FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

Naval Surface Warfare Center Indian Head Division (NSWC IHD), Contracts Division 023.

2. Description of the Action Being Approved

The Navy is executing a program to acquire a Flexible Cybersecure Radio (FlexCSR) that will replace the existing radio system and will utilize modularity to ensure interoperability with future Explosive Ordnance Disposal (EOD) robotic systems.

Per The Office of the President of the United States, Presidential Memorandum: Developing a Sustainable Spectrum Strategy for America�s Future, Dated 25 Oct 18, and the Advanced Wireless Services (AWS-3) auction of the of 1755-1850MHz band, the design objective is to have a frequency agile radio that can seamlessly accommodate future spectral restrictions.

The FlexCSR program adopted a development approach, utilizing modularity to ensure that future requirements or spectrum reallocation needs are rapidly met. Modularity is achieved by leveraging the Government-owned modular open architecture defined by the Interoperability Profile (IOP). Through this architecture, which complies with the Joint Architecture for Unmanned Systems (JAUS) SAE/AS-4 standard, FlexCSR is able to interface with other IOP-compliant systems, such as the Army Man Transportable Robotic System (MTRS) II platform. The FlexCSR system consists of a pair of radios: Unmanned Ground Vehicle (UGV) and Operator Control Unit (OCU).

The Government intends to award a sole source contract for the FlexCSR production to Tomahawk Robotics, who demonstrated the capability of meeting the FlexCSR requirement during the FlexCSR Phase II Engineering and Manaufacturing Development (EMD) which

J&A Number: FY22-FEB02-54.1 included integration of the Secure Cyber Module/End Cryptographic Unit (SCM/ECU), and pilot production effort under contract with John Hopkins University(JHU)/Applied Physics Lab

(APL), N00024-19-F-8031.

The FlexCSR Production Contract will be an Indefinite Delivery Indefinite Quantity (IDIQ) Firm Fixed Price (FFP) and Cost Plus Fixed Fee (CPFF) effort with a one (1) year base period of performance and four (4) 12-month option periods for the production and post production support for the FlexCSR systems, Depot Level Repair Parts (DLRP), initial consumable kits and repair parts. This effort includes the critical embedment of the U.S. Air Force (USAF) Mini Crypto (MC) into the SCM ECU, which is integrated into the radio design.

3. Description of Supplies/Services

This contract action is for the production, engineering support services (ESS), and post production support for a maximum of pairs of FlexCSR systems and DLRP FlexCSR Systems to address performance and reliability shortfalls, technology enhancements, and obsolescence issues on the baseline configuration. This action also provides for additional support of depot level repairs and spare parts for the duration of the contract. The anticipated period of performance (PoP) is one (1) 12-month base and four (4) 12-month option periods.

ESS will address hardware and software solutions to future capabilities as they are identified by the Government. The ESS efforts will include analysis, development, integration, and testing and may require labor, material, and travel expenditures.

The Government�s minimum needs have been verified by the certifying technical and requirements personnel.

The anticipated total estimated cost for this effort is $47,920,000.

require an additional $2.5M. The Government anticipates that the award to another vendor would jeopardize the mission readiness of the FlexCSR system, would delay fielding to the end-user for at least 24 months, and incur substantial duplication of cost to the Government.

Under EDM Phase II contract N00024-19-F-8031, Tomahawk Robotics delivered pairs of FlexCSR PPUs to demonstrate producibility and manufacturing to meet the requirement of producing pairs of FlexCSR systems and DLRP, scheduled to deliver in base year and option year I under this new contract.

The proposed contracting action is required because no other company can satisfy the Government�s requirements within the timeframe required. Delays in system deliveries impose an unacceptable risk to EOD technicians and the warfighters they protect. It is estimated that the cost to develop a new FlexCSR system that meets Government requirements would cost $10.4M for additional development, Government testing, and approval. In addition, it is estimated that another follow-on effort would take at least 24 months to develop and verify an alternate provider for FlexCSR, not including lead time for contracting.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

To further broaden market research and to satisify the requirements of DFARS PGI 206.302-1(d), a sources sought announcement was posted on SAM.gov on 28 April 2021. No responses were received.

As required by FAR 5.203, a pre-solicitation notice was publicized on SAM.gov on 17 February 2022. No responses were received.

7. Determination of Fair and Reasonable Costs

The Contracting Officer will determine that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable prior to contract award. This analysis will be conducted using price and cost analysis techniques as provided in FAR part 15.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, NSWC IHD has no plans to compete future contracts for the types of services and supplies covered by this document. If another potential source emerges, NSWC IHD will assess whether competition for future requirements is feasible.
