About this file
This is Addendum No. 1 to the Invitation to Bid (ITB) issued by the Florida Fish and Wildlife Conservation Commission (FWC) for aquatic fence construction, refencing, and removal services. The addendum provides clarifications to the original solicitation FWC 25/26-67 through a comprehensive questions and answers section addressing bidder inquiries. The project encompasses three distinct services—fence construction, refencing (removal and reinstallation), and fence removal—measured in increments of 1,300 linear feet per service. Approximately 90 percent of work will occur in Lake George, with the remaining work potentially distributed across other sections of the St. Johns River system. The sealed bid submission deadline is 3:30 PM ET on Monday, March 2, 2026, at the FWC Purchasing Office in Tallahassee, with anticipated award on March 5, 2026. The contract term extends for two years from purchase order issuance, with work anticipated to commence in Fall 2026 or Spring 2027, though the FWC reserves the right to issue work earlier or later based on project needs and environmental conditions.
Work shall be performed on an intermittent, as-needed basis with most activities occurring between February and June, with compensation calculated by multiplying completed linear feet by the quoted unit price per linear foot. The FWC will issue purchase orders and conduct daily GPS documentation of completed work. Contractors must maintain a production standard of 1,300 linear feet per day or 6,500 linear feet per week, with liquidated damages of $100 assessed for each day the minimum is not achieved; mobilization and demobilization days are exempt from production requirements. Partial invoices may be submitted every two weeks during active work. The FWC Project Manager will waive financial consequences for delays beyond the contractor's control as defined in the Force Majeure provisions. No specific budget has been established, and bonding is not required. The FWC expects contractors to maintain reasonable, adequate, and appropriate insurance coverage for maritime activities in navigable waters, with contractors responsible for determining suitable coverage. Contractors must mobilize within 14 days of purchase order issuance or face potential contract termination, with work resuming to the next lowest bidder if the selected contractor cannot fulfill obligations.

BEGIN ADDENDUM
QUESTION #1
Are you able to send a map of the fence locations?
ANSWER #1
Two separate documents will be attached to this ITB advertisement with Lake George’s fence numbers and locations. Please note these numbers were created at time of solicitation and may change. Please see the documents in the attachments.
QUESTION #2
According to the Bid documents, the Anticipated Date of Intended Award is March 5, 2026; how soon after March 5, 2026 is it expected for the first purchase order to be issued?
ANSWER #2
The Commission will issue the first purchase order when work is needed; however, it is unknown at this time when the first purchase order will be issued. The Commission anticipates work may be needed in Fall 2026 or Spring 2027 but reserves the right to issue work before or after this timeframe depending on project needs.
QUESTION #3
Will the purchase orders be issued in a continuous manner? In other words, will the contractor be able to work on a continuous basis once project begins?
ANSWER #3
The Commission anticipates work to be intermittent, as needed, based on environmental conditions, project needs and project budgets.
QUESTION #4
How much is the yearly budget for this contract?
ANSWER #4
No yearly budget has been definitively set. Budget for this project will depend on project needs and based on environmental conditions and existing project budgets.
QUESTION #5
What months of the year will the scope of work be performed by the successful contractor?
ANSWER #5
The Commission anticipates most work will occur during the months of February to June; however, timing of work may vary based on project needs and environmental conditions.
FWC SOLICITATION ADDENDUM 3
QUESTION #6
Are the fence locations for this project all located in Lake George? Are the fence locations all existing? Or will new fence locations be a part of the project?
ANSWER #6
Lake George is the primary lake where work will occur. Per the solicitation document, the Commission estimates approximately 90% of work completed under this solicitation will occur in Lake George. Most of the fence locations are existing; however, the Commission reserves the right to add new locations to Lake George and other parts of the St. Johns River.
QUESTION #7
Lake George is considered a navigable waterway as part of the St. Johns River. Because installation of the aquatic fence will require crews to work from vessels and in navigable waters, please clarify whether USL&H and/or Jones Act insurance coverage is required under this contract. Standard workers’ compensation policies may exclude maritime exposure, so confirmation of required coverage would be appreciated.
ANSWER #7
Refer to Section 4. Liability, beginning on page 33. The awarded contractor is expected to have reasonable, adequate and appropriate insurance for the activities required under this bid. The awarded contractor determines what is appropriate coverage for their employees and equipment.
This project requires the use of vessels as means of transportation to and from the work sites.
Fencing, refencing, and removal are in-water activities, which will occur in depths of 3.5 feet or less and on firm substrate.
QUESTION #8
Please clarify how the awarded contractor will be paid. It appears that a unit of payment is 1,300 LF. Is that fence removed, installed, or repaired?
ANSWER #8
Bids under this solicitation are based on increments of 1,300 linear feet for each of the three services (fence construction, refencing, fence removal). Vendors will be paid based on their quoted price for each service. For purposes of payment, the bid price for each service will be divided by 1,300 to determine the price per linear foot. Linear feet of work successfully completed will be multiplied by the price per linear foot calculated to determine the payment amount.
