DEPARTMENT OF THE NAVY

NAVAL AIR WARFARE CENTER TRAINING SYSTEMS

DIVISION

12211 SCIENCE DRIVE

ORLANDO, FLORIDA 32826-3224

J&A NUMBER: 23-0109

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity

Naval Air Warfare Center Training Systems Division (NAWCTSD) Orlando, FL

2. Description of Action Being Approved

This Justification and Approval (J&A) authorizes and approves a contract modification, on a sole source basis, to increase the ceiling of the existing Firefighter Training Structures and Props (FTSP) Indefinite Delivery Indefinite Quantity Contract (IDIQ) with Kirila Fire Training JV, LLC, (Kirila) 5712 Dot Com Court, Oviedo Florida 32765.

3. Description of Supplies/Services

FTSP supports 15 different Commander, Navy Installation Command (CNIC), Marine Corps Installations (MCI) and Center for Naval Technical Training (CNATT) training devices. Specific requirements of this effort include providing training for the general maintenance and telephonic support requirements for the support of liquefied petroleum gas (LPG) fueled training devices, fielded worldwide. It also requires operator training for Mobile Aircraft Fire Training Device (MAFTD) site personnel and the administrative requirements for this effort. Repairs requiring an actual site visit are usually identified during a telephonic support incident. This FTSP Support includes a continuation of managing maintenance, repairs, and training for the operator certification or recertification of training devices. The services acquired under this contract provide training to the fleet and school houses in fighting a fire in buildings, aircraft, shipboard, and subsurface. This includes initial training that is required before a unit can deploy or the follow on training required for semi-annual certifications instructors are required to complete. This training has a direct impact on the safety and welfare of the fleet and a direct impact on fleet readiness by providing sailors who are qualified in state of the art firefighting tactics, technologies, fire combat systems and equipment.

In order to meet fleet requirements, and to avoid an unacceptable delay to the Government, NAWCTSD intends to increase the FTSP IDIQ contract ceiling under the FTSP ID/IQ contract number N6134019D0002 by approximately $1.25 million. This action only increases the ceiling amount, which included the possible exercise of FAR 52.217-8 at its inception, but does not extend the FTSP IDIQ ordering period or scope. The FTSP ceiling increase will allow the Government to continue to conduct Mobile Aircraft Firefighting Training Devices (MAFTD) equipment sustainment in 52 Continental United States (CONUS) and Outside the Continental United States (OCONUS) locations, through its competitively awarded ordering period.

Estimated Dollar Value in Millions

FY23 FY24 Total

O&MN $0.834 $0.417 $1.251

Total $0.834 $0.417 $1.251 Note: This estimated value includes the Option to Extend Services available to the Government under FAR 52.217-8.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 3204(a)(1), as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

The current FTSP IDIQ contract, N6134019D0002, was competitively awarded to Kirila in December 2018. The competitively awarded IDIQ contains an ordering period through 30 November 2023. Due to two primary factors, the estimated ceiling of the FTSP IDIQ is insufficient to meet the remaining requirements of the ordering period. First, the scope demands of the FTSP were greater than anticipated. For instance, necessary, increased Service Life Extension Program (SLEP) work was performed. Second, inflationary impacts on cost, allocable to a cost reimbursable contract, have accelerated the IDIQ’s ceiling usage. For instance, the contractor must travel to the locations to provide the services. Increased travel costs have significantly impacted the estimated ceiling’s sufficiency.

The FTSP IDIQ is the only contract vehicle in place to perform these services through its ordering period. There is no delay in the government’s schedule to establish a follow-on competitively awarded contract for these requirements. As Kirila is the current contractor of the FTSP IDIQ, it is the only contractor with the requisite knowledge and trained qualified personnel currently available that can meet the Government’s requirement, and will remain so until the government awards the follow-on contract. Without a ceiling increase, the government will not be able to order the remaining in-scope requirements of the FTSP IDIQ, within the FTSP IDIQ ordering period, thus having a direct impact on the safety and welfare of the fleet, and its readiness, by not providing sailors who are qualified in state of the art firefighting tactics, technologies, fire combat systems and equipment. Therefore, without the ceiling increase, the government would incur an unacceptable schedule delay.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Per PGI 206.302-1, the Government published a Sources Sought Notice for the FTSP additional support to the Sam.gov (www.sam.gov) website on 6 December 2022 with a closing date of 15 December 2022.

The intent of the notice was to seek information on the availability of another source to provide the services required without inducing an unacceptable delay to the Government. No responses were received.

In addition, in accordance with FAR 5.201, the Government posted a Synopsis for this effort Sam.gov website on 15 December 2022 with a closing date of 30 Dec 2022. The intent of this notice was to ensure that full consideration is given to all potential sources. No responses were received.

The lack of any response to these outreach efforts confirms the assertion that no source other than Kirila can support the FTSP program with qualified personnel without inducing an unacceptable delay.

No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Kirila to provide the required services.

7. Determination of Fair and Reasonable Cost

The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition The Government intends to competitively award a follow-on contract with an anticipated award date of 30 September 2023. There are no barriers to competition, or delays, pertaining to the follow-on contract.
