A. Program Description Authority:
Fish and Wildlife Coordination Act-Cooperation of Agencies (16 U.S.C. §661)
Assistance Listing Number:
15.664 Background, Purpose and Program Requirements:
Introduction
The U.S. Fish and Wildlife Service (Service) is seeking a qualified Entity (Entity) to assess, design, and implement an aquatic habitat restoration project in the side channel along Cotton Island (river km 117; 38.2285, -92.5531) within the Osage River, in central Missouri. This side channel is ~1.9km in length and could potentially create 37 acres of aquatic habitat. This effort is part of a larger program called the Lower Osage River Protection and Enhancement Program (LORPEP). This program is administered by the Service, the Missouri Department of Conservation (MDC), and Ameren Missouri (collectively “Partners”) to improve aquatic habitat, protect and enhance aquatic resources, and benefit federally endangered species as required by the 2007 Federal Energy Regulatory Commission (FERC) operating license for the Osage Project (Bagnell Dam). The Service and MDC have identified and prioritized specific aquatic habitat restoration project opportunities within the lower Osage River and additional opportunities in the future. For the current potential project, the Service is seeking an Entity that can provide the technical resources necessary to assess, design and implement the project within the total amount of funding available (see “II. Award Information” for details). The Entity selected will work closely with the Partners on all phases of the work described herein. This project will require modifying riverbed features and manmade structures to enhance flow conditions to and within the Cotton Island side channel. This project may also involve the removal of depositional material (e.g., gravel) at the upstream end of the side channel and/or construction of hydraulic control structures. This project may require complex hydraulic modeling needed for natural channel design or similar function-based approaches to facilitate habitat development and control bank erosion. The side channel also has a crossing or “access road” connecting to the island that will need improved to accommodate flow augmentation and for landowner access to the island.
Project Assessment
The selected Entity will:
Visit the location and provide an initial assessment of the viability, feasibility, general cost and ecological benefit(s) of the project, if this information is not already known.
Also need to complete geomorphic and hydraulic assessments and/or soil investigation to provide an indication of long-term viability and model development to facilitate project design, if necessary.
Project Design
The selected Entity can subcontract project design elements as desired. Any sub-awards must comply with FWS solicitation and procurement laws. The selected Entity will provide conceptual designs, including preliminary conceptual designs to describe potential strategies for achieving the project goal based on the restoration potential. Conceptual designs will be discussed with the Partners before selecting an approach for final design. The selected Entity will provide all necessary and standard numerical and engineering details for each viable restoration/stabilization approach. The final design phase will focus on creating plan sheets and construction documents that will be used during the construction phase along with a final cost estimate.
The Entity will also be responsible for assisting with project permitting, including providing the necessary permitting information to the Service and participating in pre-construction permitting meetings with the U.S. Army Corps of Engineers and the Missouri Department of Natural Resources, as well as State Historical Preservation Office. The Entity will provide maintenance and monitoring plans prior to initiating construction to be approved by the Service.
Project Construction
The selected Entity will:
Provide complete construction oversight and management for implementation of the entire final design specifications, including certification of all work and subcontracts.
Be able to subcontract project construction, as needed.
Be responsible for developing and implementing post-construction maintenance and monitoring plans for five years post-construction, including corrective measures if the project doesn’t perform as anticipated.
Specifications
The following specifications are required for this project.
Excavation and disposal of accumulated sediment to improve habitat and improve low flow.
Create habitat complexity within the side channel.
o Preferably using bioengineering techniques if applicable.
Improve low flow conditions in the side channel for habitat and water quality. The side channel should maintain flow at least 30cfs when Bagnell Dam is releasing 900cfs.
Improve crossing to the island to help maintain flow and habitat conditions in the side channel.
o Design a crossing near existing crossing location that allows at least 30cfs of flow at base flow (i.e. when Bagnell Dam is releasing 900cfs). For aquatic habitat purposes, preferably at least 50% of the side channel width should be open under the new crossing.
o Crossing should allow access to the island while accommodating at least 15,000cfs.
Crossing designs should consider the hydropeaking flows from Bagnell
Dam which can increase from 900cfs to over 30,000cfs in a day.
o Landowner(s) will be invited to participate during the design phase to accommodate their needs and ensure modifications to the crossing would not occur in the future while helping to promote project integrity and success.
For consideration after award:
The landowner would like to be involved with the design of the crossing to the island.
o The Entity will work with the landowner during design phases to ensure the crossing meets the restoration needs and access needs of the landowner.
An agreement will need to be made with the landowner that outlines maintenance, expectations, and modifications. If modifications occur, the landowner will be responsible for reimbursement.

D5. Intergovernmental Review An intergovernmental review may be required for applications submissions from a U.S. state or local government prior to submission. Applicants must contact their State’s Single Point of Contact (SPOC) to comply with the state’s process under Executive Order 12372. The State Single Point of Contact list is available on the OMB Office of Federal Financial Management website.