QUESTION #9
Is there any required environmental monitoring? If so, does it need to be 3rd party?
FWC SOLICITATION ADDENDUM 4
ANSWER #9
No required environmental monitoring is included in this solicitation. The FWC Project Manager will provide any necessary environmental monitoring.
QUESTION #10
How often can invoices be submitted? What is the billing period?
ANSWER #10
Per the solicitation, partial invoices may be submitted every two weeks during active work.
QUESTION #11
Please confirm how production will be documented. Will the Commission record with GPS at the end of each day?
ANSWER #11
The FWC Project Manager will use a GPS daily to document work completed.
QUESTION #12
How are the liquidated damages of $100/day for days when the base unit of 1,300 LF is not installed determined? Is it based truly on each day or a blended daily average at the end of each billing period?
ANSWER #12
Liquidated damages will occur if the production standard is not met. The production standard is 1,300 linear feet of fence construction, refencing or fence removal per day, or 6,500 linear feet per week.
QUESTION #13
Are the $100/day liquidated damages compounding or only for the day when 1,300 LF is not achieved?
ANSWER #13
Liquidated damages will occur each day 1,300 linear feet, or 6,500 linear feet per week, is not achieved.
QUESTION #14
Is a base unit of 1,300 for a new fence considered the same as a base unit for removing and reinstalling the fence? In other words, are we expected to remove and reinstall 1,300 LF of fence in one day just as we are expected to install 1,300 LF of new fence?
ANSWER #14
Yes. For Service 2. Refencing, the awarded Contractor will be expected to remove AND reinstall 1,300 linear feet of fence in one day.
FWC SOLICITATION ADDENDUM 5
QUESTION #15
How are we expected to install 1,300 LF of fence each day? That is 200 t-posts. If a crew works an 8-hour day, that’s a post every 2.4 minutes for 8 hours straight, and that’s not including rolling out the mesh and the 1,400 zip ties.
ANSWER #15
The production standard for each service has been achieved previously by crews consisting of 4-5 people. The awarded Contractor is expected to supply the crew sufficient to meet this production standard.
QUESTION #16
Section 3.13.1 states the Commission will waive financial consequences if the “delay is due to circumstances beyond the contractor's control”. Please identify what is considered outside the contractor's control and the method by which that will be determined.
ANSWER #16
Please refer to J. Force Majeure located on page 51 of the solicitation.
QUESTION #17
Is bonding required?
ANSWER #17
No, bonding will not be required for this project. Failure to comply with any or all contract specifications may result in the Contractor’s immediate termination and final payment shall be only for work completed and approved by the FWC Project Manager.
QUESTION #18
What consequences does the contractor face if they decide to terminate the contract before all purchase orders are issued?
ANSWER #18
If the Contractor no longer agrees to fulfill current or future purchase order contracts, the Commission reserves the right to award all future work to the next lowest bidder or reissue a bid request. Failure to comply with contract specifications may result in the Contractor’s immediate termination and final payment shall be only for work completed and approved by the FWC Project Manager.
QUESTION #19
What consequences does the contractor face if they do not mobilize within the 14-day window?
FWC SOLICITATION ADDENDUM 6
ANSWER #19
If the Contractor does not mobilize within the 14-day window, as agreed to on the purchase order and/or issued notice to proceed, the FWC Contract Manager may choose to issue an extension in writing, or the Commission may terminate the contract and move to the next lowest bidder.
QUESTION #20
Will mobilization and demobilization days be considered days that require 1,300 LF production?
ANSWER #20
No.
QUESTION #21
What was the unit price for the last contract awarded for Aquatic Fence?
ANSWER #21
Please refer to the price sheet from FWC 22/23-57. The awarded for 80,000 linear feet was added from 40,000 linear feet for the initial term and 40,000 linear feet for the renewal term. The bid price sheet can be accessed from MFMP Vendor Information Portal.
QUESTION #22
As marine contractors we are required to carry Longshoreman Insurance, USL&H, as State Workers Comp does not cover work on navigable waterways. Will this contract require USL&H and/or Maritime Employers Liability Insurance?
ANSWER #22
Refer to Section 4. Liability, beginning on page 33. The awarded contractor is expected to have reasonable, adequate and appropriate insurance for the activities required under this bid. The awarded contractor determines what is appropriate coverage for their employees and equipment.
QUESTION #23
Would you please provide the bid price sheet for the previously awarded contract for ITB # FWC 22/23-57, Lake George Fencing Project?
ANSWER #23
Similar to question #21, please refer to the price sheet from FWC 22/23-57. The awarded for 80,000 linear feet was added from 40,000 linear feet for the initial term and 40,000 linear feet for the renewal term. The bid price sheet can be accessed from MFMP Vendor Information Portal.
