B.3 PERFORMANCE WORK STATEMENT
1. SCOPE: The Contractor shall incubate, process, and analyze Gloved Fingertip and Thumb (GFT)
Samples, Media-fill Test (MFT) Samples, Viable Active Air Samples, and Viable Surface Samples according to 2023 USP standards. The Contractor shall also report results and details about the incubation process including the requirements outlined in the 2023 USP. The media/plates/paddles will be provided by VA Northern California Health Care System (VANCHCS) in coordination with the Contractor. The samples will be collected by qualified staff of the VANCHCS and will be shipped to the Contractor at the cost of the VANCHCS.
2. SERVICES TO BE PROVIDED:
2.1. Gloved fingertip and thumb (GFT) sample incubation and sample analysis.
2.2. Media-fill testing (MFT) sample incubation and sample analysis.
2.3. Bacteria and fungi surface sample incubation and sample analysis.
2.4. Bacteria and fungi active air sample incubation and sample analysis.
2.5. Microbial identification to at least the genus level of viable surface samples and viable active air samples exceeding the cell forming units (cfu) action levels listed in 2023 USP.
2.6. Fixed pricing for microbial identification shall include all isolates identified on one sample (e.g., per sample plate, per both sides of media paddle).
2.7. Incubation shall start on the day of the receipt of the samples.
2.8. Sample media for GFT and Surface Sample may include media plates or two-sided media paddles.
3. The Contractor shall incubate and process personnel related assessment GFT samples according to
2023 USP standards. GFT results will be reported for each plate/paddle, with the amount of colony forming units (cfu) present on each plate reported. No growth present shall be indicated on the report as < 1 cfu.
4. The Contractor shall incubate and process personnel related assessment MFT samples according to
2023 USP standards. MFT results will be reported as negative (pass) or positive (fail); failure is indicated by visible turbidity or other visual manifestations of growth in the media in one or more container–closure unit(s) on or before fourteen (14) days.
5. The Contractor shall incubate and process viable surface samples according to 2023 USP standards.
Surface sample results will be reported in number of cfu. If cfu measured during viable sampling exceed USP action levels, the report will at a minimum identify genus and, when possible, species of any microorganism recovered on the report. No growth present shall be indicated on the report as 0
(zero) cfu or < 1 cfu. All samples will be processed as single media dual incubation.
6. The Contractor shall incubate and process viable active air samples according to 2023 USP standards.
Active air sample results will be reported in number of cfu.
7. The Contractor shall report the receipt of samples via email within two days of receipt. This report shall at least list the number of samples and their condition.
8. The Contractor shall report the incubation dates, time period, and incubation temperature for each sample. The report shall also contain the condition of the sample at receipt, the type of media, the Lot number, and the expiration date. Reports will be made available digitally via email no later than 3 days after incubation of the samples.
9. TERMS AND CONDITIONS:
9.1. Qualifications: The contractor will provide proof of ISO 17025 accreditation and shall be able to perform the above services without outsourcing.
9.2. Exclusions: Contractor does not provide the media/paddles/plates, the collection, or the shipping of the samples.
9.3. Information Security: The contractor will not access any computer system or protected health information at the VA Northern California Health Care System. The C&A requirements do not apply, and a Security Accreditation Package is not required.

SECTION C - CONTRACT CLAUSES
C.1 52.212-4 CONTRACT TERMS AND CONDITIONS—COMMERCIAL
PRODUCTS AND COMMERCIAL SERVICES (NOV 2023)
(a) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. The Government must exercise its post-acceptance rights—
(1) Within a reasonable time after the defect was discovered or should have been discovered; and
(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.
(b) Assignment. The Contractor or its assignee may assign its rights to receive payment due as a result of performance of this contract to a bank, trust company, or other financing institution, including any
Federal lending agency in accordance with the Assignment of Claims Act (31 U.S.C. 3727). However, when a third party makes payment (e.g., use of the Governmentwide commercial purchase card), the
Contractor may not assign its rights to receive payment under this contract.
(c) Changes. Changes in the terms and conditions of this contract may be made only by written agreement of the parties.
(d) Disputes. This contract is subject to 41 U.S.C. chapter 71, Contract Disputes. Contractor shall proceed diligently with performance of this contract, pending final resolution of any dispute arising under the contract.
(e) Definitions. The clause at FAR 52.202-1, Definitions, is incorporated herein by reference.
(f) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence such as, acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the
Contracting Officer of the cessation of such occurrence.

(vi) Terms of any discount for prompt payment offered;
(vii) Name and address of official to whom payment is to be sent;
(viii) Name, title, and phone number of person to notify in event of defective invoice; and

Transfer—System for Award Management, or 52.232-34, Payment by Electronic Funds Transfer—Other
Than System for Award Management), or applicable agency procedures.
(C) EFT banking information is not required if the Government waived the requirement to pay by
EFT.
(2) Invoices will be handled in accordance with the Prompt Payment Act (31 U.S.C. 3903) and Office of Management and Budget (OMB) prompt payment regulations at 5 CFR part 1315.
(h) Patent indemnity. The Contractor shall indemnify the Government and its officers, employees and agents against liability, including costs, for actual or alleged direct or contributory infringement of, or inducement to infringe, any United States or foreign patent, trademark or copyright, arising out of the performance of this contract, provided the Contractor is reasonably notified of such claims and proceedings.

(B) Affected contract number and delivery order number, if applicable;
(C) Affected line item or subline item, if applicable; and
(D) Contractor point of contact.
(ii) Provide a copy of the remittance and supporting documentation to the Contracting Officer.
(6) Interest.
