SUPPORTING/SUPPLEMENTAL INFORMATION

The Commission requires that bidders submit all required technical, specification, and other supporting information with their bid, so that a detailed analysis and determination can be made, by the Contract

A bidder's failure to provide this supplemental information or the product sample(s), within the time set by the Commission, will cause the Commission to consider the Contractor non-responsive and reject the

Contractor’s bid.

SCOPE OF WORK

FWC FY-23/24-94

INDIAN PRAIRIE CANAL BERM PLANTING

PURPOSE

The purpose of this project is to plant native trees and shrubs on the berm of the Indian Prairie Canal (IPC) on Lake Okeechobee (Figure 1) in the spring of 2024. This planting project will establish native habitat on the berm following the 2023 removal of invasive Brazilian Pepper trees. Therefore, the Florida Fish &

Wildlife Conservation Commission (FWC) seeks to procure plants and planting services. The exact location along the berm and the required plant species will be decided prior to the planting event. Bidders shall provide their bid based on the cost of supplying and planting 100 native plants (defined as a “planting unit”) from each planting Group in accordance with the attached specifications. The bid for the Project will be awarded to the overall lowest total bid price per “planting unit”. Partial “planting units” per Group may be purchased. The Contract Manager reserves the right to adjust the size of the planting project based on budgetary constraints and bids received.

1. REPORTS AND REQUIREMENTS

1.1. The Contractor shall provide all native trees and shrubs (referred to as “plants” unless otherwise specified) in quantities and container sizes as specified in “Planting Procedures” (in Section 2 below).

1.2. The Contract Manager reserves the right to inspect all equipment and nurseries proposed for use by the Contractor before the work begins. Copies of the Certificate of Nursery Certification (DACS-

08004) shall be made available upon request by the Contract Manager.

1.3. All plants shall arrive at the planting site in appropriate size containers. Plants will be inspected by the Contract Manager upon delivery to the staging site. Trees not conforming to FDACS standards, or trees that appear in poor condition (i.e. root bound, water stressed, presence of exotic or prohibited species), as solely determined by the Contract Manager, will be refused for planting.

1.4. The Contractor’s planting operation shall be coordinated and conducted under the direct daily supervision of designated Florida Fish and Wildlife Conservation Commission (FWC or Commission) personnel.

1.5. All work shall commence as specified in the purchase order contract upon receipt of a written notice to proceed (NTP) from the Contract Manager. Upon receipt of the first NTP (in this instance, a Notice to Proceed for Preparation) and a purchase order contract, the Contractor shall initiate project preparation (procurement of supplies and plants, potting and propagation of plants per specifications, etc.), unless otherwise specified in writing by the Contract Manager. The Contract

Manager will contact the Contractor to schedule the actual starting date. A second NTP (in this instance, a Notice to Proceed for Installation) will be issued for work to commence. Seven (7) calendar days from the work initiation date (as indicated on the second NTP) work will begin at the site, unless otherwise specified in writing by the Contract Manager. Work will not start any earlier than

April 15, 2024, and be completed no later than May 30, 2024, with preference for an April start date.

1.6. All work shall be completed within fourteen (14) calendar days of the work commencement date, unless otherwise specified in writing by the Contract Manager or specified in the purchase order contract and NTP. Work may be performed any day of the week during daylight hours (sunrise to

Ch. 287 Invitation to Bid – Revised 2.15.2024 FWC FY-23/24-94, Page 11 of 57 sunset). The Contract Manager shall make a final inspection with the Contractor upon project completion. Once work begins, work shall proceed until the project is completed without delay. The

Contract Manager may delay or cancel the planting if circumstances occur that may inhibit success.

If circumstances constituting Force Majeure occur, or if anything occurs beyond the Contractor’s control, the Contractor may request in writing an extension of the work commencement or completion date. The Contract Manager, upon review of the extension request, will determine and approve if an extension will be granted. Any extensions granted or rejected by the Contract Manager shall be provided in writing to the Contractor.

