About this file
This is a Sole Source Justification document from the U.S. Department of Transportation Maritime Administration for American Bureau of Shipping (ABS) inspection services under contract MAPR61525000028. The justification is for recurring regular, special, and annual ABS inspection and drawing review services for the TS Freedom Star vessel for fiscal year 2025.
The document outlines why ABS is the only viable source, citing that it is the only US-owned vessel classification society authorized by the US Coast Guard and IMO to issue Cargo Ship Safety Construction Certificates. ABS operates as a not-for-profit organization and is commissioned by the US government to maintain standards for marine vessel design, construction, and maintenance in accordance with SOLAS (Safety of Life at Sea) requirements. The justification is supported by 46 CFR § 70.35-1 and Executive Order 12234, which designate ABS's authority in these matters. The document is signed by Project Officer Timothy R. McGeein on November 8, 2024.

Memorandum U.S. Department of Transportation Maritime Administration
SOLE SOURCE JUSTIFICATION FOR AMERICAN BUREAU OF SHIPPING
1. The ABS Inspection service listed on MAPR61525000028 is available from only one source and competition is precluded for reasons indicated below.
2. This acquisition is restricted to the following source:
Source: American Bureau of Shipping (ABS) Address 16855 Northchase Drive, Houston, TX 77060
3. This acquisition is to provide for reoccurring regular, special and annual ABS inspection and drawing review of the TS Freedom Star in an estimated amount of $ for fiscal year 2025.
4. Specific characteristics of ABS Inspection Services that limit the availability to a sole source e.g., unique features, function of the item, etc. The elements below detail why only this suggested source can furnish the requirements to the exclusion of other sources:
o The International Maritime Organization (IMO) is a specialized agency of the United Nations with the responsibility to develop and maintain a comprehensive regulatory framework for worldwide shipping. Key treaties of the IMO include the International Convention for the Safety of Life at Sea (SOLAS).
o The main objective of SOLAS is to specify minimum standards for the construction, equipment and operation of ships, compatible with their safety. The US Coast Guard has been a key participant and the primary U.S. representative to the IMO for all policy development since the IMO Convention entered into force 50 years ago.
o ABS is a classification society with a mission to promote the security of life, property and the natural environment, primarily through the development and verification of standards for the design, construction and operational maintenance of marine-related facilities. ABS is the only US owned vessel classification society in this regard. ABS' core service is the provision of classification services through the development of standards called ABS Rules. These Rules form the basis for assessing the design and construction of new vessels and the integrity of existing vessels and marine structures.
o ABS has been commissioned by the US government and the US Coast Guard to act in many maritime matters and is required under US law to maintain its status as a not-for-profit organization to maintain its role as the agent of the US government on matters of government vessel classification.
o ABS designated as an organization duly authorized to issue the “Cargo Ship Safety Construction Certificate” to certain cargo ships on behalf of the United States of America as provided in Regulation 12, chapter I, of the International Convention for Safety of Life at Sea, 1974, and Executive Order 12234 and the certificate shall be subject to the requirements in this subpart. The American Bureau of Shipping is authorized to place the official seal of the United States of America on the certificate. This designation and delegation to the American Bureau of Shipping shall be in effect until terminated by proper authority and notice of cancellation is published in the Federal Register.
5. Check and fill in all that are applicable:
The material or service must be compatible in all aspects (form, fit, and function) with existing systems presently installed. Describe the equipment you have now and how the new item/service must coordinate, connect, or interface with the existing system:
A patent, copyright, or proprietary data limits competition. The proprietary data are described as follows:
These are “direct replacement” parts/components for existing equipment.
Other information to support a sole-source buy:
In accordance with Code of Federal Regulation (CFR) - 46 CFR § 70.35-1, ABS is authorized by this statue for an item, or method of construction, or testing is required to meet the standards established by the American Bureau of Shipping, the current standards in effect at the time of construction of the vessel, or otherwise as applicable, shall be used. The current standards of other recognized classification societies may also be accepted upon approval by the Commandant.
CERTIFICATION
I certify that statements checked and information provided above are complete and correct to the best of my knowledge. I understand that the processing of this Sole-Source Justification precludes the use of full and open competition.
