About this file

This Invitation to Bid (ITB) document is issued by the Florida Fish and Wildlife Conservation Commission for the supply and planting of emergent aquatic vegetation within Lake Buffum in Polk County, Florida. The project involves three plant species: Egyptian paspalidium (Paspalidium geminatum) supplied as 4-inch nursery-grown liners, giant bulrush (Schoenoplectus californicus) supplied bare-root from nursery-grown, private wild-collected, or relocated sources, and maidencane (Panicum hemitomon) supplied bare-root from similar sources. The Commission has allocated $15,000 for Egyptian paspalidium, $30,000 for giant bulrush, and $15,000 for maidencane, with each species potentially awarded separately to the responsive, responsible bidder submitting the highest total number of plants. The project must be completed by June 12, 2026, with anticipated planting occurring between April and May 2026. A non-mandatory site visit is available at Lake Buffum (2808 Doc Lindsey Road, Fort Meade). Sealed bids must be received by February 26, 2026, at 3:00 PM ET, with a public opening at the same time. The anticipated award date is March 2, 2026. Bidders must submit sealed bids to the Florida Fish and Wildlife Conservation Commission, Attn: Purchasing, 1875 Orange Ave E, Tallahassee, Florida 32311-6160. Questions must be submitted in writing by February 11, 2026, at 5:00 PM ET, with responses posted by February 17, 2026. The contract term is one year upon issuance of the Purchase Order.

Bid pricing must include all costs associated with supplying and planting, including plants, containers, workers, equipment, maintenance, fuel, and required safety devices. Contractors must be registered with MyFloridaMarketPlace and the Florida Division of Corporations (Sunbiz) prior to bid opening. Each species will be awarded based on the formula: allocation amount divided by price-per-plant equals the number of plants to be supplied and planted, with the highest number of plants determining the award winner. Contractors must supply a minimum of 95 percent of contracted plants by number and are responsible for obtaining all required permits, including FDACS nursery registration certificates and permits to collect non-prohibited aquatic plants. Payment is made only for plants successfully planted, determined jointly by the Contractor and Project Manager through daily reports. No partial payments are allowed unless requested by the Contract Manager, with the final invoice due within seven calendar days of project completion. Liquidated damages of $100 per calendar day are assessed for delays beyond the 30-calendar-day completion window unless delays result from circumstances beyond the Contractor's control. The estimated total budget for all three species is $60,000. Subcontracting is permitted, and a Subcontractor Minority Status Report must be submitted with each invoice. Contractors must maintain comprehensive insurance coverage, comply with E-Verify employment eligibility verification, and adhere to all Florida and federal laws, including provisions related to discriminatory vendor lists, forced labor prohibitions, and debarment requirements.

2.6. RELOCATED PLANT – a plant manually harvested from an existing stand (donor site) within a public water body and transported to another area of the same water body and planted; or transported to another public water body and planted.

3. PLANT SPECIES

3.1. Egyptian paspalidium - Kissimmee grass Paspalidium geminatum; Each 4” liner cell (minimum 3.5 inches X 3.5 inches container; 18-cell pack liner) will be considered one plant and shall consist of

Ch. 287 Invitation to Bid – Revised 3.12.2025 FWC 25/26-49, Page 13 of 67 three or more intact connected stems at least 30 inches in length with roots attached. All liners must have been potted and grown for at least three (3) months prior to installation.

3.2. Giant bulrush - Schoenoplectus californicus: A bare-root bulrush plant is described as a single intact

(not split or torn) rhizome at least one-and-one-half (1.5) inches in length with associated roots and at least one (1) live stem of a minimum height of 48 inches. If supplied bare-root bulrush material is such that it requires more than a 1.5-inch section of rhizome to get at least one stem, it shall still be considered one plant

3.3. Maidencane - Panicum hemitomon: A bare-root grass plant is defined as three or more intact connected stems at least 30 inches in length with roots attached

4. BID SPECIFICATIONS

4.1. This bid solicitation entails supplying (nursery-grown, public wild-collected and/or private wild-collected) and planting aquatic plants (Egyptian paspalidium, maidencane and giant bulrush) within the littoral zones of Lake Buffum. The work sites will be specified by the Project Manager.

The Project Manager will prioritize and determine the time and work allotted for each planting site.

