Request for Proposals (Federal)
General Architectural and Engineering Consultant (GEC) On-Call Design Services
RFP No. FQ19172
Date: April 5, 2019
WASHINGTON METROPOLITAN AREA TRANSIT AUTHORITY
GEC ON-CALL DESIGN SERVICES CONTRACT RFP No. FQ19172
Date: April 5, 2019
SUBJECT: Request for Proposal (RFP) No. FQ19172
Dear Sir/Madam:
The Washington Metropolitan Area Transit Authority (WMATA, known hereinafter as the Authority) requires the services of professional on-call multi-disciplinary general architectural and/or engineering consultants (“Consultant”) to provide services in support of the on-going capital improvement program and maintenance program, conduct special complex engineering/architectural studies, provide engineering and architectural support for recovery from urgent, emergent and emergency conditions, and provide design support for new capital rail construction, for bus system projects, for joint-development projects, for adjacent construction- related projects, for project and technology development projects, and for additional projects and services as required.
The selected Consultants shall assist the Authority by providing certain professional engineering, architectural and surveying services associated with new construction and the renovation, repair and maintenance of Authority facilities, assets and systems located in the District of Columbia, Maryland and Virginia. The Consultant shall assist the Authority by providing architectural and professional engineering services associated with Design, Staff Augmentation, and Engineering Support Services.
Architectural and Engineering The successful Consultants may provide architectural and engineering design, staff augmentation, and a full-range of engineering support services under the wide array of capital and maintenance program needs of the Authority through future competitively-solicited Task Order requests. For RFP No. FQ19172, WMATA has elected to review proposals and will award multiple on-call, contracts within four technical categories:
• Power
• Systems and Vehicles
• Facilities
• Rail, Yards, and Infrastructure An expanded definition of the design and support services included in each of these technical categories is provided in the Instructions and Scope of Work included within this RFP.
In addition, WMATA plans to award multiple Small Business Enterprise (SBE) Set-Aside contracts within each of these four categories. Further definitions and requirements to compete for the SBE contracts are provided in the Instructions and Scope of Work.
Engineering Support Services The successful Consultants may also be asked to provide other critical support functions to the engineering and construction programs through future competitively-solicited Task Order requests. These support functions may include, but are not limited to: document management, business process development and configuration, performance analysis, animation and graphics, drafting and development of engineering standards, Quality Control (QC) programs, and associated training in all the above as required.
While no Disadvantaged Business Enterprise (DBE) goals have been established for this RFP, Consultants are strongly encouraged to include a diverse team that includes DBE subconsultants, as DBE Participation will be part of the technical evaluation of proposals. DBE goals will be evaluated and may be established for each subsequent Task Order RFP to be released under all of these contracts. WMATA’s current authority-wide DBE goal is 22% and it is WMATA’s expectation that the overall cumulative work associated with each awarded contract will exceed the authority-wide DBE goal.
For the purpose of reviewing the key terms, conditions, and requirements of this RFP, a non-mandatory (attendance) Pre-Proposal meeting will be held in the Lobby Level Boardroom of the WMATA Jackson Graham Building, 600 5th Street, NW, Washington, DC 20001 on Thursday, April 18, 2019 at 1:00 p.m. EDT.
If you have any technical, contractual, or administrative questions, please e-mail them to Cindy D. Smith, Contract Administrator at GECDesign_procurement@wmata.com no later than 2:00 p.m. EDT, April 25, 2019. WMATA will provide written answers and post them on www.wmata.com (under Business; click on Procurement and Contracting; then click on WMATA Procurement Opportunities; then click on View WMATA Procurement Opportunities; then click on All Solicitations (except Simplified Acquisitions). Any Amendment(s) issued, resulting from questions and answers to this RFP, will be posted on the same website.
Your proposal must be received with all required submittals as stated in the RFP, no later than 2:00 p.m. EDT, May 23, 2019 at WMATA, Office of Procurement and Materials, 600 5th Street, NW, Room 3C-02, Washington, DC 20001-2651. GEC ON-CALL DESIGN SERVICES CONTRACT RFP: #FQ19172
REQUEST FOR PROPOSAL (RFP) SOLICITATION INSTRUCTIONS
1. INTRODUCTION
(a) The Washington Metropolitan Area Transit Authority (WMATA or ‘the Authority’) seeks to award contracts to general architectural and engineering consultants (“Consultants”) to provide engineering, procurement and construction support services in support of WMATA’s capital improvement and state of good repair programs. To that end, it is issuing this Request for Proposals (RFP) to solicit proposals from qualified firms, joint-ventures and/or individuals who can satisfy the requirements described herein.
(b) The work effort is composed of providing professional and technical consulting services with qualified engineers and architects. The services to be provided may include expertise in the full range of transit-oriented architectural, engineering and surveying disciplines and Work Categories as described in the Statement of Work.
