OVERVIEW
The primary project objective of this project is to improve universal accessibility which will conform to federal accessibility requirements at multiple units of Lake Cascade State Park (LCSP). The project will also improve overall visitor safety be reducing hazardous facilities and reducing tripping hazards.
RECIPIENT INVOLVEMENT
Pelican Cove Fishing Pier and Day Use Improvements: This project includes the development of an accessible fishing pier at the Pelican Cove unit of LCSP. The pier will be in compliance with accessibility requirements and will provide a unique fishing and scenic opportunity at the park. This project also includes the development of a precast concrete vault toilet and two accessible parking spaces. The parking area will connect to the vault toilet restroom and the fishing pier via an accessible hardened surface path, either asphalt or concrete. The existing gravel parking area will be improved to provide more defined parking areas and expanded to facilitate visitor flow.
Crown Point Dock System: The existing dock system at the Crown Point unit will be replaced, and access to the docks will be improved. This project will include the construction of an accessible pathway and the stabilization/replacement of the existing concrete landing platform connecting to the docks. The existing docks are currently accessed by a steep set up stairs leading down the bank. These stairs will be replaced by the ramp system along the hillside, leading to a 40’x8’ concrete transition platform. These elements will be designed to meet accessibility standards. The docks will also be replaced as part of this project. In total, 180 linear feet of docks will be purchased and installed, along with new gangways and anchoring system.
Blue Heron Boat Ramp/Day Use: This project will replace the handling docks, install accessible dock approaches, improve traffic flow and expand parking at the Blue Heron unit. The existing boat ramp docks will be replaced. Some dock sections currently at Blue Heron were moved from other less popular areas, and these sections will be returned to their original park unit. This project will install 240 linear feet of new dock at Blue Heron. The existing concrete abutments will be removed, and the asphalt adjacent to the boat launch will be expanded on the north and south sides of the boat ramp (1200 sf) to provide uniform access from the asphalt to the gangways, and to facilitate dock removal for the winter.
Van Wyck Day Use: This project will repair the asphalt abutment connecting the gangways to the boat ramp handling docks. This asphalt is damaged and does not provide accessible transitions onto the gangways.
RECLAMATION INVOLVEMENT
No substantial involvement on the part of Reclamation is anticipated for the successful completion of the objectives to be funded by this award. It is anticipated that Reclamation’s involvement will consist of standard federal stewardship responsibilities such as monitoring project performance, technical assistance at the request of the recipient, etc.
SINGLE-SOURCE JUSTIFICATION
DEPARTMENT OF THE INTERIOR
SINGLE SOURCE POLICY REQUIREMENTS
Department of the Interior Policy (505 DM 2) requires a written justification which explains why competition is not practicable for each single-source award. The justification must address one or more of the following criteria as well as discussion of the program legislative history, unique capabilities of the proposed recipient, and cost-sharing contribution offered by the proposed recipient, as applicable.
In order for an assistance award to be made without competition, the award must satisfy one or more of the following criteria:
(1) Unsolicited Proposal – The proposed award is the result of an unsolicited assistance application which represents a unique or innovative idea, method, or approach which is not the subject of a current or planned contract or assistance award, but which is deemed advantageous to the program objectives;
(2) Continuation – The activity to be funded is necessary to the satisfactory completion of, or is a continuation of an activity presently being funded, and for which competition would have a significant adverse effect on the continuity or completion of the activity;
(3) Legislative intent – The language in the applicable authorizing legislation or legislative history clearly indicates Congress’ intent to restrict the award to a particular recipient of purpose;
(4) Unique Qualifications – The applicant is uniquely qualified to perform the activity based upon a variety of demonstrable factors such as location, property ownership, voluntary support capacity, cost-sharing ability if applicable, technical expertise, or other such unique qualifications;
(5) Emergencies – Program/award where there is insufficient time available (due to a compelling and unusual urgency, or substantial danger to health or safety) for adequate competitive procedures to be followed.
Reclamation did not solicit full and open competition for this award based the following criteria:
(3) LEGISLATIVE INTENT
Single Source Justification Description:
16 USC 4601-13 requires in order for Reclamation to fund recreation and/or fish and wildlife enhancements at Reclamation reservoirs beyond that of “minimum basic facilities” a non-federal public body must indicate their intent in writing to agree to administer the project land and water areas for recreation or fish and wildlife enhancement.
Further, 16 USC 4601-12 states, “That it is the policy of the Congress and the intent of this Act that . . .
(b) planning with respect to the development of the recreation potential of any such project shall be based on the coordination of the recreational use of the project area with the use of existing and planned Federal, State, or local public recreation developments; and (c) project construction agencies shall encourage non-Federal public bodies to administer project land and water areas for recreation and fish and wildlife enhancement purposes and operate, maintain, and replace facilities provided for those purposes. . . “
Therefore, for Reclamation to fund recreation and/or fish and wildlife enhancement activities at its reservoirs, there must be a non-federal managing partner that has a current managing partner agreement with Reclamation for these activities. Reclamation does not have the discretion to award a financial assistance agreement for cost-sharing to any other entity except the managing partner in accordance with 16 USC 4601-13 et seq.
Reclamation and the Recipient have entered into managing partner agreement # 9-07-10-L1534 on July 1, 1999, for facilities at Lake Cascade State Park. This management agreement expires September 30, 2022.
STATUTORY AUTHORITY
Pub. L. 89-72 AS AMENDED: Reclamation Recreation Act of 1992, Pub. L. 102-575, Title XXVIII (16 USC 4601-13 et seq.)
16 USC 4601-18 (b): “The Secretary of the Interior is authorized to enter into agreements with Federal agencies or State or local public bodies for the administration of project land and water areas and the operation, maintenance, and replacement of facilities … as will best promote the development and operation of such lands or facilities in the public interest for recreation and fish and wildlife enhancement purposes.”
Reclamation has entered into an agreement with IDPR to manage the lands surrounding Lake Cascade.
This agreement will supplement that agreement by allowing IDPR to construct ADA accessible facilities within the park which are outside of the scope of the original agreement. These facilities will further promote the development and operation of Reclamation’s lands being managed by IDPR.