Depending on environmental conditions, the Project Manager has sole discretion to pause planting activities to ensure that plants are planted in conducive conditions for success. If additional time is required for project completion due to planting delays or pauses beyond the Contractor’s control, the

Contractor may submit an extension request in writing (“Force Majeure” clause, “TERM”; p. 5)

4.2. Each plant species has been allocated a specific amount to fund supplying and planting of that species (see “PRICE SHEET”). The Contractor shall provide a price-per-plant for each species on which they intend to bid (Contractor is NOT required to bid on all species) and the number of plants to equal the funded amount (allocation amount divided by price-per-plant = number of plants to be supplied and planted; e.g., allocation amount = $30,000 and price-per-plant is $1.00, so number of plants = 30,000). Each species will be awarded to the responsive, responsible bidder that submits the highest “TOTAL NUMBER OF PLANTS” for that species (three separate awards to potentially three vendors). In the event additional funding becomes available or if a species is not procured, the awarded price-per-plant for any of the awarded species may be used to procure additional plants above the awarded number and original allocated funding amount.

4.3. The Contractor shall supply a minimum of 95% (by number) of each plant species and then subsequently listed in the Purchase Order, in accordance with the ITB specifications or the

Contractor may be found in default for that Project.

4.3.1 If the Contractor does not have sufficient plants to fill the Purchase Order, the

Contractor shall acquire the plants specified for the project from another source within a time frame that allows the Contractor to fulfill the obligations of the Purchase Order.

Any additional costs accrued through such actions shall be the sole financial responsibility of the Contractor.

4.3.2 If the Contractor is unable to acquire the plants specified for the project after meeting the “95% (by number)” minimum requirement, the Project Manager may allow, at their sole discretion, the substitution of other plant or tree species listed and bid-upon in this ITB to reallocate unspent funds for the lacking species and required to complete the Project at no additional cost to the Commission.

Ch. 287 Invitation to Bid – Revised 3.12.2025 FWC 25/26-49, Page 14 of 67

4.4. Bid pricing shall include all necessary items to perform work (plants, containers, workers, equipment, maintenance of equipment, fuel, etc.) and safety devices required by law.

4.5. The Contractor shall assume full legal and financial responsibility for permit violations resulting from the activities of their employees.

4.6. Purchase Orders and written Notice to Proceeds may be issued to entirely or partially complete the project for.

4.6.1 All, some, or none of the species listed within the project; and/or.

4.6.2 All, some, or none of the plants listed for one or more species within the project.

4.7. Upon receipt of a Purchase Order, the Project Manager will contact the Contractor to schedule the starting date for the project. For species grown-out in 4”-liners, two Notices to Proceed will be issued:

one for Propagation and one for Installation.

4.7.1 All work shall begin on the agreed-upon commencement date as listed on the written Notice to Proceed.

4.7.2 The commencement date for Installation, if using nursery-grown or private wild-collected plants, shall be defined as the first day the Contractor attempts planting at the recipient lake; OR

4.7.3 The commencement date for Installation, if using public wild-collected

(relocated) plants, shall be defined as the first day the Contractor attempts collection at the donor lake.

4.8. Work shall be performed during weekdays (Monday–Friday) during daylight hours (one-half hour after sunrise to one-half hour before sunset). Requests to work weekend days shall be made in writing by the Contractor. The Project Manager shall provide a response to the Contractor in writing to grant or reject requests.

4.9. The Project Manager/Contract Manager shall make a final inspection with the Contractor and determine work completeness before payment is authorized.

5. WORK EXPERIENCE

5.1. The Contractor shall have at least three (3) years of similar work experience as reflected in their

References.

5.2. The Project Manager reserves the right to inspect all equipment, privately-owned wild-collection sites, and nurseries proposed for use by the Contractor before the work shall be awarded.

5.3. All plants and trees proposed for installation under this bid must be available for inspection by the

Project Manager at least two (2) weeks prior to installation.

5.4. Copies of the Certificate of Nursery Registration or Certificate of Stock Dealer Registration (FDACS-

08004) and the Permit to Collect Non-Prohibited Aquatic Plants (FDACS-08450) for proposed private and public (relocation) wild-collection sites, including the written plan providing reasonable assurance to prevent the dissemination of noxious or prohibited plants (or exotic or prohibited

Ch. 287 Invitation to Bid – Revised 3.12.2025 FWC 25/26-49, Page 15 of 67 animals) from private wild-collection sites, shall be submitted as part of the Contractor’s bid package.