D6. Funding Restrictions Indirect Costs: Individuals Individuals applying for and receiving funds separate from a business or non-profit organization they may operate are not eligible to charge indirect costs to their award. If you are an individual applying for funding, you must not include any indirect costs in your proposed budget.
Indirect Costs: Organizations The Federal awarding agency that provides the largest amount of direct funding to your organization is your cognizant agency for indirect costs, unless otherwise assigned by the White House Office of Management and Budget (OMB). If the Department of the Interior (DOI) is your organization’s cognizant agency, the Interior Business Center (IBC) will negotiate your indirect cost rate. Contact the IBC by phone 916-930-3803 or using the IBC Email Submission Form. See the IBC Website for more information.
Organizations must have an active Federal award before they can submit an indirect cost rate http://www.sam.gov https://www.grants.gov/help/html/help/Register/RegisterWithSAM.htm https://www.grants.gov/help/html/help/Register/RegisterWithSAM.htm https://www.archives.gov/federal-register/codification/executive-order/12372.html https://www.whitehouse.gov/omb/management/office-federal-financial-management/ https://www.whitehouse.gov/omb/management/office-federal-financial-management/ https://ibc.doi.gov/ICS/contact-us https://ibc.doi.gov/ICS/contact-us https://ibc.doi.gov/ICS/icrna proposal to their cognizant agency. Failure to establish an approved rate during the award period renders all costs otherwise allocable as indirect costs unallowable under the award. Recipients may not shift unallowable indirect costs to another Federal award unless specifically authorized to do so by legislation.
Required Indirect Cost Statement to be submitted by Organization:
U.S. state or local government entities receiving more than $35 million in direct Federal funding must include the following statement in their application and attach a copy of their most recently negotiated rate agreement:
We are a U.S. state or local government entity receiving more than $35 million in direct Federal funding. We submit our indirect cost rate proposals to our cognizant agency. Our current indirect cost rate is [insert rate]. Attached is a copy of our most recently negotiated rate agreement/certification.
U.S. state or local government entities receiving $35 million or less in direct Federal funding must include the applicable statement from this list:
We are a U.S. state or local government entity receiving $35 million or less in direct Federal funding. We prepare and retain for audit an indirect cost rate proposal and documentation per 2 CFR 200, Appendix VII. Our current indirect cost rate is [insert rate], which is charged against [insert a complete description of the direct cost base used to distribute indirect costs to the award].
We are a U.S. state or local government entity receiving $35 million or less in direct Federal funding. We have not prepared an indirect cost rate proposal and documentation per 2 CFR §200, Appendix VII and elect to charge the de minimis rate of 10% of Modified Total Direct Costs as defined in 2 CFR §200.1. We understand we must use this methodology consistently for all Federal awards until we choose to establish a rate per 2 CFR §200. We understand we must notify the Service in writing if we establish a rate that changes the methodology used to charge indirect costs during the award period. We understand that additional Federal funds may not be available to support an unexpected increase in indirect costs during the project period and that such changes are subject to review, negotiation, and prior approval by the Service.
All other organizations must include the applicable statement from this list and any related documentation in their application. Please note, an organization with a current negotiated (including provisional) rate may not elect to charge the 10% de minimis rate of Modified Total Direct Costs during the period covered by their current negotiated rate.
We are an organization with a current negotiated indirect cost rate. In the event we receive an award, we will charge indirect costs per our current negotiated rate agreement.
Attached is a copy of our current rate agreement.
We are an organization with a negotiated indirect cost rate that has expired. Attached is copy of our most recently negotiated rate agreement. If we receive an award, we will submit an indirect cost rate proposal to our cognizant agency within 90 calendar days after the award date. We understand we must provide the Service a copy of our approved rate agreement before charging indirect costs to the Federal award.
We are an organization that has never negotiated an indirect cost rate with our cognizant agency. Our indirect cost rate is [insert rate], which is charged against [insert a complete description of the direct cost base used to distribute indirect costs to the award]. If we receive an award, we will submit an indirect cost rate proposal to our cognizant agency within 90 calendar days after the award date. We understand we must provide the Service a copy of our approved rate agreement before charging indirect costs to the Federal award.
We are an organization that does not have a current negotiated (including provisional) rate. In the event an award is made, we elect to charge the de minimis rate of 10% of Modified Total Direct Costs as defined in 2 CFR §200.1. We understand we must use this methodology consistently for all Federal awards until such time as we negotiate a different rate with our cognizant agency. We understand that we must notify the Service in writing if during the award period we establish a rate that changes the methodology used to charge indirect costs to the award. We understand that additional Federal funds may not be available to support an unexpected increase in indirect costs and that such changes are subject to review, negotiation, and prior approval by the Service.
We are an organization submitting a [insert either “Cooperative Fish and Wildlife Research Unit Program” or “Cooperative Ecosystem Studies Unit Network”] project proposal, which has an indirect cost rate cap of [insert rate; CRU is currently 15%; CESU is currently 17.5%]. In the event we receive an award, we understand that if we have a current negotiated (including provisional) rate we must charge the program’s capped indirect cost rate to the same base identified in our approved indirect cost rate agreement, per 2 CFR §1402.414. If we do not have current negotiated (including provisional) rate, we understand we must charge the capped indirect cost rate against Modified Total Direct Costs (MTDC) as defined in 2 CFR §200.1.
We are an organization that will charge all costs directly.

E2. Review and Selection Process Prior to award, the program will review any applicant statement regarding potential overlap or duplication between the project to be funded and any other funded or proposed project in terms of activities, funding, or time commitment of key personnel. Depending on the circumstances, the program may request modification to the application, other pending applications, or an active award, as needed to eliminate any duplication of effort, or the FWS may choose not to fund the selected project.
The program may not make a Federal award to an applicant that has not completed the SAM.gov registration. If an applicant selected for funding has not completed their SAM.gov registration by the time the Bureau is ready to make an award, the program may determine that the applicant is not qualified to receive an award. The program can use that determination as a basis for making an award to another applicant.
Prior to award, the program will evaluate the risk posed by applicants as required in 2 CFR §200.206. Prior to approving awards for Federal funding in excess of the simplified acquisition threshold (currently $250,000), the Bureau is required to review and consider any information about or from the applicant found in the Federal Awardee Performance and Integrity Information System. The Bureau will consider this information when completing the risk review. The Bureau uses the results of the risk evaluation to establish monitoring plans, recipient reporting frequency requirements, and to determine if one or more of the specific award conditions in 2 CFR §200.208 should be applied to the award.
Applications will be reviewed in their entirety and not on an objective-by-objective or method-by-method basis. Proposals that include components that do not adequately satisfy the review https://www.ecfr.gov/current/title-2/subtitle-A/chapter-II/part-200/subpart-C/section-200.206 https://www.ecfr.gov/current/title-2/subtitle-A/chapter-II/part-200/subpart-C/section-200.206 https://www.ecfr.gov/current/title-2/subtitle-A/chapter-II/part-200/subpart-C/section-200.208 https://www.ecfr.gov/current/title-2/subtitle-A/chapter-II/part-200/subpart-C/section-200.208 criteria above will receive lower overall scores even if other components rank highly. A panel of Service biologists will review the proposals for eligibility. Eligible applications will be reviewed by a panel of Service and MDC biologists. Outside experts (non-agency) will be solicited to augment the review team or to review specific proposals ad-hoc, as needed. Reviewers will evaluate each proposal and assign Excellent, Adequate, or Insufficient for specific topics within the criteria identified above.
Each proposal will be reviewed by at least three independent reviewers. Failing any additional concerns, the highest scoring proposals will be recommended by the review team for funding by the Service. The Service reserves the right to make all final decisions, and will share final decisions with MDC and any outside experts prior to release. If no acceptable proposals are received, modifications or additional proposals will be requested.
Prior to participating in any review or evaluation process, all staff and peer reviewers, evaluators, panel members, and advisors must sign and return to the program office point of contact the “Department of the Interior Conflict of Interest Certification” form. For a copy of this form, contact the Service point of contact identified in the Agency Contacts section below.
Prior to award, the Service reviews the selected applicant’s statement regarding potential overlap or duplication in terms of activities, funding, or time commitment of key personnel and makes a determination regarding Service funding. Depending on the circumstances, modification of the application, other pending applications, or an active award may be necessary, or the Service might choose to not fund the proposed project.
E3. CFR – Regulatory Information See the Service’s General Award Terms and Conditions for the general administrative and national policy requirements applicable to Service awards. The Service will communicate any other program- or project-specific special terms and conditions to recipients in their notices of award.
E4. Anticipated Announcement and Federal Award Dates Awards will be announced and issued prior to summer 2022.
F. Federal Award Administration Information
F1. Federal Award Notices Following review, applicants may be requested to revise the project scope and/or budget before an award is made. Successful applicants will receive written notice in the form of a notice of award document. Notices of award are typically sent to recipients by e-mail. Award recipients are not required to sign/return the Notice of Award document. Acceptance of an award is defined as starting work, drawing down funds, or accepting the award via electronic means. Awards are https://www.fws.gov/library/collections/financial-assistance-general-award-terms-and-conditions based on the application submitted to, and as approved by, the Service. The notice of award document will include instructions specific to each recipient on how to request payment. If applicable, the instructions will detail any additional information/forms required and where to submit payment requests. Applicants whose projects are not selected for funding will receive written notice, most often by e-mail, within 30 days of the final review decision.
