JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
Naval Surface Warfare Center, Indian Head Division (NSWC IHD), Contracts Division Code 023.
2. Description of the Action Being Approved
Award of a Cost Plus Fixed Fee (CPFF) contract on a sole source basis for Catalog Order and Logistics Tracking System (COLTS), Item Unique Identification (IUID), Passive Radio Frequency Identification (pRFID) software and hardware, logistical maintenance, and COLTS software license maintenance to GVI, Inc., 5700 Thurston Avenue, Suite 212, Norfolk, Virginia 23455.
3. Description of Supplies/Services
NSWC IHD requires continuing support for its supply chain management system providing Total Asset Visibility (TAV) with the ability to read IUID labels via pRFID capability and functionality with financial transaction tracking tools; all interfacing with COLTS software and hardware. COLTS is a commercial application and NSWC IHD previously purchased COLTS software licenses. The Contractor will advise and assist with supply chain and inventory management software, hardware, and interfaces and COLTS software licenses.
NSWC IHD uses various software applications to track asset history, maintenance, IUID, and supply chain management functions. The COLTS, along with the pRFID and UID provides TAV for all Joint Service Program of Record assets.
The Unique Identification of serialized assets provides a link to COLTS and the pRFID system. All serialized items are tracked in COLTS and an IUID is provided to the Department of Defense (DoD) Unique Identifier (UID) Registry. Using this unique identifier, assets are tracked in our warehouses with a passive tag that indicates their individual location in the warehouse for TAV. Within COLTS there is a financial module which is used to track all repair funding actions, as well as upgrades and associated authorized accessories. This financial module is used to monitor funding on contract and is validated against invoices before they are approved for payment in Wide Area Workflow (WAWF). The use of all of these linked software applications provides the Joint Service with visibility into each asset from the time it is purchased and entered into COLTS, through the life-cycle of the asset to disposition at the end of its useful life.
The anticipated period of performance is one 12 month base period plus four (4) 12 month options periods for a total of five years. The total estimated cost of this procurement is $10,938,923.
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open
Competition
10 U.S.C. 2304(c)(1), as implemented by Federal Acquisition
Regulation (FAR) 6.302-1: Only One Responsible Source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority
This will be a follow on effort to Contract N00174-16-C— 0045, J&A 16-24666 as well as Contract N0017420P0221 for Software licenses.
COLTS, a commercial application, is a vital component of NSWC IHD’s logistics support effort consisting of supply chain management services and is tailored to support the Joint Service Explosive Ordnance Disposal (JSEOD) Business Model Process. NSWC IHD previously purchased licenses for the COLTS software. GVI is also the only source that can provide logistical support as well as the middleware and corresponding COLTS software maintenance.
GVI owns the rights to the middleware that connects COLTS to the pRFID and UID software applications which has already received Autority to Operate (ATO) to meet cybersecurity compliance requirements. The current ATO took over a year to obtain at a cost in excess of $1.5M to the Government. If access to COLTS were lost, NSWC IHD would no longer be able to track shipments or inventory, approve maintenance estimates for Original Equipment Manufacturer support and report JSEOD tool and equipment readiness. Failure to sustain this capability will degrade NSWC IHD’s ability to provide rapid response to warfighter needs. Additionally, GVI provides certified COLTS administrators who manage the daily maintenance, upkeep and availability of all three software applications. Without this, the JSEOD community would lose the TAV that is vital to supporting the warfighter on a daily basis. Annually, 145,000 asset events in support of the war fighter are performed in COLTS.
The absence of critical logistic operations, maintenance actions and maintenance support would result in delayed deliveries of highly specialized equipment (i.e. bomb suits/robots/explosive detection equipment) to EOD joint forces stationed around the world. Without this equipment, our Warfighters would not be able to control or mitigate dangerous and life-threatening situations thereby placing themselves in harm’s way, possibly resulting in loss of life.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
NSWC IHD Contracts Department published a Sources Sought notice #N00174-20-SN-0041 on 4 August 2020 to the beta.SAM website to satisfy the requirement of Defense Federal
Acquisition Regulation Supplement 206.302-1(d). No responses were received. No additional market research was conducted because it is not practicle, for the reasons discussed in paragraph 5 above, for any company other than GVI to provide the required services.
The Government also synopsized the proposed contract on7 April 2021 via the beta.SAM website. No companies expressed interest.
NSWC IHD is a license holder of COLTS and GVI owns the rights to the middleware that connects COLTS to the pRFID and UID software applications. Market research was performed and no other companies can provide the required hardware or software to provide the requisite logistical maintenance support.
7. Determination of Fair and Reasonable Costs
The Contracting Officer will determine that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable prior to contract award in accordance with FAR Part 15.4.
DCMA pricing assistance and/or DCAA audit of contractor’s proposal will be requested along with offeror’s certificate of current cost and pricing to support the fair and reasonable cost determination.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, NSWC IHD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWC IHD will assess whether competition for future requirements is feasible.
