JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
(JEFO)
1. Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment Division, is the contracting activity.
2. The action submitted for approval is a JEFO for an acquisition under Philips Healthcare
Patient Monitoring and Capital Equipment Program (PMCE) contract SPE2D1-19-D-0014, valid through March 29, 2029.
3. The required items are hardware and software upgrades with installation to the existing
Philips patient monitoring system, Philips PIIC Classic version N.00.19, at the Evans Army Community Hospital, Ft. Carson, Colorado. The upgrade replaces the physical server, workstations, hardware peripherals, PIICiX software and updates the firmware for all of the patient monitors. Estimate value of the upgrade is
4. The authority waiving the competition requirements is FAR 16.505(b)(2)(i)(B), only one awardee is capable of providing the supplies required at the level of quality required because the supplies ordered are unique or highly specialized. Philips is the only PMCE contract holder that can provide the necessary hardware and software items compatible with the existing Philips patient monitoring equipment. Hardware and software upgrades from sources other than Philips will not be compatible with Philips’ existing hardware and software. The current existing system in place, which includes bedside monitors, can only accept OEM firmware which is proprietary to Philips.
Currently the Evans Army Community Hospital is using a Philips patient monitoring system, the Philips PIIC Classic version N.00.19. The proposed acquisition will upgrade the Philips PIIC Classic version N.00.19 to the Philips Intellivue Information Center iX. The Intellivue Information Center iX will serves as a mid-life software/server upgrade and will extend the current lifecycle of the equipment for another 4 years.
The upgrade to the Intellivue Information Center iX will bring the existing equipment up to current technology standards and is essential to Ft. Carson’s requirements.
5. The Philips Healthcare items required are available on the Philips Healthcare PMCE contract
SPE2D1-19-D-0014. The contract pricing has previously been determined fair and reasonable via comparison with commercial invoices. The Contracting Officer has determined that the subject procurement represents the best value to the Government and that the anticipated cost will be fair and reasonable.
6. Ongoing research with the PMCE team has shown that upgrades to software, hardware, and
RMF can only be performed by the OEM.

7. There are no additional facts supporting the use of this JEFO.
8. DLA continues to perform market research and add items to the PMCE program contracts in an effort to overcome barriers to competition. When the Philips system at Ft. Carson requires replacement, DLA anticipates the acquisition of a new system will be conducted on a full and open competition basis.
9. As the Contracting Officer, I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge and belief.