Proposer’s will be evaluated in up to four (4) Technical Work Categories: Power; Systems and Vehicles; Facilities; and Rail, Yards and Infrastructure. Proposers may submit a proposal for one (1), multiple, or all four (4) Technical Work Categories. Proposers shall clearly state in their cover letter and proposal the specific Technical Work Categories for which they are submitting qualifications.
In addition, the Authority plans to award several Small Business Enterprise (SBE) Set-Aside contracts in each of the four Technical Categories. Only WMATA-certified SBEs are eligible to submit a proposal or be considered for the Set-Aside contracts. Future Task Order Requests for Proposals under the SBE Set-Aside program may involve architectural, design, engineering, or professional service staff augmentation services under one or more of the four (4) Technical Work Categories described above. Under any future SBE Set-Aside contracts, Task Order requests will be limited to an estimated value of $500,000 in professional services, or less. Firms submitting as Small Business Enterprise must clearly state in their cover letter and their proposal the specific Technical Work Categories for which they are submitting qualifications. In addition, WMATA requests firms submitting a proposal for any Set-Aside contracts to further disclose the technical discipline(s) or niche services (within the four Technical Categories) that the firm has the capabilities to perform. Firms submitting a proposal for consideration of a Set-Aside contract may submit a proposal for one (1), multiple, or all four (4) Technical Work Categories. Proposers shall clearly state in their cover letter and proposal the specific Technical Work Categories for which they are submitting qualifications. Tasks for technical services will be competed among the selected SBEs that demonstrate technical capabilities to perform that type of work within their proposal.
(c) The Authority contemplates multiple awards to Consultants deemed to be the best-qualified (or equivalently qualified) but may elect to award more or less contracts based on the number of best-qualified Consultants identified through the proposal evaluation process.
Future Task Order RFPs will be solicited from Consultants holding a master contract in the Technical Work Category that aligns with the Task Statement of Work (SOW), and will be competitively evaluated on technical merit first, then price considerations in accordance with the Brooks Act. The determination of the evaluation factors for future Task Order RFPs will be based on the respective SOW and the most relevant factors for determining the best-qualified Consultant. For future Task Order RFPs, the Authority will enter into price negotiations with only the top technically-ranked Consultant and attempt to reach fair and reasonable terms for Task Order award. If unable to reach fair and reasonable price and terms with the top technically-ranked Consultant, the Authority may terminate negotiations and begin negotiations with the Consultant determined to be the next best technically-qualified Consultant for that particular task. This process will continue until the Authority issues a Task Order award, however, the Authority retains exclusive rights to cancel the Task Order RFP at any time and may resolicit if deemed to be in the best interest of the Authority. The value of future individual Task Orders is anticipated to range from $10,000 to $15,000,000; however, the Authority may elect to issue Task Orders of a higher or lower value, with approval of the Contracting Officer to be in the best interest of the Authority. The estimated aggregate value for all future Task Orders to be awarded under this GEC On-Call Design Services procurement is $500,000,000. The Ordering Period establishes the time limits for the issuance of individual Task Orders and shall be five (5) years from the Notice of Award date. Performance of future Task Orders may extend no more than six (6) months beyond the contract expiration date, unless expressly authorized by the Authority’s Contracting Officer.
(d) In the event that any Consultant selected for the award of a contract under this RFP is unable or otherwise fails to provide services within the time frames required in a subsequently awarded Task Order or this Contract, the Authority reserves the right to procure the services from any other source and in any other manner it deems appropriate. Nothing contained, herein, shall be deemed to waive, modify, or impair the Authority’s right to treat such failure as a material breach of the Consultant’s obligations pursuant to the “Default” article under this Contract, or to pursue any other remedy to which the Authority may be entitled pursuant to this Contract, at law or in equity.
(e) To participate in this procurement, Proposer must satisfy the minimum qualifications required by this RFP. Where the Proposer is a joint-venture, the firm that holds a majority ownership interest in the Proposer (i.e., over 50% ownership) must meet the minimum requirements set forth in this RFP.
(f) If a Joint-Venture responds to this RFP, the Authority will not accept separate proposals from the Joint-Venture constituents (either jointly or separately) within the same Technical Work Category. A firm will not be permitted to submit as a prime on more than one (1) Joint-Venture within the same Technical Work Category.
(g) A firm that responds to this RFP as a prime or a prime Joint-Venture constituent may not be included as a subconsultant to another firm that responds as a prime within the same Technical Work Category. A firm that responds to this RFP as a prime or a prime joint-venture constituent may be included as a subconsultant to another firm that responds as a prime within a different Technical Work Category. The above does not preclude a firm from being set forth as a subconsultant to more than one (1) prime within any Technical Work Category. An SBE that is WMATA certified and that submits a proposal for a SBE Set-Aside award, may also be a subconsultant to a prime under any Technical Work Category.
(h) Only Architect or Engineering (A&E) Consultants may compete for this contract.