1.7. The invoice must be received no later than 14 calendar days following project completion and must be received no later than June 7th, 2024, whichever date is earlier. The Contract Manager shall make a final inspection with the Contractor upon project completion. The Contract Manager shall determine work completeness before payment is authorized.

1.8. The Contractor shall provide a price based on the cost of supplying, transporting to the IPC berm, staging site, planting, staking, and watering (i.e., “planting”) plants in accordance with the attached specifications. The Contract will be awarded to the overall lowest total price (Total Bid Price).

1.9. The Contractor will be required to procure a Right of Way (ROW) permit from the South Florida

Water Management District before planting begins (https://www.sfwmd.gov/doing-business-with-us/permits/right-of-way). There is a permit processing fee, and any damage to the berm, outside of where the trees are planted, must be repaired by the Contractor.

2. PLANTING PROCEDURES

2.1. All plants shall be container grown. Plant size and condition of trees shall be Florida No. 2 or better

(if applicable) as referenced and specified in Florida Department of Agriculture and Consumer

Services (FDACS), Division of Plant Industry, Florida Grades and Standards. Plant size and shape shall be that typically associated with a native tree or shrub grown in 7-gallon or 15-gallon containers (http://www.freshfromflorida.com/Divisions-Offices/Plant-Industry/Business-

Services/Florida-Grades-and-Standards-for-Nursery-Plants-2015).

2.2. Only native species listed shall be supplied and planted. Species and number of plants will be determined by the Contract Manager (and verified with the Contractor).

2.3. For each plant Group (A-C), the Contract Manager shall choose which species and how many units

(quantities) from each Group to be provided and installed. The exact number of planting units of each species from each Group, shall be requested and confirmed with the Contractor before initiation of the planting project and prior to the issuance of a Purchase Order. The Contractor shall NOT be required to provide every species within each Group, but a single plant species shall not represent more than twenty-five (25%) of the total plants in Group A, B, and C. The Contract Manager will choose which plants will be needed at the time. If any plants are unavailable in a Group for a planting event, the Contractor may request replacement of that species for another within the same

Once a Purchase Order is issued, the Contractor shall supply a minimum of 90% (by number) of the plant species specified in accordance with the specifications or the Contractor may be found in default for that project. If the Contractor does not have sufficient plants to fulfill and complete the

Purchase Order, with permission from the Contract Manager, the Contractor may obtain substitutes from within the group within a time frame that allows the Contractor to fulfill the obligations of the

2.4. The native tree planting project will be conducted in the northwest marsh of Lake Okeechobee on a

3-mile berm that flanks the eastern edge of Indian Prairie Canal (Figure 1). The berm was created during the construction and dredging of the canal, and it has a solid 2-track dirt “road on top that may get muddy or slippery when wet (Figure 2.1). The berm has some ground cover (mainly grasses) and small trees and shrubs from natural recruitment. The planting substrate is composed of organic sediments, composted vegetation detritus, and sand. Brazilian Pepper was mulched along a 1.5-mile section of the berm in spring 2023 leaving behind a thick layer of mulch in some areas. This, along with the paragrass growing along the berm (Figure 2.2), may make planting with a shovel difficult;

an auger may prove more effective. The berm has a very steep slope, so care needs to be taken when selecting equipment.

2.5. The Contractor shall be responsible for the transport of plants and crews to the Staging Area and to the Planting Area. The staging area is located at the beginning of the berm, which is approximately 200 yards from the beginning of the Planting Area (Figure 1). The Contractor may stage plants along the length of the berm before planting. For a ground-level view of the berm and canal, please refer to Figure 2.

Directions to Indian Prairie Canal Berm (from Okeechobee city): From the intersection of SR 70

(Park Avenue) and Hwy 441 (Parrott Avenue), take Hwy 441 south for 3.1 miles to SR 78. Turn right on SR 78 and travel west for 13 miles. Access to the berm will be before you cross the bridge on the southeast side of the canal. A gate blocks the path to the berm, and only authorized vehicles are allowed on the berm; FWC staff will provide access to from the Hwy to the staging area.

