JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

BRAND NAME ACQUISITION

This justification is in accordance with FAR 13.501 – Special Documentation Requirements (Deviation 2018-O0018) using the format at 6.303-2 as follows:

(1) IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY

DOI/NPS/HFC-ConOps National

(2) NATURE AND/OR DESCRIPTION OF THE ACTION

The purpose of this contract is to provide the NPS/ Facility, Service and Property (FSP) with a newly developed database and to provide Publications (PUBS), Media Development (MD), and Museum Conservation Services (MCS) with ongoing FileMaker database updates and new development, in accordance with the following Scope of Work. A new dashboard shall also be created to pull information from all the other databases for reporting purposes. This action will allow for a continuation of remote and on-site support services throughout the next fiscal year.

(2) DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE

AGENCY’S NEEDS (INCLUDING THE ESTIMATED VALUE)

FileMaker Pro Development Services (Estimated Value: $150,000.00)

(4) IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING

OTHER THAN FULL AND OPEN COMPETITION.

FAR 6.302-1(a)(2) – Only one responsible source and no other supplies or services will satisfy agency requirements.

(5) DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE

OF THE AUTHORITY CITED.

The Harpers Ferry Center currently has existing databases and needs the support from a certified/authorized reseller to successfully maintain its integrity. They greatly enhance/improve productivity and workflow of the Publications, Media Development, Conservation and Facilities, Services, and Property sections. Since 2018, the Harpers Ferry Center has procured FileMaker Pro Developer. It would be highly cost prohibitive to solicit to vendors that use a different development software. Personnel at the center are already trained and proficient with the FileMaker Pro. With that being said, the existing infrastructure has passed all security requirements and has maintained licensing throughout the life of the databases. Future procurements with another software provider will again, add significant duplication of costs and efforts, as well as the potential to miss or delay timely completion of the National Park Service’s ongoing contract deliverables.

(6) DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE,

INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS

REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION

UNDER 5.202 APPLIES.

The Government intends to issue a combined synopsis/solicitation for commercial items in accordance with the format in FAR 12.6 to authorized/certified FileMaker Pro vendors.

(7) DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE.

FileMaker Pro is commercially available and has an extensive consumer market, including numerous Government agencies. Filemaker Pro development is competitively priced with other similar products.

(8) DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (SEE PART 10)

AND THE RESULTS OR A STATEMENT OF THE REASON MARKET

RESEARCH WAS NOT CONDUCTED.

Market research was conducted for authorized Filemaker Pro partners both online, and through historical data for contracts awarded in three previous fiscal years. There is a network of 72 certified resellers in the United States. This is a commercial, off-the-shelf product, so adequate price competition exists.

(9) ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION, SUCH AS:

(i) Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available. N/A

(ii) When 6.302-1 is cited for follow-on acquisitions as described in 6.302-1(a)(2)(ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived. N/A

(iii) When 6.302-2 is cited, data, estimated cost, or other rationale as to the extent and nature of the harm to the Government. N/A

(10) A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN

INTEREST IN THE ACQUISITION.

REQUIRED.

Until compatibility is allowed, FileMaker Pro will be the primary development infrastructure for use by the Harpers Ferry Center’s Publications, Media Development, and FSP sections.

(12) CONTRACTING OFFICER CERTIFICATION THAT THE JUSTIFICATION IS

ACCURATE AND COMPLETE TO THE BEST OF THE CONTRACTING

OFFICER’S KNOWLEDGE AND BELIEF

The above justification is accurate and complete to the best of my knowledge and belief.

Based on the above information, it is recommended that the NPS renew its FileMaker Pro licensing and support to keep the NPS’s development databases in compliance with all security protocols, guidelines, STIGs, etc. FileMaker Pro is available by resellers throughout the market. Price competition can be obtained from these sources, allowing the NPS to solicit offers with adequate competition, as well as fair and reasonable pricing.
