor.
In lieu of a Performance Bond, The Commission may prior approve an alternate form of security in the form of a Cashier’s check, Official bank check or Money order in the amount of the bond. The alternative form of security shall be for the same purpose and be subject to the same conditions as those applicable to the Performance Bond.
Work shall not begin before the Commission receives the Performance Bond. Failure to provide a Performance Bond may be grounds to find the Contractor in default, which could include cancellation of the contract, and/or the Contractor’s removal from the State’s approved Contractor list for future solicitations.

The Commission is not liable for any costs, fees, expenses or any other compensation whatsoever incurred or charged by the Contractor, other than the bid price paid for the work specifically described in the Scope of Work, which work is actually accomplished and invoiced by the Contractor subsequent to the Commission’s notice to proceed (or other notice to begin work). The Florida Fish and Wildlife Conservation Commission (FWC) is seeking competitive pricing for the procurement of prescribed burning services on 11,825 acres of fire-maintained conservation lands on the Big Bend Wildlife Management Area (BBWMA) located in Taylor and Dixie Counties within FWC's North Central Region. Fire-maintained natural communities on this property include mesic flatwoods (7.6%), restoration sandhill (0.6%), sandhill (1.3%), scrubby flatwoods (0.8%) and wet flatwoods (1.4%). Work performed under this contract is intended to supplement the FWC's in-house prescribed burning program. Therefore, continual coordination will be required on all aspects of burn planning, preparation, and implementation with the FWC Project Manager and the FWC Contract Manager.
Prescribed burning is used to maintain and restore native plant species’ composition and structure. The FWC’s goals are to increase biological diversity, enhance wildlife habitat, mimic natural processes, and reduce excessive fuel loads. These goals can be accomplished if management units are burned with appropriate intensity to produce desired results, including varying degrees of litter removal, understory consumption, and overstory kill. Some management units may contain medium-to-high fuel loads; therefore, high intensity fires may be necessary in select cases to achieve burn objectives on certain management units.
No minimum amount of work is guaranteed under this Contract. The FWC reserves the right to task services based on the bid prices received, budgetary concerns, and/or other factors of this nature.

The Contractor shall notify the FWC Project Manager at least one (1) day prior to each estimated burn date. FWC may limit, or prohibit, burn operations on any given day, based on fuel loads, smoke considerations, weather parameters, public use such as hunting seasons, or other factors.
2.13. An emphasis will be placed on growing season burns when applicable, but winter burns will be utilized in units that have higher fuel loading or that are overdue for burning. Burns shall not be put off until growing season if appropriate burn weather is available prior to March 15; the preference is for units to not slip out of fire return interval. Some units may have extensive duff build up around the base of old growth pines and the edges of swamps with cypress needle cast. Extra precautions may be required to minimize tree stress and/or mortality;
this shall include but not be limited to Keetch-Byram Drought Index (KBDI) requirements, low number of days since last rain, extra mop-up requirements, and/or other weather restrictions that may be required by the FWC
Project Manager.
2.14. Burning during the hunting season may be restricted and/or limited to certain burn units which will be determined by the FWC Project Manager. Primary hunting seasons at Big Bend WMA that may impact burning are from late-
September through December and again from mid-March to mid-April.
2.15. The Contractor shall be responsible for all costs and liability associated with burning activities such as any fire suppression costs, fines, or damages resulting from burns that escape the burn unit or resulting from smoke originating from a burn. The FWC shall not be held responsible for damage to the Contractor’s equipment, and the Contractor shall have, maintain, and provide proof of sufficient liability insurance.
2.16. Failure to conduct a burn during any 28-day period when weather conditions are consistent with approved prescriptions and current priority list on at least 5 days may result in an initial notification (via certified letter) to the Contractor that their performance is failing to adhere to the terms of this Contract. The Contract may be terminated with notification (via certified mail) to the Contractor indicating the continued failure to adhere to the terms of this Contract if an additional 14-day period occurs without burning operations on at least 3 days when weather conditions are consistent with approved prescriptions and current priority list.
2.17. It shall be the responsibility of the CPBM to remove any trash or debris associated with the project from the project area upon completion of each unit burned. The CPBM must obtain all permits, licenses, and insurance required for burn operations. They must assess the need for, and supply, all necessary equipment, labor, and materials to complete the job in accordance with the specifications contained herein. Gates must be open during firing operations to allow for safe escape, but must be closed, when applicable, upon declaring the fire out.
2.18. Any damage to existing state property (i.e., roads, culverts, low water crossings, fences, gates, signs, or natural resources) caused by the Contractor, and not within the scope of the project, will be the responsibility of the Contractor.
2.19. In the event historical or cultural artifacts are uncovered during site preparation or burning activities, the Contractor shall immediately halt activities within the area and notify the FWC Project Manager.
2.20. Protection of Faunal Species: The Contractor shall use every precaution necessary to prevent the disturbance, harassment, or death of wildlife encountered on state-managed lands. The willful killing of any animal species (i.e.
Ch. 287 Invitation to Bid – Revised 07.01.2026 FWC 26/27-32, Page 16 of 100 birds, mammals, snakes, etc.) while working on state lands will not be tolerated. Violations will void the Contract, and the Contractor may be subject to prosecution under appropriate wildlife laws. All known eagle nests will be marked on provided maps of each unit. Any units slated for prescribed fire may not be burned during active nesting.
3. PLANNING SPECIFICATIONS
3.1. No new additional firelines shall be constructed without prior written approval from the FWC Project Manager.
All non-natural fireline construction and fireline mechanical preparation work will be performed by FWC staff. The Contractor may touch up firelines and conduct additional mechanical fireline preparation work, as needed, with prior approval from the FWC Project Manager.
3.2. On the day of the burn, the CPBM shall inspect the perimeter of the burn unit for vehicles or other such signs that may be indicative of recreational users within the burn unit. If it is determined that individuals may be within the burn unit, then ignition shall not take place until it is verified that all individuals are out of the area.
3.3. A copy of the burn prescription and site map showing firelines, roads, natural features, safety zones, escape routes, and any other pertinent information shall be in the possession of the CPBM for the duration of the burn.
A copy of the site map shall be in the possession of each crew member for the duration of the burn.
3.4. Final burn prescriptions shall be prepared and supplied to the FWC Project Manager on the day of the burn, prior to ignition. The burn prescription shall include a fully completed standardized FWC burn prescription form that has been signed by the CPBM, simple smoke screen map, National Weather Service fire weather and spot-weather forecasts, and a map of burn unit(s) to be burned.
3.5. The CPBM shall certify that the current and forecasted weather conditions meet the approved parameter ranges (Attachment L) and that all necessary factors included in the approved burn prescriptions are met prior to ignition.
Exceptions to the parameter ranges can be made to help meet the goals and objectives for a unit with prior written approval from the FWC Project Manager in consultation with the FWC Regional Biologist. Spot weather forecasts for the nearest locations shall be obtained on the day of the burn.
3.6. Ignition techniques can include strip head, flanking, point source and flanking, backing fire, or a combination of techniques necessary for a particular burn depending on the burn objectives established by the FWC Project
Manager, time since last burn, vegetative structure, and fuel arrangement. The ignition techniques to be used will be outlined in the prescription.
3.7. Burn planning shall consider the probability of smoke and/or fog impacts on roadways and other smoke sensitive areas. All fires shall be conducted by a CPBM whose burn record will permit him/her to secure open burning authorizations from the FFS. All required personnel, equipment, firebreaks, and permits as established by statute and rule shall be in place by the CPBM prior to ignition.
3.8. The CPBM must remain on site until there is no more fire spread or potential for spread. The CPBM is responsible for checking on the fire on the days following the burn until the fire can be declared out.