2.6. The specific placement, spacing, and site pattern of each tree will be determined by the Contract

Manager.

2.7. All 7 and 15-gallon trees shall be stabilized (with flexibility) using one bamboo stake (minimum 8’

X 1”) anchored through the root ball and secured to the tree with an acceptable heavy-duty tree staking material (e.g., wide canvas strapping or thick flagging).

2.8. All plants shall be thoroughly irrigated by the Contractor no greater than 24 hours prior to arrival at the Staging Area. If the Contractor stockpiles plants at the Staging area, all plants at the

Staging Area shall be irrigated at no greater than 48-hour intervals (water may be pumped from the lake or canal adjacent to the staging area).

2.9. All plants WILL need irrigation once planted. Water may be accessed from the edge of the berm. A long hose and a water pump will be needed. Water may be silty/muddy, so a basket or something similar may be helpful to keep the intake clean.

Ch. 287 Invitation to Bid – Revised 2.15.2024 FWC FY-23/24-94, Page 14 of 57

2.10. Plants must be free of any spreading diseases or parasites. Plant containers must be free of noxious plant material, specifically any plant species listed by FLEPPC as a Category I or II invasive, and exotic wildlife species (e.g., non-native Pomacea snails).

2.11. FWC will provide water absorbent granular co-polymer and fertilizer for vegetation that are planted dry to aid in maintaining moisture presence and to assist in the initial establishment and acclimation period. The Contractor shall add the provided co-polymer and/or fertilizer to each plant at the rates determined by the Contract Manager. Planting holes shall be excavated such that the water absorbent co-polymer and fertilizer can be placed along the periphery of the plant root ball after the containerized plant has been placed in the planting hole. Water absorbent granular co-polymer shall not be placed under the plant root ball, because hydration and expansion would lift the plant from the excavated planting hole. Co-polymer is not needed if the hole is already wet from groundwater.

2.12. All excavated planting holes shall be of a depth such that a slight depression will remain after the containerized plant is placed in the planting hole and backfilled with soil. The depression will create a slight catchment basin for capture and retention of rainfall during the plant establishment and acclimation period. During plant installation, a daily inspection will occur, and any plants not installed to these standards shall be re-planted. Areas around installed plants must be raked flat to prevent piles of soil.

2.13. No items (e.g., equipment, trash, plant containers, etc.) are to be left on the planting site or staging area after the completion of the project.

2.14. Location reference coordinates:

Indian Prairie Gate: 27°04'00"N 80°58'40"W (27.066592, -80.977882)

Staging Area: 27°03'42"N 80°58'17"W

3. SAFETY

3.1. The presence of any hazardous materials shall be brought to the attention of the Contract Manager immediately. The Contractor shall be responsible for all costs including damages, clean up, and decontamination should a hazardous spill occur. The Commission’s decision is final. The

Contractor shall be responsible for the cleanup of ALL spills, including fuel, oils, lubricants, chemicals, and hazardous waste, regardless of the quantity/size. The Contractor shall always have a hazardous spill kit on-site. The Contract Manager may inspect the Contractor for these items at any time during the project. Equipment refueling shall take place outside the wetland areas. All fuel must be in a portable spill containment device, such as a tub or tote.

3.2. No equipment shall be operated in a manner that significantly damages the natural resources in these areas or the road on top of the berm. The Contractor shall be responsible for and repair/replace, to the satisfaction of the Contract Manager and the ROW permit, all Contractor-induced damage.

3.3. In performing the scope of work, all safety on or off the job site shall be the sole responsibility of the

Contractor. The Contractor shall be solely responsible for initiating, maintaining, and supervising all safety precautions and programs in connection with the work. The Contractor shall be responsible for protecting and safeguarding employees and the public in connection with the work and job site.

The Contract Manager shall not be responsible for safety on or off the job site.
