JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION,
Limitation of Sources and Inclusion of Open Market Items in Federal Supply Schedule Task Order
The Public Buildings Service, Rocky Mountain Region, proposes to contract the requirements described herein by means of other than full and open competition. Contracting by such means is authorized by FAR Subpart 6.3 and is supported by this justification prepared in accordance FAR 8.405-6(a)(1)(C) and FAR 6.303-2.
1. Identification of the agency and the Contracting Activity: General Services Administration, Public Buildings Service, Rocky Mountain Region, Denver Federal Center Service Center. The Requiring Agency is the Department of State (DOS).
2. Nature and/or Description of Required Supplies or Services: This justification authorizes and approves the inclusion of Open Market items in the RCRA Facility Investigation of Investigation Area 04A at Denver Federal Center, Lakewood, Colorado, Federal Supply Schedule Contract Task Order
GS-10F-0105K/GS-P-13-JA-0058.
3. Description of the supplies or services required to meet the agency’s needs, including the estimated value:
A storm event on July 13, 2013 caused extensive flooding and damage in Building 56, Denver Federal Center, Lakewood, Colorado (DFC). The event caused roof drains to overcome the floor drains which backed up and flooded the building. The original building design was completed during the 1940s and connected the roof and floor drains to the storm sewer. EPA regulations and the DFC’s Federal Facilities Compliance Agreement do not allow roof drains to connect to the sanitary sewer or floor drains to connect to the storm sewer. This storm event indicated that many of the roof drains are still connected to the floor drains since the floor drains backed up or had water shooting out during the storm. If gray water was discharged into the building, significant health risks may be present.
Performing the specific study of the drains within Buildings 45 and 56 at the Denver Federal Center, Lakewood, Colorado will require that additional schedule items and open market items be included by modification to the original task order. The open market items are the subject of this Justification and are valued at $124,623.78.

4. Statutory Authority Permitting Other than Full and Open Competition: The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c)(1)(c) as cited in FAR 6.302-2, "Unusual and Compelling Urgency."