6. SUPPLYING AND PLANTING SPECIFICATIONS

6.1. Supplied plants shall be bare-root or liner-grown (according to specifications for each plant species).

All plants shall be handled so that the root and stem material remain viable. The Project Manager reserves the sole authority to refuse plants, at no cost to the Commission, considered to be contaminated or of poor quality.

6.1.1 Bare-root plants shall be rinsed to remove sediment, debris and/or non-target plant parts (leaves, stems, roots, propagules) and any other exotic species (plant or non-plant, e.g., exotic snails).

6.1.2 Liner-grown plants shall not contain non-target plant parts (leaves, stems, roots, propagules) and any other exotic species (plant or non-plant, e.g., exotic snails).

6.2. All supplied plants shall be grown within and obtained from a FDACS-registered nursery, a FDACS-permitted private wild collection site, or a public wild-collection site permitted by FDACS. Up to

25,000 giant bulrush plants may be collected from Lake Istokpoga (Highlands County) from a

Commission-specified site (Figure 2; no permit will be required if collection is conducted in presence of Commission staff). The Project Manager shall have the sole authority to reject any other private water body, wetland, or donor site therein, proposed by the Contractor as a donor site for plants.

6.3. For any species proposed to be grown-out as 4” liners which require collection of donor plants from a “sovereignty submerged” waterbody or wetland (public wild collection), the Contractor must obtain

FDACS-08450 permits for collection of those species and provide copies of those permits to the

Project Manager prior to receiving Notice to Proceed(s) for Propagation.

6.4. The Contractor must obtain the required permits (FDACS-08450) to harvest bulrush or maidencane from other public waterbodies prior to the project commencement (exception is Lake Istokpoga for bulrush under FWC supervision). The Contractor will submit the permits to the FWC Project manager prior to the purchase order issuance. NOTE: By having the Contractor obtain their own permits, the Contractor does not require FWC staff to be present during plant collection. Collection sites must still be approved by the Project Manager; this approval and the use of plants for FWC revegetation efforts must be noted in the applications to FDACS.

6.5. All harvested plants shall be installed within 48 hours of being collected.

6.6. All liner-grown plants shall be thoroughly irrigated by the Contractor no greater than 24 hours prior to arrival at the lake. If Contractor stockpiles plants at staging site, all plants at staging site shall be irrigated at no greater than 48-hour intervals.

6.7. Final determination of specific planting sites within Lake Buffum will be made prior and during the plantings in response to environmental conditions.

6.8. All Paspalidium, maidencane, and bulrush plants will be planted in planting configurations determined by the FWC Project Manager though the project.

Ch. 287 Invitation to Bid – Revised 3.12.2025 FWC 25/26-49, Page 16 of 67

6.9. All plants are to be planted within the substrate in up to three (3) feet of water depth so that the roots do not pop up.

6.10. In performing the scope of work, all safety on or off the job site shall be the sole responsibility of the

Contractor. The Contractor shall be solely responsible for initiating, maintaining, and supervising all safety precautions and programs regarding the work. The Contractor shall be responsible for protecting and safeguarding employees and the public relating to the work and job site.

6.11. Boat operators shall have Personal Floatation Devices for all workers and passengers on-board and shall follow all other safety requirements in accordance with state and federal law, including vessel

“maximum capacity” limits for personnel, equipment, and plant transport

7. PAYMENT SPECIFICATIONS

7.1. No partial payments will be allowed for this project unless otherwise requested by the Contract

Manager. Final payment will only be made if the quality of work is approved by the Project

Manager/Contract Manager. The final invoice must be received no later than seven calendar days following project completion as approved by the Project Manager/Contract Manager and prior to

June 12, 2026.

7.2. The Contractor will be paid for the number of supplied plants meeting bid specification requirements that are successfully planted. The Contractor and Project Manager/Contract Manager shall agree in writing on the number of plants successfully planted at the end of each planting day in accordance with the Contract Management Daily Report / Aquatic Revegetation (EXHIBIT 1). The Contractor shall submit one (1) invoice, unless otherwise requested by the Contract Manager. The invoices shall be representative of the total number of plants per species successfully planted over all planting days, or for those planting days requested by the Contract Manager at the time of invoice request.