Consultants shall submit documentation that the Consultant is a certified professionally-registered architectural and/or engineering Consultant. Documentation can be the Consultant’s engineering or architecture registration number from a State Licensing Board if the state in which the Consultant is located has a Consultant registration requirement, or it can be resumes of the senior engineers/architects that are managing the Consultant showing that they are registered engineers or architects.
(i) Location of the Consultant in the general geographic area of anticipated WMATA Task Orders and projects, and knowledge of the locality of the WMATA projects area is required. Consultants shall demonstrate they have or will have office space within the geographic area and adequate staffing of the office space prior to a contract being awarded. Geographical area of the contract covers the area of 150-mile radius from WMATA headquarters (600 5th Street NW, Washington, DC, 20001). It is preferable that the Consultant has practical knowledge and experience performing A&E services in each of the Washington Metropolitan Area jurisdictions (Maryland, District of Columbia, and Virginia).
2. TECHNICAL WORK CATEGORIES
WMATA intends to award multiple On-Call, Task Order master contracts under four (4) Technical Work Categories and additional contracts under a Small Business Enterprise (SBE) Set-Aside initiative for each Technical Work Category. The four (4) Technical Work Categories are (see Scope of Work contained in this RFP for further detail):
• Power
• Systems and Vehicles
• Facilities
• Rail, Yards and Infrastructure
Consultants can propose on a single, multiple, or all Technical Work Categories, however, only WMATA-certified SBE’s will be eligible for award of a contract as a Small Business Enterprise Set-Aside. Consultants are encouraged to submit proposals only in Technical Work Categories where the Consultant and proposed staff have a high level of proven expertise and would be able to support a wide-array of potential future Architectural and/or Engineering Task Order requests and assignments within the Technical Work Category being proposed on.
For the SBE Set-Aside awards, only WMATA-certified SBE’s are eligible for submitting a proposal. To be considered for a Small Business Enterprise Set-Aside, the firms must be WMATA certified at the time proposals are submitted. The SBE Set-Aside awards will be established in each of the four technical categories for which selected SBEs are deemed to be the best, or equivalently, qualified to compete on future Task Order Requests that are estimated at $500,000 or less in total professional services value. As such, certified SBE’s wishing to submit a SBE Set-Aside proposal for consideration in a Technical Work Category should have the proven expertise, ability, staffing plan, and capacity to cover elements of work for the category for which they are proposing. In addition, WMATA requests firms submitting a proposal for any Set-Aside contracts to further disclose what technical discipline(s) or niche services (within the four Technical Categories) the firm has the capabilities to perform. Tasks for technical services will be competed among the selected SBEs that demonstrate technical capabilities to perform that type of work within their proposal.
Proposer’s must clearly indicate in their cover letter and in various sections of their Proposal, which Technical Work Categories that they are proposing on, and proposal elements should be submitted that correlate to the technical expertise of staff, the proposed team, and the management approach relating to each Technical Work Category being proposed on.
The Authority is not obligated to issue a specific number of master contracts or SBE Set-Aside contracts in any Technical Work Category but will evaluate all proposals objectively and independently to formulate a pool of Consultants that can competitively compete for and provide the Authority the best-qualified services and responsiveness to many future Task Orders that are envisioned in support of WMATA’s Capital Program. Only firms that are rated good or exceptional in any category will considered for selection in those categories.
3. COMMUNICATIONS WITH THE AUTHORITY
Prospective proposers are advised that any and all communications with the Authority relating to this solicitation and made by, or on behalf of, a prospective proposer at any time between release of this Request for Proposals and Contract award, shall be directed to the Authority’s Contract Administrator, Cindy D. Proposers shall acknowledge receipt of all amendments in their cover letter to be submitted with their proposal. The Authority plans to post all responses to questions, clarifications, and Amendments (if needed) at the following central site: www.wmata.com. Consultants are encouraged to regularly visit this site for updates pertaining to this solicitation.

The Authority does not assume responsibility for the accuracy of any such communication.
(d) The failure of a prospective proposer to request an explanation, take exception, or pose a written question shall serve to preclude it from claiming any ambiguity, inconsistency, or error that should have been discovered by a reasonably prudent proposer.

11. LATE SUBMISSIONS AND REVISIONS OF PROPOSALS

(c) Notwithstanding a determination by the Authority to proceed without conducting substantive negotiations or discussions with best-qualified Proposers, the Authority may engage in communications with the best-qualified Proposers relating to clarification(s) of their proposals.
(d) The Authority maintains the right to waive informalities and minor irregularities in proposals at any time during the solicitation process.
14. EVALUATION CRITERIA AND BASIS FOR AWARD
This is a qualifications-based competitive selection conducted in accordance with the Brooks Act. The Contracting Officer reserves the right to engage in oral or written communications with Proposers prior to a determination of the best-qualified Technical Proposals for the purposes of clarifications or questions on proposed information. The following Criteria will be the basis for selection of the best-qualified Consultant(s) within each Technical Work Category and for the SBE Set-Aside awards, and are listed in descending order of importance:
