JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

Upon the basis of the following jttsttjication, I, as Contracting Officer, hereby approve the proposed sole source acquisition being conducted under the authority of the Exceptions to Fair Opportttnity Process (FAR ]6.505(b)(2)(i)(c) and (d)

(1)Identification of the agency and the contracting activity: U.S. Department of Housing and Urban Development, Office of the Chief Procurement Officer, Northern Field Contracting Operations, Wanamaker Building, 100 Penn Square East, Philadelphia, PA 19107

(2)Nature and/or description of the action being approved: Authority to award a sole source task order on a sole source basis to provide marketing support services for the entire HUD housing market surveys program which includes the American Housing Survey (AHS), the Rental Housing Finance Survey (RHFS), the Survey of Market Absorption of New Apartments (SOMA), the Manufactured Homes Survey (MHS), and the Survey of Construction (SOC).

(3)A description of the supplies or services required to meet the agency’s needs (including the estimated value): This requirement is for the Office of Policy Development and Research (PD&R). The purpose of this Task Order is to provide marketing support services for HUDs housing surveys. Marketing support will accomplish three goals:

o Expand the survey user base through targeted marketing of survey data to various user groups, including social media marketing;

o Develop survey data products such as factsheets or infographics that are tailored to the needs of specific user groups; and o Perform targeted outreach and assistance to current survey data users through development, production, and scheduling of new live or recorded webinars, updating of existing webinars, publishing of messages for the HUD housing survey user community, and publication of short articles about HUD’s housing surveys.

The services are logical follow-on work and consist of the continued development and execution of the departmental marketing plan, social media outreach and management, development of survey products such as infographics, factsheets, and articles), development of new webinars and engagement with the portfolio’s user community through the various list serves. The period of performance on this order is one year (12 months). The total value for this order is $422,190.00.

(4)Exception to fair opportunity and the supporting rationale: The authority permitting an exception to fair opportunity is Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(C) logical follow-on and (D), to satisfy the minimum guarantee. The services being ordered are a logical follow-on to task orders number 002, and $65431 1$F00009, issued against Contract Number DU2O3NP-15-D-07 (Penngood, LLC). This requirement is the logical follow-on requirement to encapsulate all phases of the IMP. Penngood, LLC has performed and satisfactorily completed the second phase of this effort under task order $65431 1$F00009 on 4/30/20 19. The vendor is familiar with the requirements and has data and webinars that can be utilized to support this effort and further define the IMP. This follow on is in the best interest of HUD as the vendor understands and can execute HUD’s requirement efficiently and effectively.

In addition, the issuance of this order will also satisfy the minimum guarantee against Contract Number DU2O3NP-15-D-07 as there is no other planned work anticipated to be issued against this contract during this last option year.

A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable: The Contracting Officer in consultation with technical personnel determined that the proposed price of $422,190.00 covered by this order is considered fair and reasonable. The hourly rates utilized to support this order were already negotiated and deemed fair and reasonable during award of the DIQ. The level of effort (man hours) and labor classifications are appropriate for this type of work and less than the prices offered when compared to current market pricing and other historical data.

(6) Any other facts supporting the justification: None.

(7) Actions the agency may take to remove or overcome any barriers that led to the exception to fair opportunity: The justification will be posted to Federal Business Opportunities (FBO) and will remain on FBO for 30 days. This will allow HUD to receive and evaluate any industry input on new methodologies to obtain the Integrated Marketing Survey for any future requirements. HUD will continue to review data in the industry and commercial market. Should other acceptable sources be known to HUD that will meet its needs, appropriate action to ensure open competition or fair opportunity will be provided. The DIQ contract was issued competitively and posted to Federal Business Opportunities and awarded to three vendors on a competitive basis. Other than the situation described herein, HUD intends to issue future orders utilizing the fair opportunity procedures to the maximum extent practicable.
